@9and10News This means the jury can only consider a second degree murder charge. First degree conviction is not an option #babykate

The defense also wants manslaughter to be an option for jury. Judge has not decided on that yet. That charge has a 15-year maximum.

:tyou: byo for keeping this discussion up to date. Early in the case, there was some local (Detroit) media coverage, but I haven't seen or heard anything about it for months. Hopefully, there will be mention of the case locally when there's a verdict. I hope it's tomorrow.

It's difficult to successfully prosecute a (presumed) murder case without a body. There's a thread about such cases elsewhere on the forums.

This is a Detroit case in which D'Andre Lane, father of 2-year-old Bianca Lily Jones, was sentenced to LWOP for her suspected murder. Remains have never been found.

1st degree murder charge thrown out in 'Baby Kate' trial

Posted: 2:25 PM, October 11, 2016

LUDINGTON, Mich. - A judge has acquitted a northern Michigan man of first-degree murder in connection with the disappearance of his 4-month-old daughter.

Mason County Judge Peter Wadel issued a directed verdict Tuesday on the charge against 26-year-old Sean Phillips and said he will allow the jury to consider a second-degree murder charge that doesn't include premeditation and allows for parole...

First-degree murder no longer an option in Baby Kate trial
Barton Deiters and 24 Hour News 8 web staff Published: October 11, 2016, 10:40 am; Updated: October 11, 2016, 5:35 pm

Glancy is fighting to give the jury the option of finding his client guilty of the lesser charge of manslaughter.

“I believe that’s the only issue that should go in front of the jury is whether or not this was a manslaughter or it was an accident,” he told the judge.

The judge did not mention manslaughter when going over instructions Tuesday afternoon, but the defense told 24 Hour News 8 they are confident that involuntary manslaughter will be an option for the jury.

Phillips is in the fourth year of a 10- to 15-year sentence for the unlawful imprisonment of Baby Kate. If Glancy has his way, that sentence might not be much longer if a jury can find his client guilty of manslaughter, which carries a maximum sentence of 15 years.

Is this trial not being streamed anymore? I've been trying to find it on YouTube and I can't see anything.

What SHOULD happen today: The defense will rest its case, then jury instructions, then closing statements, then jury deliberations.

What COULD happen: the AG appeals the judges decision and the trial halts. Sean Phillips takes the stand (Unlikely). We should know soon.
