LUDINGTON, Mich. - A Ludington father was sentenced to 19 to 45 years in prison on Friday in the murder of his 4-month-old daughter.

Parole - The Parole Process


PAROLE BOARD DECISIONS Normally, the prisoner first comes to the attention of the Parole Board as he/she nears the end of the minimum term imposed by the court. The date of parole eligibility is often called the Earliest Release Date (ERD). Approximately 8 months prior to the parole eligibility date, a Parole Eligibility Report is prepared and the prisoner will be scheduled for consideration by the Board. The Board considers many factors to determine whether parole should be granted. State law holds that "A prisoner shall not be given liberty on parole until the board has reasonable assurance, after consideration of all of the facts and circumstances, including the prisoner's mental and social attitude, that the prisoner will not become a menace to society or to the public safety." Most prisoners are interviewed by one member of the Parole Board. The scope of the interview includes the prisoner's criminal, social and substance abuse history, previous adjustment on parole or probation, conduct in prison, programming, parole plans, and other factors. The prisoner may have a representative at the interview, although the representative cannot be another prisoner or an attorney. The parole decision is made by majority vote of a three member panel of the Board. If granted a parole, the prisoner is allowed to return to the community under the supervision of a Parole Agent for a specified term. The release is conditioned upon the parolee's compliance with terms set by the Parole Board.

Phillips does get credit for the three years he has been in prison after he was arrested for murder, meaning he will spend at least 16 more years in prison.

This judge seems to be in love with this baby killer.

Pendergast wanted to see Sean Phillips convicted of first-degree murder which means life without parole. But Mason County Judge decided that only second-degree murder or manslaughter would be on the table.


The jury chose murder.


In court Friday, Pendergast asked the judge to throw the book at 27-year-old Phillips.


“The harm that the defendant has inflicted, not only on his family, not only on Ariel, but on this community as well should all be taken into account,” Pendergast said. “I would ask the court for 40 to 75 years.”

Friday, the judge shaved several years off the sentencing guidelines intended to help a judge decide how much time to give a convict. He decided that the prosecution did not show that psychological trauma requiring professional help resulted from the murder.

This stupid judge didn't even require him to divulge where he dumped his little precious baby girl before he gave him his light sentence. To me, that is shameful.

This is the same judge who years ago ruled that he couldn't be tried for murder because they had no body.. A grand jury decided otherwise and now the has been convicted. But, he still hasn't told what he did with her after he murdered her.

The judge told the court Phillips he wasn't evil. I certainly disagree, he is the personification of evil.

LUDINGTON, Mich. (AP) —
The Michigan appeals court has affirmed the conviction of a man who was charged with murder in the disappearance of his 4-month-old daughter in Mason County.

The body of Katherine Phillips still hasn’t been found. But the appeals court says there was plenty of circumstantial evidence pointing to the death of “Baby Kate.”

Good job MI Supreme Court.
This needs to rot in prison. I hope his fellow criminals beat the poo out of him at every opportunity. Does anyone know what the mother is doing and how she is?
