I looked again at the news articles from the day of the initial crime, the murder: 2 eye witnesses both say Hoffman shot the other man (Phillips) once 'face on', and Phillips then tried to run. Hoffman shot Phillips in the back and Phillips fell to the parking lot pavement. Phillips then screamed for his life, 'No, no, no, please!' and Hoffman stood right over him and shot him 'point blank' in the head. Phillips did some gasping for air, but that was the end of his life there.

An eyewitness to the arrest says he had seen Hoffman before the arrest but thought the man was 'too skinny' to be Hoffman, so this eyewitness was not the person who phoned police. The eyewitness said Hoffman looked dirty and homeless and skinny, disheveled, beard stubble. So it seems that Hoffman had really been in the area of the casino since the police last saw him, on the streets 'in suburbia' as a homelss person. The eyewitness said Hoffman looked out of place. So, if Hoffman had been in the Twin Cities metro' as a homeless person, he would have blended-in with the locals better, but there also are plenty of police roaming Mpls. and St. Paul. I wonder who it was in the northern suburb area (called 'Blaine') who had been helping Hoffman - I wonder if that will come out in due time. HOFFMAN TO APPEAR IN COURT TODAY - 1st MUGSHOT
Could somebody here please paste Hoffman's mugshot into a post, because I do not know how to do it. Hoffman will appear in downtown St. Paul MN court this afternoon and be charged with 2nd degree murder. Hoffman may still wind up charged with 1st degree murder but a grand jury would need to make that decision. I had thought, 'Oh, this is over now.' But this may be just the beginning. I think Hoffman needs a jury trial and he and his attorney team will need to trash the victim, and I bet there is going to be a whole lot of dirt that will come out, and much dirt that the prosecution will try not to be allowed entered into evidence or discussed. The man/fiance whom the victim was to marry last month will show up at court, along with a bunch of pals, and the victim's parents, and 6 siblings, and Hoffman's sister has spoken to the press so likely she'll be at the trial and chatting with the press as this unfolds.

imo, If you watch video of the victim's fiance (they're gay men), he seems like such an innocent and pure angel, and describes the victim as a gentle saint. http://minnesota.cbslocal.com/2014/08/14/fiance-of-lawyer-gunned-down-at-gas-station-speaks-out/ And, in contrast, Hoffman was lovers with the same man (the victim, Phillips) for 15 plus years, and now, in this murder, Hoffman and the victim were bickering and having a fight in a car together, and yelling at each other before it all happened. In other words, the victim seemed to have a few incongruent 'personalities/sides' about him. imo.

A murder charge unsealed Friday against Lyle “Ty” Hoffman revealed that authorities found his passport, folded clothes, prescription drugs and the ammunition magazine for a .45 caliber semiautomatic handgun in a suitcase at a friend’s Minneapolis condo.

The magazine contained 13 live rounds that matched bullet fragments recovered from the body of Kelly Phillips, the man Hoffman allegedly killed...

The criminal complaint against Hoffman showed that Phillips was killed on the one-year anniversary of his engagement to another man, Nathon Bailey. The two were to marry Aug. 30.
 
THE CRIMINAL COMPLAINT
I am not convinced that the murder was planned at all - it'd be interesting to know whether Hoffman routinely packed a pistol imo. It's interesting how many details you hear from the press and various witnesses, and pros', vary - obviously there's confusion and many mistakes and errors.

It's clear that Hoffman and the victim willingly were together at 0820am, in the victim's BMW, and they were loudly fighting as they stopped at a gas station side parking lot (not at the pump), and that gas station was very near the victim's workplace. So, I'm wondering why the victim would be with Hoffman in the first place: Was it a ruse where Hoffman sweetly phoned the victim that morning or txt'd and said his car was broken and could he borrow the victim's while victim was at his job? Was there a clandestine relationship going on the entire time after Hoffman and the victim publicly 'broke off' their relationship a few years ago? Also, what is wierd, is if you watch any video of the victim's fiance, you cannot imagine that the fiance would ever get into a heated fight, let alone argue! So, the victim seems to have a Dr Jekyll / Mr Hyde dark side to him. Friday, there is new information on where Hoffman was while he fled police... The latest criminal complaint shows that Hoffman was desperate and was close to being caught several times. For a month there were close encounters and clues...

Three weeks after the murder, surveillance video showed Hoffman walking into a TCF Bank in Blaine. He pointed a Glock semiautomatic handgun at the teller and demanded money. The teller put cash and a red dye pack in Hoffman’s backpack... On Sept. 1, surveillance video again showed Hoffman entering a Target store in Richfield where he bought a new backpack and a cell phone.

Later, video showed him getting on a bus to the Mall of America, and hours after that he took a cab to Mystic Lake Casino. Hoffman walked into the casino around 4:00 p.m. that day and played slots. He fed dyed money into the machines and got clean money out. The complaint said Hoffman also gambled at Little Six Casino. That night, casino surveillance video showed Hoffman going in and out of the woods before getting into a cab, which he took to a McDonald’s. Red dyed money was found at a business near that location.

Finally, on Sept. 11, Hoffman was arrested outside an Arby’s in Shakopee. He first told police his name was “Mark Lamar Royce,” but once in handcuffs, he admitted that he was Ty Hoffman. Police found over $3,000 in dye-stained money on Hoffman, along with a beard trimmer, mirror, and claim slip from the backpack he left at Mystic Lake... Hoffman had burns and red marks on his back consistent with the red dye pack that went off in his backpack.
 
Wow, imo this should be 1st degree murder. He will get more time for the bank robbery.

Lyle "Ty" Hoffman admitted Friday in a St. Paul courtroom that he shot his former boyfriend and business partner last summer at an Arden Hills gas station.

Hoffman, 44, pleaded guilty to one count of intentional second-degree murder of Kelly Phillips, 48, on Aug. 11.

He likely will be sentenced to 25 1/2 years, under a plea agreement, when he is sentenced March 17 in Ramsey County District Court.
