A motion to suppress some evidence and testimony was also filed. The evidence includes data from a phone number from March 31 to April 2. Bauer also motioned to suppress a statement Fravel made to the Rushford Police Department on April 2. According to the motion, Fravel was not read his Miranda Rights before interrogation.

Fravel’s attorneys also motioned to dismiss an aggravated sentence for lack of probable cause.

The prosecution team also filed a motion Friday. The team asked for an order prohibiting the defendant from seeking to admit evidence referencing the distribution, possession or use of controlled substance or prescribed medications by Madeline Kingsbury.

The order also asked any mental health or physical conditions not be brought up at trial. Finally, the prosecution teams asked that statements by Madeline Kingsbury during therapy or counseling sessions not be brought up as well.

Fravel's attorneys filed five motions for changes in this case Friday.

Among the biggest requests: dropping his first-degree murder charge, as his lawyers say there isn't sufficient evidence.

They also want his trial venue changed, arguing Fravel can't get a fair trial in Winona County because of the extensive media coverage surrounding this case.

A motion was also filed to suppress some evidence, including data from a specific phone number from March 31 to April 2 and a statement Fravel gave to the Rushford Police Department. His attorneys say he wasn't read his Miranda rights before he gave that statement.

The request also includes omitting evidence regarding Kingsbury's medical and mental health. They also don't want any statements Kingsbury made in therapy and counseling sessions to be brought up in trial.

KTTC reported over 2,000 volunteers showed up to look for Kingsbury in April 2023, and hundreds more searched for her in surrounding areas. Attorneys also argue KTTC used "clickbait" to draw in viewers that could suggest Fravel is guilty.

The defendant's attorney says the community members who have been exposed to the media coverage are now being asked to be jurors in the case.

The defense attorney also says the community held a "Justice for Maddi" coalition, including a float sponsored by the Winona County Sheriff's Office at Steamboat Days.

March 19 and 20 are two omnibus hearings. During these hearings, the defense and prosecution will present evidence related to the case and discuss pretrial motions.

On Monday, Winona County Attorney Karin Sonneman filed a motion for a proposed order restricting access to the grand jury transcripts that indicted Fravel on his first-degree murder charges. The motion also proposes a second restrictive order preventing public access to any pretrial filings made in the case regarding grand jury transcripts.

According to Sonneman, portions of the grand jury transcript and other evidence contain a substantial amount of information that has not been made public. Sonneman wrote the prosecution believes the proposed restrictive orders will ensure a fair trial for Fravel.

The attorney for Adam Fravel is seeking the change of venue, following extensive media coverage of the disappearance last March of his ex-girlfriend, Madeline Kingsbury. Madeline’s body was found in June, and Fravel was arrested the same week.

The man accused of murdering Madeline Kingsbury will be back in court Tuesday.

30-year-old Adam Fravel will appear in Winona County Court for a two-day hearing as he fights to move his trial out of the county.

Attorneys for Fravel have argued that heavy media coverage surrounding the case will prevent him from getting a fair trial in Winona County.

  • The prosecution and defense had originally planned to save discussion of an aggravated sentencing motion and dismissal of Fravel’s 1st-degree murder charges altogether until a third omnibus hearing April 30. However, the court will discuss those motions at day two of the omnibus hearing, March 20.

The only motion reviewed thoroughly Tuesday morning is the defense team asking the judge to suppress all statements made by Fravel from the day Kingsbury disappeared up until April 2.

Fravel's lawyers argue investigators failed to provide a Miranda warning to Fravel during the three interviews that occurred during that time period.

However, the lead investigators, who spoke under testimony, said Fravel was free to leave whenever and their only goal was to determine the truth and if he was a suspect.

The state worked to suppress evidence surrounding controlled substances. During the hearing, it was revealed there was marijuana usage in the relationship between Kingsbury and Fravel, but it is unclear by whom and how much. ...

The prosecution also argued to suppress statements Kingsbury may have made during therapy sessions. According to the lead prosecuting attorney Phillip Prokopowicz, witnesses said Kingsbury may have been in therapy regarding her relationship with Fravel. Prokopowicz said they have not been able to track down records of this.

The defense has asked the judge to drop the charge of first-degree premeditated murder, citing a lack of evidence. Buytendorp says she won’t rule on that motion until at least late May.

The defense also wants the state to drop its intent to seek an aggravated sentence — which would elevate Fravel’s punishment if convicted of second-degree murder, on the grounds of particular cruelty. Buytendorp will also rule on that motion later.

Kingsbury’s father shared with KIMT how his family has been coping with the latest developments in the case.

"There's probably a lot of things I could say, but wouldn't be very appropriate as the lawyer would say,” says David Kingsbury, “but I'll put this way... a journey of a thousand leaps begins with a single step and without a few baby steps and this is just another one and were checking off the boxes right now and were getting somewhere," said David Kingsbury, Father of Kingsbury

A Winona County Judge has issued an order restricting access to audio and video statements previously made by Adam Fravel to law enforcement as the trial in the murder of Madeline Kingsbury moves forward.

Prosecutors in the case filed for the restrictive order anticipating that they would enter exhibits and a complete transcript of grand jury proceedings.

According to the motion made by Fravel’s attorney, the restrictive order is to prevent access to audio and video statements by Fravel to law enforcement on 3/31/23, 4/1/23, and 4/2/23 because they “contain a substantial amount of material facts and information that has not previously been made public.”

“We just can’t really have much of a conversation. You know, there’s a restrictive order in place. We’ll be back on April 30th, still a change of venue once again. It’s really all I can say at this point,” Fravel’s defense attorney Zachary Bauer said.

Fravel will be back in court on April 30 for the third contested omnibus hearing. The possible change of venue will be the topic of discussion.

A trial date has not been set, however both parties are eyeing a fall 2024 date.

My thoughts will be with them next Sunday, on the one year anniversary of Maddie's disappearance. Which also happens to fall on Easter this year :(

Sunday marks one year since Winona, Minn. mother Madeline Kingsbury went missing, sparking a months-long search for her body and later the arrest of her ex-partner.

Kingsbury was last seen alive on the morning of March 31, 2023.

“We will always be loud and not just for Maddie, but for everyone who is dealing with domestic violence because we’re not going to stop,” Perlinger said.

In a post made on the Finding Madeline Kingsbury Facebook page on March 18, it said, in part, "As we approach a year of Maddi being taken from us there are a lot of emotions. The year has been a rollercoaster with time going to slow but also going to fast. She is in the thoughts of many of us daily. Our lives as well as the community have been affected by this loss. This year has been challenging but we are not done fighting for her justice."
 
Maddi's family first began worrying about her late in the afternoon of Friday, March 31, 2023, when Naber realized she had not heard from her daughter for nearly the entire day.

Naber contacted Megan, Maddi's older sister, but Megan said she was not overly concerned.

Megan Kingsbury: I sent her a couple of text messages anyway … "Hey mom, hasn't heard from you. Can you call her? Can you text her back? … She's concerned." … and she didn't reply to that.

Megan Kingsbury: He was outgoing, and seemed interested in getting to know us, and he seemed very, almost infatuated, I guess, with … Madeline.

Theresa Sis Mejia: He manned up, he manned up.

Theresa Sis Mejia, Fravel's sister, says Adam quit school to support his new family.

Theresa Sis Mejia: He knew he was gonna be a dad. He went and got a job … and he had that job up until COVID, and then he got laid off … while he let Maddi continue college so that she could graduate … and she did. She graduated and he supported her.
