Clay Waller pleads guilty

Clay Waller pleaded guilty to second degree murder
of his estranged wife Jacque Waller.

"20 years in prison is not what you deserve, but it will have to do," said Judge Benjamin Lewis.


The stipulations of the plea deal were that Waller had to provide the location of the body, law enforcement had to find the body, and he had to recount how he killed Jacque.

He told officials he struck Jacque in the head and face with his fist, put his forearm on her neck, and suffocated her with all of his body weight.

Did the family agree to this deal?
I'm guessing not since they didn't know they were going to find Jacque....
This should have been left up to the family.
Some families would rather find their loved ones and don't care if it means a shorter sentence.
Others would sacrifice finding them in order to have him get more prison time.

I think they would have wanted her body, seems they are very religious, just my opinion.

They weighed whether it was more important to give Clay what he deserves or give Jacque what she deserves.
Ultimately Jacque won out... she deserves to be laid to rest.

They had a VERY strong case. DNA evidence, they were able to track him.
Clay's defense team approached the state about the plea deal.

Jacque's father wanted Jacque back. They wanted Clay to get 20-25 years.
They asked his opinion on taking the plea deal.
Clay was narcissistic enough he would have never admitted it unless he had something to gain.

What was his motive since it was obviously premeditated since he dug the hole the day before?
He couldn't stand the thought of someone else raising his kids, or Jacque having a boyfriend.
He said he thought about doing this before but he decided not to carry it out before.
He premeditated it by having kids gone... so when she came to pick up their son he killed her.
He thought he had it planned out well and he thought he was smart... but he made a bunch of mistakes.
He is a liar and the truth doesn't live within him...

Clay Waller's primary motivation is Clay Waller. Anything he told us on Monday was geared toward protecting himself as much as possible while still meeting the requirements of the plea agreement.
I have no doubt he lied to us all day on Monday... and it was frustrating.
Him coming into court with his head hung low was just a show.

We met with Jacque's family prior to charging Clay. We discussed what they could live with.
20 years was what was agreed on in return for getting Jacque back.

Clay will be moved sooner rather than later.

What information did you get from the body?
There are a lot of family members present today.
We believe she was choked... when it's been 2 years when you recover the body we are limited.
We strongly believe she was strangled.

Her body was whole when we recovered it. He placed her in a trash can and transported her across the river to bury her.
I believe we are here because we had a very strong case.

Did any information come from the threatening of Jacque's sister. No.

Vehicle found by the interstate... did he in fact ride a bike that far?
We believe he did, he says he didn't. But he admits he did put the car there.

Was the body on public land or private land?
Private.
There is no connection to the landowner.

At the time it only would have been accessible by boat because of the river.

Clay told a lot of stories. But Clay admitted his guilt in front of the judge today.

Elaborate on some of Clay's mistakes.
Trying to hide evidence, fabricate evidence.
Tried to hide the carpet, probably his most critical error.
Stories he told that we couldn't confirm or evidence didn't support.

When investigators were there the first time the light in the hallway didn't work.
We did look at the carpet but we didn't look hard enough.
The carpet was there and then it wasn't there the next day. Critical.

I agreed not to charge him with anything like that in return for her body.

FBI opened up a federal kidnapping case when this started.
One of the FBI agents worked hand in hand with major case squad.
The presence of Jacque's body in Illinois when we found her...

It is still up in the air on whether the federal government will charge him. :please:
That federal kidnapping case is still open...
We will either close it or not depending on what the federal authorities decide to do.
 
Her body was treated with dignity and respect... we were able to bring her home.

Jacque had said she thought Clay would kill her and her father didn't believe her.

Stan said Clay didn't get what he deserved but he deserves everything he got.

He deserved a much harsher sentence for depriving those babies of their mom.

Second degree murder? It was premeditated, he dug her grave the day before he killed her.

I wonder how long it will be before he's out again, ready to victimize another woman?

Clay Waller was still being held in the Cape Girardeau County Jail in Jackson on Friday, but will likely be transferred back into the custody of federal authorities sometime next week before he heads to state prison for his second-degree murder conviction in the death of his estranged wife, Jacque Waller, Sheriff John Jordan said.

Clay Waller's son was arrested Monday on a domestic assault charge, online court records show.

James Clay Waller III, 21, was charged in October with one count of third-degree domestic assault.

Cape Girardeau County Jail records show he was arrested and later released Monday.
