The FBI sought information from Google for six phone numbers and two Gmail accounts believed to be associated with Defendant and sought information from Verizon on three cell phone numbers. Google’s Emergency Disclosure Request form asked the Government to provide a detailed explanation of the emergency, including information about how the threat involved the risk of death or serious physical injury to a person and when the harm might occur. Agent MacManus provided the following information to Google:

On September 8, 2019, the FBI was notified that a 5-year-old girl had been kidnapped by her father in Espanola, New Mexico. The father made statements to an associate which indicated he may have harmed or killed the 5-year-old or left her in a remote area. The father is in custody, but the 5-year-old has not been located. The 5-year-old was last seen around 4:00pm (MDT) on September 6, 2019. Due to the threat of serious injury or death to the child, the FBI is seeking an emergency disclosure of records.

CONCLUSION

Even assuming the FBI conducted a warrantless search of Defendant’s location data, the search was justified by exigent circumstances: Jane Doe had been missing for at least 24 hours and had been last seen with Defendant, who was giving friends, family, and law enforcement officers conflicting information about her whereabouts. The Court therefore DENIES Defendant's Defendant’s First Motion to Suppress.

Torres was heavily intoxicated and not fit to supervise the children. While in Torres’ care, Jane Doe sustained blunt-force trauma to her head, torso, and extremities. Torres became aware of Jane Doe’s injuries while she was still alive but failed to seek or provide necessary medical care. Torres claims he was too drunk to remember how he injured Jane Doe.

The man who admitted to killing his five-year-old stepdaughter, Renezmae Calzada, in 2019 has been sentenced. Malcolm Torres will spend the next 35 years in prison.

At Torres’ October 30, 2023, hearing, he apologized to Renezmae’s family. Torres was sentenced to 30 years, and family members unleashed their emotions on him in the courtroom.

Torres was given the sentence in exchange for pleading guilty in April to second-degree murder in the slaying of Renezmae Calzada.

He was facing a potential felony charge of first-degree murder, which could have brought life in prison.

After serving his sentence, Torres will be under supervised release for five years.

... The judge told the court this is one of the most difficult cases he has presided over.

Renezmae’s family told the court how much she loved her stepfather, and how much she looked up to him. They made sure to remind the court how he brutally beat her to death and dumped her body.

Her family wore black shirts with Renezmae’s photo on the back. They told KOB 4 after the hearing what a happy little girl she was. Her favorite movie was “Frozen,” and she loved Barbie dolls, books, and pink things.

Her family said she loved her baby brother, who was there with Renezmae and Torres on the day she was killed. They hope Torres thinks about her every day for the next 35 years – though they don’t think that’s enough.

“My daughter was absolutely beautiful, gorgeous – her smile would light up a room, her energy was just enough to rub off on you. I’m grateful for the little time I did have with her and I wish I had more,” said Victoria Maestas, Renezmae’s mother. “There is no sentence that will ever bring justice to a family who has lost someone.”

Torres did make a statement Monday. He apologized for killing Renezmae and asked for forgiveness.

Torres will spend the next 35 years in prison. In the federal system, he does have the opportunity to qualify for good time, which could potentially slice off 15% of that sentence.

Once he’s out, he cannot have any contact with children under the age of 18.

“This could have been your child. It could have been my child,” Raul Bujanda, FBI special agent in charge for the New Mexico district, told reporters Monday during a press conference. “She was a beautiful soul that was taken way too soon from us.”
