Timothy Dean in Wayne Co Court for hearing ahead of trial to go over possible evidence for trial. Special Agent with FBI from Texas on stand now testifying about transport from Dean’s house to police station for interview. Dean is accused of shooting two ppl in Sodus #13WHAM

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Special Agent says they interviewed Dean for more than 3-hrs. His Miranda rights were not read before this interview. The defense is now asking about this.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Defense questions Special Agent about the aggressive tactics of the Texas Ranger who was conducting the interview. Defense claims interviews video shows the Ranger getting nose to nose with his client and yelling calling him a coward and cussing.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Prosecutor asks about this - Special Agent says this is an interview tactic.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Judge asked follow up questions-Dean was handcuffed during transport to this interview and he was not able to leave room freely during interview.

Prosecutor calls next witness- Deputy Cory Nicolet from Kansas - he responded to crash Timothy Dean was in on K-130 in Kansas two days before shooting. He had body camera on at the time.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Vehicle he was driving was a rental - deputy testifies Dean told him his life had gone to **** and he was driving around. Trying to do a U-turn when he crashed. Dean also told deputy he was getting a divorce and was thinking about going to NY to see an old friend.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Deputy said Dean told him he worked at Frito O’Lay and a friend got the rental car he crashed for him. Deputy said the name on the agreement was Bron Bohlar. Bron is facing a conspiracy charge in this case.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Deputy said Dean told him he had two guns - deputy said in rural Kansas most people have guns.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
During the testimony Dean continues to keep his head forward and slightly down. He doesn’t appear to show emotion or look at the witnesses on the stand.

Detective Sgt. Tammy Ryndock with the #WayneCounty Sheriff’s Office now testifying. She interviewed Dean in Texas - she said this was after he was read his Miranda Rights.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Detective Sgt. said Dean told her he drove to Sodus shoot himself. He said he didn’t want to talk to them anymore and wanted an attorney. She said they continued to talk to him for 20mins after that because they wanted to get the gun used off the street.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Defense continues to talk about the Texas Ranger interview. The main interviewer Texas Ranger Ditto(sp?) is not here today to testify. Prosecutor tells us he had a heart attack and could not travel to testify today.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22
Says knew what they talked about after he wanted a lawyer would not be able to be used in court. But Detective Sgt. says she wanted more information to find gun.

    Kelsie Smith‏ @KelsieSmithWHAM Mar 22

Couple charged in Sodus double murder to stand trial together

SODUS N.Y. — A couple charged in connection to a double-murder in Sodus will face trial together in May.
    [.....]
At a court appearance Wednesday, Childers' attorney says she and Dean will be tried together next month.
    [.....]
Childers will be in court again Tuesday (4/16) for a pre-trial appearance.

She's been charged with conspiracy in the second degree and criminal possession of a weapon in the second degree.

Dean faces charges of first-degree murder, two counts of second-degree murder and two counts of criminal possession of a weapon.

and found another article with the trial date!! :)

Sodus woman, husband to face trial together in double murder case

Jury selection in the trial against Childers and Dean is now scheduled for May 15. The judge scheduled the trial to last two weeks.

"Unlike a typical trial where one DA and one defense attorney questions a witness, they'll most likely be questioned by myself and then two defense attorneys," said prosecutor Christine Callanan.

"Just based on that alone and separate proof that may apply to one and not the other, it makes the trial a little more in depth," she said.

    hmm.... must have missed something!

Second suspect pleaded guilty in Sodus double murder case

Lyons, N.Y. (WHAM) - Charlene Childers, one of three people arrested as part of a double murder investigation in Sodus last October, pleaded guilty to manslaughter and weapons charges on Tuesday.
    [.....]
After the plea hearing, defense attorney Rome Canzano said Childers' apologies were considered during the plea negotiation process.

"Very briefly and very humbly I will say they there are few that express more remorse than her," Canzano said. "And that played a factor in her decision."

Childers is scheduled to be sentenced on June 27 at 9:30 a.m. in Wayne County Court.

Judge rules statements made by Sodus double murder suspect can't be used at trial (with clip)

    Apr 24, 2019

"....In a hearing in March, attorneys reviewed video of interviews of Dean by Texas Rangers, the FBI and Wayne County Sheriff's Office. During the interviews, Dean didn't admit to the murders, but his attorney said he made statements that weren't voluntary. Dean's defense argued the video shouldn't be allowed at trial because Dean was never read his rights.

The judge agreed, ruling the evidence as inadmissible for trial. However, statements Dean made to Kansas deputies will be allowed.

Dean remains in Wayne County Jail. His trial is expected to start in May."
