Looks like he was in court on 7/18 for a pretrial hearing for murder charges.

Trial Date Set for Alberto Reyes


A trial date has been set for the Wayne County farm worker accused of killing a teenage mother and her 1-year-old son last year.

Alberto Reyes was in court on Thursday for a pre-trial hearing.

Prosecutors and the defense went over materials that will be involved in the trial, including how the bodies of Selena Hidalgo-Calderon and her son Owen were found.

Reyes is due back in court on August 21 for one last appearance to resolve outstanding matters in the case.

The trial is scheduled to start on September 16.

Man accused of murdering woman, son in Sodus close to federal plea deal

Rochester, N.Y. (WHAM) - The man accused of murdering his former girlfriend and her 14-month-old son in May 2018 in Sodus is in the process of negotiating a plea agreement for federal charges against him.

Federal paperwork filed on Tuesday morning by the attorney for Everardo Donoteo-Reyes, also known as Alberto Reyes, indicates that he will accept the proposed agreement "subject to U.S. Attorney's Office approval." The terms of the plea agreement were not disclosed as the agreement is not final. However, Reyes is facing federal charges for allegedly having a forged social security card and re-entering the US after being removed twice before.

The federal trial was pushed back to September. However, prosecuting federal attorneys could approve the plea agreement by mid-August and cancel the trial.

There is no word on a potential trial date for the state murder charges.

1/15/19 Update: Reyes requests a new lawyer (State charges). Also Federal charge of fraud & misuse of a permanent alien card, fraud & misuse of a Social Security card, & unlawful re-entry by a removed alien. The indictment was unsealed Jan. 10. He is scheduled to be arraigned on the new charges at 4 p.m. Thursday (1/17/19).
2/28/19 Update: Pretrial hearing was held. Next Huntley Hearing on 3/18. Huntley hearing where the judge will look into if Reyes was mirandized & interrogated correctly. There also may be a Mapp hearing, which determines if evidence can be suppressed due to search and seizure. Correia has asked Nesbitt to rule on whether there was probable cause for police to get search warrants for a building or buildings on the farm. Reyes has asked Judge Nesbitt to take Correia off the case & assign him a new attorney. In court Thursday, Reyes asked for an attorney from the Monroe County Public Defender’s Office. On Thursday (3/7/19) in Wayne County Court, Judge John Nesbitt denied Alberto Reyes’ request to replace his lawyer, Public Defender Andy Correia. Trial will start 6/24.
3/18/19 Update: Judge heard arguments re interrogation went correctly. Will decide later, hearing continued to 4/2.

6/20/19; Next Oral arguments hearing on 7/29.

Sodus farm worker pleads guilty in slaying of mom and her toddler son


The man accused in the slayings of his girlfriend and her 14-month-old son on a Sodus farm last year has pleaded guilty, the Wayne County Sheriff's Office announced Wednesday.

The terms of the guilty plea are still unknown, but they will be revealed at 11 a.m. Thursday(9/12) in a press conference where officials are expected to provide further comment.

At a press conference Thursday at the Wayne County Sheriff's Office in Lyons, Calarco said Donoteo-Reyes "had to admit and acknowledge that he caused their deaths." But law enforcement officials didn't release a cause of death.

"It is very difficult to explain what is in the mind of someone who commits these types of crimes," he added. "The ‘why’ is probably only going to be known to Mr. Reyes, and he gave no indication as to the answer to that question."

My paraphrased bullet points:

I feel so sad for the family and the decision they were forced to make. Reading between the lines it sounds as if the prosecution was going to fight the best case they could in court but were not sure if they could prove murder beyond a reasonable doubt. It sounds like the cause of death for both Selena and Owen may be unknown. I understand why the family would consent to a deal but 20 years doesn't feel like justice to me. I get the impression the sheriff feels the same way. He was very emotional and empathetic for the family. MOO.

I take it he won't be sentenced separately for his role in the deaths of Selena and Owen? Why would he not be sentenced 20 years apiece? That is only 10 years apiece.
Also, what is the federal charge he is facing? I assume illegal entry since he was deported 2x? I hope he gets a stiff charge for that.

I couldn't hear very well either. It sounded like 20 years is all is expected to serve for 2 counts of manslaughter. He said something about the tampering with a corpse charges too but I couldn't catch that-- if it was left in or dropped for the deal I'm not sure. It would be closer to justice IMHO if they charged him 20 years for each count to be served consecutively (for 40 years total) but he didn't mention anything like that as far as I could hear. I guess we will wait until Nov 7th to see what the judge says.

Those sentences will run concurrently. Donoteo-Reyes is still awaiting sentencing on two immigration-related federal charges.

He was originally charged with two counts of second-degree murder and two counts of tampering with physical evidence, each felonies.
