    Back to Hoepfl: We're taking about the 13 cartridge casings found at the crime scene. He's explaining how they determine if they were all fired from the same gun: by identifying the caliber, firing pin impressions and ejector marks.

    That said, he said was able to identify five bullets from the scene that were all fired from the same firearm.

    Colleen Murphy, for example, just said she's testified more than 30 times. You can tell. She answers questions quickly, succinctly and does not stray from what the question asked when providing her answer. She also looks directly at the jury while she speaks.

    Back to the trial: Callanan has given Murphy a bag with evidence sealed inside. Murphy is putting on gloves and has been asked to open the bag and identify the contents without touching them.
    It's the balaclava.

    She's explaining how she collected "trace evidence" from the balaclava. Then she used a crimescope (similar to a blacklight) to see stains like saliva. She identified two stains, one on the nose area and one on the mouth area.
    She photographed them, then cut and removed them.

    Several people testified that the shooter fled west, behind the outbuildings at 29 Carlton St.
    The X on Elmwood Ave. is about where the balaclava was found, to my understanding.

    Timothy Dean's DNA found on ski mask near Sodus double-homicide crime scene

    "One in 14.3 octillion — that's the probability that DNA recovered from a ski mask found in Sodus doesn't belong to Timothy Dean.

    Robert Visca, a forensic biologist at the Monroe County Crime Laboratory, testified that DNA "stains" found on the ski mask were a positive match to a DNA sample Dean provided in January....

    The trial is scheduled to resume at 1:30 p.m. Thursday. The jury will hear from a witness who was unable to make an appearance on Wednesday, Callanan said, and could possibly hear closing arguments by the end of the day. "

Several Carlton Street neighbors took the stand. Niles’ family lawyer. A rental car risk manager. Wayne County Deputy with canine unit. Wayne County Deputy helped gather evidence.     "NBC's Dateline is back in in town.

    A production crew for the real-life crime television show has been filming at the Wayne County Courthouse since Monday for a potential episode about the Sodus double-homicide trial.

    Though the crew filming in Lyons has said it's too early to say when an episode featuring accused killer Timothy Dean and his wife Charlene Childers might air, it's not the first time the show has featured an out-of-the-ordinary homicide in the Rochester region.

    Niles was wearing a gray t-shirt, blue jeans and gray underwear when she performed the autopsy on Oct. 23, 2018. She recovered four bullet fragments from his body during the external examination.

    Granger just listed 10 total gunshot wounds. She just testified that there were no other medical conditions that could have caused Niles' death.

    When she received Washburn's body, there was a significant amount of dried blood on her face. They had to clean it off to see a gunshot entrance wound on her ear.

    The projectile entered through the ear, went through her skull, through the temporal and occipital lobes of her brain before hitting the cerebellum and exited through her skull.
    That was the only sign of trauma, and Granger says that wound killed Washburn.

    It's possible Dean could've dropped the mask before she saw him, but Damelio says Iacona could have been mistaken about seeing him at all.

    ADA Christine Callanan says Niles had abrasions on his body because he was as crawling to get away from Timothy Dean while he was being shot. The ME testified earlier Niles did have abrasions, along with gunshot wounds, on his body.

    "Closing arguments were presented Thursday afternoon in the trial of Timothy Dean, the man accused of fatally shooting Joshua Niles and fiancée Amber Washburn in Sodus last fall.

    Dean's defense attorney Joe Damelio and Wayne County Assistant District Attorney Christine Callanan both agreed Thursday that Dean’s estranged wife, Charlene Childers, is far from innocent....

    The prosecutor, during her argument, pointed at Dean and told the jury that he shot and killed both Niles and Washburn.

    Dean's charges include one count of first-degree murder, two counts of second-degree murder, two counts of second-degree criminal possession of a weapon, and second-degree conspiracy."

    5/23/19 Day 4: State witness: Dr. Nadia Granger, the ME in Monroe County. Prosecution rests its case. Defense Attorney Joseph Dameilo rest his case. Dameilo is now asking to have all of the charges against Dean be dismissed. Judge Barrett denies the motion. Judge also asks Dean if he wishes to testify. Dean says he does not. Defense does their closing arguments. Prosecutors have done their closing. Jury excused for the day. Tomorrow Judge will give instructions and they will begin deliberations. Trial continues tomorrow 5/24.

    It's day five. The jury is hearing final instructions now, and then they'll be dismissed to discuss/determine a verdict.

    We've seen a lot of evidence and heard from many witnesses this week. Here's some of what the jury must consider:

    Judge Barrett is reading the charges against Dean to jurors and explaining how they must determine if he committed the crimes. There are 6 felony charges: 1st degree murder two counts 2nd degree murder two counts 2nd degree criminal possession of a weapon 2nd degree conspiracy

    Anyway, Judge Barrett is still explaining the charges. He's talking about what the criminal possession of a weapon charge actually means, and how they must determine if the defendant is guilty of that charge.

    He's now explaining that they have to reach a unanimous verdict and listen to each other, but also that they should not change their opinion just to come to a verdict and end the deliberations.

    They are allowed to re-examine evidence and see parts of witness testimonies again, Barrett says. They're not allowed to leave during deliberations, and they'll be provided lunch today.

    He's dismissing the three alternate jurors. Thanks them for their time, effort and attention. The 12 jurors who will be deliberating are escorted out of the courtroom. So now we wait. ⏳

    Jurors are back, but don't get excited. They've asked to see some evidence again. They just watched some of the body cam footage from Deputy Nicolet that shows Dean next to the rental car in Kansas. Now they're hearing Frederick Plummer's testimony again.

    They've taken a few exhibits back with them and left the courtroom. I think one was the overview map of Carlton Street, but not sure. As usual, I'll tweet when we've got anything new going on. See y'all in a bit.

    The jury has reached a verdict: Timothy Dean is guilty of murdering of Joshua Niles and Amber Washburn. They found him guilty of all six counts: 1st degree murder, two counts 2nd degree murder, two counts criminal possession of a weapon and 2nd degree conspiracy.
