Jurors hear opening statements in murder case against former Tulsa dentist

"Jurors in a murder trial were told Tuesday that a former Tulsa dentist caused "catastrophic" head injuries to his mistress' 19-month-old son because of jealousy.

Bert Glen Franklin was “very jealous, very controlling, very obsessed” with his mistress, Roxanne Lewis Randall, Oklahoma County prosecutors said during opening statements....

Franklin's hatred and jealousy of the boy's father may have motivated the deadly assault, prosecutors said. Franklin also would get jealous when Randall put Lincoln before him, according to testimony....

During his opening statement, Assistant District Attorney Ryan Stephenson said Franklin is a “self-professed master manipulator.”....

Video evidence

During the trial, jurors will be shown a video that prosecutors allege depicts Franklin kicking Lincoln before slamming the toddler head first to the floor on the evening of July 16, 2016. However, what Franklin is kicking, throwing or interacting with cannot be seen due to a dividing wall inside the house...."

"....Jurors heard testimony from five witnesses on Tuesday. The state’s witness list is long, possibly 50....

Jurors also heard from the toddler’s nanny, a mutual friend of Franklin and his mistress, the baby’s father and two family members.

Prosecutors expect the trial to last two weeks."

"OKLAHOMA CITY - An emotional Roxanne Randall testified for most of the day in the murder trial of Tulsa dentist, Bert Franklin....

Franklin is married with four children but was having an affair with Randall who lives in Oklahoma City....

Randall testified that she was upstairs and Franklin was downstairs with Lewis when she heard a noise.

“It was loud, a loud noise, a loud thud,” Randall testified in court.

She says Franklin told her he had thrown a ball to the dog and it wasn’t until the middle of the night that Randall noticed something was wrong.

She said she woke up and thought Lincoln was coughing.

He was having trouble breathing and was unresponsive....

She and Franklin rushed Lewis to the ER at Mercy Hospital where doctors told her he had a severe skull fracture and that it had to be the result of something intentional.

The ER doctor testified today that it was the worst skull fracture he’s ever seen....

The defense said in opening arguments on Monday that they will call to the stand a pediatric neurologist who will testify that it’s impossible to say for certain that Lewis’ injury was the result of abuse....

Randall is expected to take the stand again on Thursday."

Franklin’s defense is that the toddler fell down stairs days prior to the emergency room visit in July 2016....

The doctor also told prosecutors and defense attorneys the child’s injuries were fresh, meaning they had to have happened only hours before the child came to the hospital."

"OKLAHOMA CITY - Oklahoma County prosecutors said in court Thursday that home surveillance video is missing from the day 19-month-old Lincoln Lewis was severely abused.

It is alleged former Tulsa dentist Bert Franklin caused the child’s deadly injuries and deleted the video clips.

Franklin’s mistress, Roxanne Randall, has testified that she noticed several home video clips were missing in the days after her son’s death.

Defense attorneys showed jurors a re-enactment video created by Oklahoma City police detectives and Randall, the victim’s mother. The video was made due to some of the home surveillance video being missing. Randall believes Franklin, her boyfriend at the time, deleted the clips.....

Jurors will hear from the lead detective on the case on Friday."

Franklin gave Lewis Randall the cash to buy a home in Oklahoma City – then installed surveillance cameras so he could keep tabs on her, jurors were told on Wednesday.

He is said to have flown into a murderous rage after footage showed his mistress having a one night stand her baby’s father.

Henry told the court: ‘He said he was going to ‘Game of Thrones’ me.

‘He said he was going to cut my penis off.’..."

Physician testifies in murder trial against Tulsa dentist

"OKLAHOMA CITY –...The defense called a physician, board certified in pediatrics and neurology, to testify in court Tuesday. He was hired by the defense to review Lincoln’s medical records.

The physician told the court the baby suffered a subdural hematoma with a blow to the left back side of his head.

“One-year-old’s don’t get subdural hematomas for no reason,” he said.

However, the physician testified there was no way to tell exactly what or when it happened based on cat scans alone. In his experience as a medical professional, he testified he had seen head injuries in other cases that were accidental.

It’s possible Lewis “took a tumble and nobody noticed” within the last day or so leading up to his death, the physician said.

During cross examination, defense attorney Scott Adams objected several times suggesting the state was not allowing the witness to fully answer questions before “interrupting and moving on to another topic.”

In one incident, a prosecutor questioned how many times the physician saw or treated patients with injuries similar to Lewis’ but did not die. He answered he had seen it but was unable to provide a specific amount or names.

The state also noted the physician was not a radiologist nor did he consult with other doctors about Lewis’s injuries to compare conclusions....."

"...The state called an investigator to the stand Tuesday for the solicitation charge. He told the court Franklin's cell-mate told him [investigator] Franklin wanted a woman killed and later learned the woman was Randall.

The investigator said the first thing he had to do with determine whether the tip was credible. Eventually, the investigator had a smuggled cell phone be given to Franklin.

Phone calls made on a phone smuggled into jail to Franklin were played in court. In one, Franklin is heard giving directions to Randall's home in Oklahoma City a man now identified as a confidential informant. In another conversation, money was arranged to be transferred.

The phone's search history was also presented in court....

The trial will continue Wednesday.

Judge Cindy Truong said the jury may go into deliberation on Thursday."

"OKLAHOMA CITY - The fate of Tulsa dentist, Bert Franklin, could be decided as soon as tomorrow.

Both the state and defense rested in the case Wednesday afternoon....

The defense’s only witness was an out of state pediatric neurologist who had previously testified that Lincoln’s injury wasn’t necessarily the result of abuse and that the injury could’ve happened before Bert Franklin was around him.

“I think that’s all that we needed in this case. We just needed to show that there was a time that these injuries could’ve occurred other than they say when Bert did it which we clearly did that and now it’s time for the jury to make their decision,” said Franklin’s attorney, Scott Adams.

In the end, Franklin did not take the stand in his own trial...."

Why would he arrange a hit on his girlfriend if he didn't kill her son. Glad the jury saw right through his lie's. He deserves to rot in prison the rest of his sorry life.
