New Florence man accused of killing police officer won't face trial until 2017

A Westmoreland County judge has granted Ray Shetler's defense extra time to prepare motions for the case, delaying a pretrial conference that was scheduled for Monday and setting the current trial date for the January term of court.

The delay isn't uncommon, particularly given that Shetler faces a list of felonies, including homicide in the case – and the possibility of the death penalty if convicted. But part of the reason behind his law counsel's recent requests for added time is less so.

A fire in a building (the old Macy's building if you're from Pittsburgh) forced the closure of Shetler's attorney's office which was next door.

"Our computers, files and records ... all of that was in there," Daffner said, noting it was off-limits until a few weeks before the Allegheny Building reopened. And even at that point, staff was only allowed to enter the office for one hour a week for "essential files."
 
The lawyer for a New Florence man who could be sentenced to death for fatally shooting a St. Clair police officer last year filed court documents Tuesday asking a judge to dismiss a first-degree murder charge against his client.

Defense attorney Marc Daffner said the deadly incident was not intentional and there is not enough evidence against Ray Shetler Jr., 32, to substantiate a charge of first-degree murder. Shetler is charged with fatally shooting Officer Lloyd Reed, who was investigating a Nov. 28 domestic incident at Shetler's home.

The trial was originally scheduled for October of last year, was rescheduled for January 3rd and then January 9th this year, then for June 5th. Now, jury selection is scheduled for August 7th, with no indication on his criminal docket sheet as to why the trial has been delayed yet again.

A Westmoreland County judge ruled Tuesday that enough evidence exists to allow murder charges to stand against a New Florence man who could face a death sentence if convicted of fatally shooting St. Clair Township police Officer Lloyd Reed.

Common Pleas Court Judge Meagan Bilik-DeFazio, in a 14-page opinion, said a statement Ray Allen Shetler Jr. made in the days after the fatal shooting provided the prosecution with enough evidence to allow its case to move forward.

After a series of rulings by Judge Meagan Bilik-DeFazio last month, it’s no surprise that the murder trial of Ray Shetler Jr. has been rescheduled yet again, for a sixth time. The 32-year-old New Florence man had been scheduled for trial October 2nd for the shooting death of Saint Clair Township police officer Lloyd Reed Jr. in November of 2015. The new trial date is January 8th of next year.

Judge Bilik-DeFazio issued the latest continuance of the trial because of a new pretrial hearing she had scheduled. Shetler’s online docket does not list that hearing date. The trial was originally scheduled for October of last year. The most recent trial date was January 8th. Jury selection is now scheduled to begin on February 5th.

A Westmoreland County jury will travel to a St. Clair Township home next week to view the scene where police officer Lloyd Reed was gunned down responding to a call for help during a domestic dispute in late 2015.

Westmoreland County Common Pleas Court Judge Meagan Bilik-DeFazio on Monday approved a prosecution request for a site visit during the opening stages of the capital murder trial of Ray Shetler Jr., which is expected to begin next week.

Jury selection in the case is scheduled to start Feb. 5.
 
His attorney has said Shetler does not dispute that he fired his gun toward Reed, but maintains his client had no idea the man pointing a weapon at him was a police officer and only discharged his rifle after Reed fired first.

If convicted of his most serious charge – first-degree murder – Shetler would face a separate hearing for the death penalty.

The prosecution contends Reed, 54, was in uniform when he was shot in the chest by Shetler during an exchange of gunfire after police responded to a call for help from a woman.

That woman contended her boyfriend, Shetler, was drunk and abusive and had a weapon.

Shetler has maintained that he did not know that Reed was a police officer when fired his gun. After the shooting, Shetler fled and swam across the Conemaugh River before he discarded the murder weapon, prosecutors allege.

Thursday's opening day of trial for a New Florence man charged with gunning down St. Clair Township police Officer Lloyd Reed Jr. on Nov. 28, 2015, included playbacks of 911 and police radio calls recounting a tense standoff between the pair, commands for Ray Allen Shetler to drop his weapon and the fallen officer’s final words.

It also included contrasting opening statements by attorneys about the moment Reed was fatally shot, with Westmoreland County District Attorney John Peck saying Shetler went outside with a rifle and took the officer’s life, firing three “deliberate” rounds with a bolt action rifle.

“The defendant killed Officer Reed intentionally, knowingly and deliberately,” Peck said, saying evidence will show Shetler, 33, is guilty of first-degree murder in the case.

Defense attorney Marc Daffner countered that Shetler didn’t fire until he was shot in the shoulder and forced to defend himself that night in a “tense situation” before he could drop his gun.

Trooper Michael Dzvonik testified Friday afternoon in the capital murder trial of Ray A. Shetler Jr., 33, that Kristen Luther, through tears and fits of hysteria, insisted that Reed repeatedly demanded that her boyfriend drop his rife, then fired the first shots outside her Ligonier Street home.

“The officer told him to drop it, then the officer started shooting. He (Shetler) shot back,” Dzvonik told jurors on the second day of the trial in Westmoreland County court.
 
The jury resumed deliberations at 9 a.m. Friday. In the afternoon, jurors returned to courtroom to ask the judge how they should proceed, noting they have been unable to reach unanimous verdict in regard to charges of first-degree or third-degree murder.

The jury also asked for another explanation about justification regarding the shootout on Nov. 28, 2015 in New Florence.

Bilik-DeFazio read jurors the legal definition of reasonable doubt and gave another explanation for the elements needed to find that Shetler was justified when he shot and killed Reed, who was responding in uniform to a 911 domestic violence call.

The defense argued that Shetler acted in self-defense when he shot Reed, who was the first to fire.

Reed, according to testimony, fired six shots toward Shetler. Shetler fired three shots at Reed from a high-powered hunting rifle.

The judge told jurors to continue deliberations.

After six days of testimony and more than 20 hours of jury deliberations, Ray Shetler Jr. was found not guilty of murder Friday in the fatal shooting of St. Clair Township Police Officer Lloyd Reed.

The jury found Shetler Jr. not guilty of first- or third-degree murder. He faced a possible death sentence had he been convicted of the most serious charge.

The jury found Shetler guilty of two lesser charges in connection with stealing a truck as he attempted to flee the scene of the shooting in New Florence and swam across the Conemaugh River.

The judge said Shetler could be sentenced up to seven years in prison.
