"However, State Supreme Court Justice Sanford Berland denied Ray's request, siding with Suffolk County police who want to keep the tapes confidential due to the fact that it is still an "open, active investigation."
Since the SCPD has an "open, active investigation." I wonder if it would be possible for the SCPD to have regular public press briefings. I think the public desreves to hear from the lead investigator on this case, especially in terms of resources allocated, potential POIs, the number of ongoing witness interviews, DNA results, and so on.
I know the SCPD would never give false testimony to a State Supreme Court Justice, so an 'open and active case' would likely have several investigators working full time on this case with other major resources allocated.
On the other hand, if only one detective has been assigned the file, and it lays on his desk under 50-100 other case files that the officer is focused on, most civilians would have a hard time accepting that it is an "open, active investigation."
If the SCPD, believes this case is unsolvable without significant new evidence or witness information, and they are waiting, then they should say so. The public can handle the truth.
