While they are VERY different people and these are very different trials, there was something about her delivery that reminded me of Amber <mod edit> Heard. Acting and from a script (internal or rehearsed) with too much information which can be indicative of lying. IOW, BS.

In the end, Chad Daybell is not LDS, as evidenced by the LDS church severing his relationship with the LDS church, from the excommunication papers he received. This is evidence that his cult beliefs have nothing to do with the LDS Church.

Chad Daybell will be judged by a jury of his peers, did his actions, behaviors, demonstrate conspiracy in the deaths of Tylee and JJ, and did he kill his wife Tammy, with premeditation? I believe that the State of Idaho has met the threshold for a finding of guilty on all counts charged.

And, INMO, he merits the death penalty.

I do think Garth flubbed his lines as Prior had in mind a few times. I do not think he was supposed to say the raccoons were all buried in the compost area. I think he was supposed to say he saw them daytimes. I can't recall all, but I felt that there were several relatively minor points Garth flubbed. (Or rescued, if he was more honest than anticipated.)

But I think Prior was pleased to show that casting out evil spirits as in that story did not kill people like Emma or Newel Knight. His point was just calling people dark was not a kiss of death. It's a weak argument, though. Just because Emma and Newel continued on, it doesn't change that the murders for which Chad is charged did occur. And the belief system, that they were zombies or whatever, and castings were needed, isn't the illegal part. It was the actions taken to supplement the castings that caused death that were illegal.

Chad's kids didn't have to die because they're adults and they have didn't life insurance or SS that Chad & Lori could benefit from. Same for Colby.

The evidence has to be in before the trial begins, as does the proposed witness list and information about expert witnesses, including their credentials and reports. So they have to work with what is on hand, then get permission to publish it in discussion during the trial.

The prosecution did not anticipate that the stairs and accessibility of the loft room of the cozy cone would be such a big deal. Now, to counter that narrative (which started when JP decided to as a witness if it would surprise her to learn the house is one story- thus calling into question her observation that Chad told different versions of Tammy's natural death stories during the wake.

There are stairs in the house, but it is unclear still the importance of that. The first thing is it's important is because stairs are present in both versions of the death story, at least as JP repeated it. (The stories as repeated by the witness implied stairs with prepositions, but didn't fully mention them. JP jumped on that and said, Not true! The house is one story!) If the stairs part is wrong, maybe the witness is making up her story.

Thus it seems like the prosecution making it clear there are stairs is important, and they did that with witnesses.

Now JP is continuing to de-emphasize the accessibility the loft room and how inconvenient the stairs are. It feels a bit like he's getting at another point we don't fully understand.

A lot of sleuthers are surmising the stairs are integral to the murder of Tammy, as Prior is so sensitive about them. This theory assumes Prior knows the minute details of how the murder went down. IANAL, but I wonder why he'd want or need these details, unless there are some mitigating details in the narrative and a plea deal was discussed that would involve a full narrative.

I think it's pretty clear Prior assumes that Tammy was murdered, having gaffed by criticizing opinions of those not present at the murder.Does he know stairs play a part? IDK.

But back to showing pictures- a brand new picture that is not already an exhibit would be very hard to get in. The prosecution, defense and the court all have to agree it is relevant, doesn't create prejudice, and timely. Even if a photo exists already as an exhibit, there must be permission to publish it.

If any lawyer knows the blow by blow details of the murder, it's Prior, but I don't think it's typical he would know.

So it is rather weird how much he cares about the stairs. My theory is that he cares just to credibly make a big to-do in closing arguments about how unreliable the witnesses who said Chad changed his death stories. Piling on that poor Garth was bullied by LE and had to fight to hold on to his strained narrative, and one reason for concluding Tammy was murdered, the conflicting stories, could be called into doubt.

But I think it's weak because I don't think the jury will care much about the Garth testimony (It's hard to follow the narrative, and easy to intuit that whatever it is supposed to convey, it's from a person with reason to lie.) and the witness who saw the changing stories had never been in the house. I think the jury will be unmoved by whatever they have concluded about the stairs: she didn't say stairs, she said stairs because she imagines the rooms in her own house, or prior is a liar and is scared of the witness. In all situations, the death story was evolving.

Closing arguments should be interesting.

Priors closing argument themes regarding the Tammy murder counts: Tammy was sick, out of shape, McMeal eating fit-bit cheater who was found to have died by natural causes by the coroner on the scene. Local LE was out to get Chad and dug up Tammy out of the ground against her family's wishes just because Lori and Alex were suspected of murdering Lori's husband three months before, and hiding Lori's children. Chad was in an affair- but he couldn't be expected to help himself because Lori was hot, hot, hot! In a new yellow bathing suit. He was tricked into marriage. Any goofy fundamental religious beliefs were from old church teachings and Tammy believed them more. LE was determined to turn this natural death into a murder just to harass Chad. It is an unrelated coincidence that some kid with a paintball gun was playing in Chad's driveway a week and a few days before Tammy passed away, but LE is trying to connect those things, too, including by lying in their reports about what Joe Murray said. And, BTW, if it was a real attack with a real gun, the intended target was Chad; Tammy was in Chad's vehicle.

I appreciate your post. I don’t think I could give anyone the death penalty but his evil ways call out for it. I really feel for the jury. I believe they have long ago decided he’s guilty of horrific murders of kind and living people who were just in his way. He sure didn’t mind giving others a death sentence for no wrong doing at all. People like Chad and Lori cannot be in society. They are evil to the core. I hope they realize one day what they have done. If they do, they will punish themselves more than what the jury can do. I pray for the jurors.
 
Haven't kept up with this thread lately, but I am hoping we will get to closing arguments today. However, that may be a bit optimistic.

Emma, Garth, and Joseph sure put an entirely different spin on my thoughts re: the Daybell adult children. Such a deeply enmeshed bizarro family hive mind. That being said, several puzzle pieces that were previously turned wrong-side up have most definitely fallen in place.

But, it is definitely concerning to me that these specific people don't seem concerned about murdered children or a murdered family member. To me that raises them up to a much higher level of concern.

I am also concerned with grifts against fringe families. People are being tricked into trading out their retirement savings for more guns than they have fingers, and tents with cooking facilities. (It is very poor planning to cash out savings for these things. Building up savings while accumulating a supply of essentials like food and water might help through natural and financial emergencies. Cashing out funds intended for a realistic emergencies, like job loss, for unrealistic ones, like a mean god destroying the earth, just shouldn't be encouraged.)

There shouldn't be false claims for products nor false predictions of the future just to sell products.

I am also concerned with harm done by using fringe beliefs to justify breaking civil rights laws such as those against sexism.

There are levels of harm that occur more broadly and more routinely than murder.

Doubtful about closing arguments today, more like next week IMHO. There are still at least 2, perhaps 3, expert witnesses remaining to testify for the defense. Then there is the matter of rebuttal if the state chooses to do so. Judge was also talking about hearings needed for jury instructions which are more complicated due to it being a capital case.

Yes! A potential missed opportunity IMO. I am trying to remember, wasn’t the grave site / pit also scene of something having been burned? (Or maybe I am mixing up another case……) And if it is was the case, maybe someone was worried which direction the offensive odor might be heading? MOO
 
I don't think this matters at this point but with the focus on the description of the house layout, it occured to me that AC could have entered and exited the house via the Cozey Cone. Just thinking through the legistics.

  • She's trying to fit in with the culty women who are mostly blonde
  • She doesn't want to be as easily recognized in public
  • Prior advised her to change her appearance so she doesn't look like the Tammy Jr. she physically is at court
  • She's always wanted to try light blonde and her doing it now is just a coincidence
Consider that Tammy is naturally a dark or "dirty" blonde, as is Emma. Leah, who we haven't heard much about, is a lighter blonde in the 48 Hours interview but I can't tell if it's natural or enhanced. Consider that while Gibb has always been blonde, Zulema has now gone blonde. The Emma in Chad's book series is light blonde. MOO.

While I was watching her say that, this is what was going through my mind. She made herself sound completely involved.

IMO First thing I noticed about Emma’s testimony…

Emma and her husband are in a position to be extorted for testimony by Prior. Prior is her landlord. As Emma testified, the owner of her house would determine what’s to happen going forward about whether they stay there, etc. This makes the couple vulnerable to retaliation if they don’t say the “right” things about Chad on the stand.

There wouldn’t have to be a stated quid pro quo, just the perception of one on the couple’s part. And, from an outsider’s perspective, it makes everything they say potentially a distortion. It doesn’t even have to be a lie: just a twist or omission in support of Dad.

There’s a HUGE dollar value riding on this testimony, entirely separate from the thousands Chad shoved in their accounts.

In fact, now that I think about it, another curiosity…If Chad dumped the money into their accounts, because of the timing of his detention, he had to have done it before they found the bodies (or before he knew they found the bodies). This would prove acknowledgement of guilt:it’s admission he knew LE would find something, and he would be responsible.

I don’t know anything about Emma. But when I heard her wind direction testimony, I could ONLY jump to the conclusion she was complicit, and I jumped to it instantly. So was she or wasn't she? I can’t get it out of my head. IMO this changed the implications of ALL her testimony.
