Virus orders postpone Hellman trial in Montgomery County

June 22, 2020

CHRISTIANSBURG — The trial of McKenzie Kyle Hellman, a Christiansburg man accused of murdering his girlfriend’s 2-year-old son, will be pushed back to October [5 & 6] due to the coronavirus emergency orders that Virginia courts are working under.

That was the upshot of a short hearing Monday in Montgomery County Circuit Court, where Hellman, 26, was scheduled to begin a two-day jury trial.

That Hellman’s trial would be postponed was no surprise. A series of emergency orders issued by the Supreme Court of Virginia, beginning in March and aimed at reducing the number of people in courthouses and limiting the spread of COVID-19, barred jury trials until at least June 28, when the present orders expire.

The mother of the slain boy, Kayla Nicole Thomas, also 26, also faces charges alleging child abuse, sexual abuse, and making and reproducing child *advertiser censored*. She has a plea hearing scheduled for Aug. 26.

10/16/19 Update: Plea hearing has been delayed again because of Hellman’s competency hearing. Trial delayed to March 18, 2020. Plea hearing has been delayed (again) to 3/18/20 instead of trial.
3/18/20 Update: A plea hearing for Thomas remained on the docket for Wednesday, but Commonwealth’s Attorney Mary Pettitt wrote in an email that she expected attorneys would use the hearing only to reschedule the matter for a later date. Plea hearing was rescheduled for 8/20/20.

Trial dates set for Christiansburg woman charged with making child *advertiser censored* and sexually assaulting 2-year-old son

Kayla Nicole Thomas' trial has been set for January 20, 2021 - January 22, 2021.

Thomas appeared in Montgomery Circuit Court Thursday. She faces the following felony charges:

§ Abuse and neglect of children; penalty; abandoned infant
§ Possession, reproduction, distribution, solicitation, and facilitation of child *advertiser censored*; penalty
§ Production, publication, sale, financing, etc., of child *advertiser censored*; presumption as to age
§ Forcible sodomy
§ Object sexual penetration; penalty

Thomas is not charged with the murder of Meek.

Thomas’s boyfriend, McKenzie Hellman is charged with murder as well as the following charges:

Jury trial delayed again for Christiansburg man

CHRISTIANSBURG — A jury trial for McKenzie Hellman was again delayed last week due to the coronavirus pandemic, with charges of murder, child *advertiser censored* and more now set to be heard in March.

Hellman, 26, of Christiansburg, was scheduled for a two-day jury trial beginning Monday — itself a rescheduling from June. But with the Virginia Supreme Court’s latest emergency order still barring most court systems from holding jury trials, Montgomery County Circuit Court Judge Robert Turk used Monday’s hearing to move Hellman’s case to next year, with trial dates set for March 15 and 16.
 
Thursday, Dec. 10th:

When Hellman’s case begins Monday in Montgomery County Circuit Court, it will be the first jury trial in the New River Valley since the coronavirus pandemic began last year. Jury trials were halted by orders of the Virginia Supreme Court, which decided that the crowding of jurors and others posed too much of a chance of spreading COVID-19. Each court system in the commonwealth had to come up with a plan to impose greater distancing and other protective measures during jury selection and trials.

Monday’s trial is to revolve not around the boy’s death but around charges of animate object sexual penetration, being an accessory to forcible sodomy, producing child *advertiser censored*, reproducing child *advertiser censored*, and possessing child *advertiser censored*, all filed against Hellman after officers found what an investigator testified was a sexually explicit picture of Steven on Hellman’s phone.

According to testimony at a preliminary hearing in the case, Hellman told police that he asked Thomas to sexually abuse her son because Hellman wanted to see if he would be aroused by what happened to the boy. Hellman said he told Thomas to make videos of herself performing various acts upon the 2-year-old, an officer testified.

Thomas is charged with child abuse, forcible sodomy, inanimate object sexual penetration, producing child *advertiser censored*, and reproducing child *advertiser censored*. She is scheduled for a three-day jury trial starting June 9.

Both Hellman and Thomas are being held in the Western Virginia Regional Jail.

Wonder "why" not the murder charge per article?

Hellman is also facing charges of second-degree murder in the boy’s death, and child abuse, but those counts have been separated from the sex charges and will be considered at a separate proceeding later.

Good, glad he's facing murder charges as well. While I'd rather he be under the prison, if convicted on all counts, he should be looking at life in prison. He and his girlfriend are complete waste of space.
