Mr. Davis of the contract company (delivery subcontractor) attempted to track down the driver in question (tanner Horner) upon reaching Horner said he didn't specifically recall that delivery.

McGuire then went to interview Horner in person where he was located. They had his delivery sheet for that day to ascertain where he might be on his scheduled delivery route. They intercepted him while making a delivery.

Horner was startled when they encountered him, so much so that he dropped the package he was carrying when exiting the truck. He delivered the package to the property he was on and then McGuire had him step to back of the fedex truck to interview him. He said he now remembered that delivery having just that day (after speaking to McGuire by phone) driven past the Strand property seen the police presence and the delivery they were asking about. He said the Strand house appeared rundown. He claims he saw what may have been the homeowner leaving as he arrived.

honestly I think we can forgo all of this current stuff since he has already plead guilty, play the one hour audio for the jury and call it a day. nuff said.

McGuire relayed info to the command post via Joe Espinosa (Texas Ranger)

They requested more info from fedex about Horner's deliveries on the day Athena went missing in an attempt to build a timeline of Horner's activities that day. Eventually a warrant was obtained for all the fedex evidence but at that time fedex was cooperating and providing in formation in the moment as requested. after getting an idea of what Horner's delivery day looked like they attempted to reach Horner again to set up a second interview. That call "dropped" and so they couldn't complete it.

Horner then called them back after the dropped call. Those interviews will be entered into evidence by the state

Horner explained possible delays along his delivery route the day of Athena's disappearance as him feeling unwell, pulled over on side of road, threw up, then traveled to a Love's truck stop, vomited some more, then returned to his fedex location. Athena's package was the last he delivered that day. That package was never marked in Fedex system as having been delivered, and the four or five additional deliveries that were to have been made that day after the Strand delivery were not made that day.

McGuire was advised about the vans and them having dashcams and on December 2nd they obtained video which consisted of video from inside the van of Horner placing a small girl into his van. This video came to him as a cell phone recording of a playback of the van's video. He and another were actually in the middle of surveilling Horner while he was on his route at the time they received this cell phone footage depicting what the van footage consisted of.

Defense will not be cross examining FBI Special Agent McGuire. He is released from the stand. Judge dismisses jurors because he needs to talk to the lawyers outside their presence.

A former FedEx driver pleaded guilty Tuesday to killing a 7-year-old girl after delivering a Christmas gift to her Texas home, where he told authorities he accidentally stuck her with his van and then strangled her in a fit of panic.

Jurors will now decide if he deserves the death penalty.

I have just caught up, to see he has pled guilty, I am opposed to DP so I hope jury doesn't decide this as his punishment

Sorry Joe, this is Texas. And this defendant deserves the highest level of punishment society has to mete.

Although, since he did plead guilty, prior to trial, was this a deal to avoid the Death Penalty?

Was there any release of information on sexual abuse on Athena?

just heartbreaking to watch all of this being shown to the jury. I can't imagine sitting on a case like this. A rape and murder of a child. I can't imagine a worse crime to have to adjudicate. These poor jurors, what they will see an be unable to wash from their minds afterwards.
I’m still watching today’s hearing, but I thought I specifically heard she hadn’t been sexually assaulted?
