A Pismo Beach gas station surveillance tape captured what appears to be the horrific beating of 15-year-old Dystiny Myers while two Pismo Beach police officers stand nearby, talking and drinking coffee. [KCCN.tv]

On Sept. 26 at 3 a.m. at the Five Cities Chevron just off Highway 101, a surveillance tape shows a man restraining and beating a struggling woman. Though officers thought the two men, who were wearing gloves and trying on sunglasses, “were acting kind of hinkey” they failed to notice the physical assault occurring in the bed of the truck driven by the suspects.
Pismo Beach Police Chief Jeff Norton declined to identify the officers involved but confirmed the incident to KCCN.tv. Norton said he had not yet had a chance to view the camera’s tapes, but said he was told by department personnel that the tapes showed a man in the back of the truck, apparently holding down a struggling woman.

According to sources, the suspects turned on the girl allegedly because she disrespected Wisto, the mother of York and the girlfriend of Hill. The suspects then drove the teen to a rural site in Santa Margarita where they dug a shallow grave.
They then allegedly strangled the teen, placed her in the grave they had lined with lye, covered her with branches, coated her body in accelerant and lit her on fire.

The comments after that article are flying. Sounds like there is now an accusation of a local cover-up and the call for other surveillance videos in the area.

I'm not buying what I just read. Men struggle with a petite teen in the back of a truck at a gas station in Pismo? Unless the laws have recently changed, it's not legal to even ride in the back of a truck in California. No one responds, no one hears muffled cries or screams, no one sees flailing limbs?

Even at 3 am, gas stations near the beach are not deserted. They are well lit and often a stop off after the bars close. If Dystiny was already restrained in some way, she wouldn't have been struggling enough to be seen on a video. And why would someone with a struggling teen in the bed of their truck stop to buy gas and try on sunglasses with gloves on? What kind of gloves? There are special gloves which surfers sometimes wear but they wouldn't leave them on to look at sunglasses. And what other glove would a guy wear in Pismo in the late summer?

FWIW, the 25th and the 26th had a high of 82 and a low of 60. There was a light breeze off the ocean. That's hardly glove weather. And 3 am is a very strange time to be looking at sunglasses.

I'm sorry but I don't think this was a murder due to disrespect any more than I think Zachary Irvin was raped, shot, dismembered and burned in a "torture chamber" warehouse in East St. Louis due to a "beef" with some homeless guys.

Not buying it.

I'm not accepting any story right now. It's too soon for me to get a handle on this killing, it's so vicious.

I'm troubled by the contradictory accounts of the beating in the truck, etc.

All I'm sure of is the people that did this are REALLY bad news.

Something weird is going on Missizzy. Two completely different versions of the gas station sighting and security tape? Blackburn is a controversial local journalist, there is no doubt about that.

I thought at one time he wrote as "the shredder" for the New Times, but I may be mistaken. His journalistic integrity as far as factual reporting to my knowledge has not been in question. However, his subject matter is usually very controversial, so you can imagine that with some of the local politicos and who's-who, he is not very popular.

I'm just not sure what the deal is, but I'll be watching to see how this unfolds. I thought the gag order being issued so quickly in the case was odd.

I checked back and I don't see this article posted. It concerns the suspects' criminal histories, oddly noting no crimes of violence. That seems remarkable to me as most who are charged with violent crimes have long histories of such. Not all but most:

The comments are flying under the conflicting articles about the truck/gas station story. A poster compares the story to the "telephone game". I would have to agree. Someone else also raises the valid question as to why this info would be released to the public (either before or after LE has seen it, depending on which news source is telling the truth) as it could strongly figure into the trial.

What a mess!! All this and yet a young girl is still dead, under very curious circumstances.
 
Thank you for listing the article referring to the videotape. Too often the police have trouble proving murder. If this is true this should give prosecutors all the evidence they need. I feel for those poor LE officers. I can't imagine how they must be feeling.

The Sheriff’s Department has released little information about the teen’s murder, and her autopsy results have been sealed, along with search warrants for property in Nipomo and rural Arroyo Grande. A gag order has also been issued in the case.

All five suspects remain in County Jail without bail. A preliminary hearing has been scheduled for Nov. 19 in San Luis Obispo County Superior Court.

Does it strike anyone else as odd that Ms. Myers has been jailed on a misdemeanor drug possession charge for over four months and that she's not expected to be released in time for trial next year? What's that all about?

An interesting comment by Blueskies posted on 11/22 at 1:28 pm. I'm assuming that the poster is referring to Garland's Hamburgers in Grover Beach--about 10 miles from Nipomo but 25 from where Dystiny's body was found.

A preliminary hearing scheduled in the criminal case against the five defendants accused of killing 15-year-old Dystiny Myers has been postponed.

The two-day hearing was expected to take place Monday, but it was re-scheduled to Feb. 7. The details of why the hearing was postponed weren’t discussed by attorneys outside of court because of a gag order issued in the case.
