In the initial discussion this morning, prosecutor reminded the judge that the defense must lay a foundation for self-defense claim if battered child defense is to be allowed. That might mean that Nachtman will have to testify at some point.

The judge asked Nachtman how she was doing. "Could be better, could be worse," she said. He swore her in and asked if she understood that her attorneys intend to raise two affirmative defenses, meaning they will admit she committed the killings. "Yes, sir," she said.

More than 100 people are in the potential jury pool. The lawyers plan to ask them first if they can commit to being on the jury for two weeks. Those who can will then be asked if they've been exposed to media coverage.

It's slow going here in the Nicole Nachtman jury selection. The initial pool of 100 jurors has been seated for about an hour. About half of them have said they have some knowledge of the case from news coverage.

The judge read the indictment, and a statement of facts, saying that Nachtman is accused of killing her mother and stepfather at their Carrollwood home and that she was arrested at FSU, where she was a student. Nachtman sat with hunched shoulders, looking down.

Lots of people say it would be difficult to commit to a two-week trial. Lots of medical procedures, pre-planned vacations, weddings, and new babies. Some said missing work would be a financial burden.

A couple folks said they know some of the court personnel. One guy said he used to work for the sheriff's office and knows the courtroom deputies. He also knows Judge Sabella, who used to be an attorney for the sheriff's office.

The court is taking a break for lunch. The judge has asked several people to check with their employers, etc. on whether they could serve on the jury.

The Nachtman trial is done for the day. The initial pool of 100 was whittled down to approx. 50-60 jurors. Some questions included whether jurors owned firearms, if they already had an opinion about the case and if they'd be bothered seeing gruesome images.
