Prosecution may try to block FSU student’s battered child defense in murder trial

"TAMPA — If Nicole Nachtman’s defense wants to tell a jury that battered child syndrome led her to kill her mother, they can only do so if it’s tied to a claim of self-defense.

That’s what a judge decided six months ago.

But in between rounds of jury selection this week, a prosecutor argued that there is no evidence Nachtman was defending herself when she shot and killed her mother and stepfather in 2015.

The state may be signaling that they’ll try to block the defense from arguing that Nachtman was abused when her trial on two counts of first-degree murder starts....

Opening arguments are expected to start as soon as Wednesday."

A third witness, @HCSOSheriff Detective Michael Pecylak has been called by the state. He says he found a bullet casing next to Myriam's head, who is the mother of Nicole Nachtman. The detective says he saw no movement when he came across the body.

He wondered if it was kids playing with fireworks. Then he heard a scream.

“It wasn’t a kid’s scream,” Roe said. “It was kind of a scream of agony or disbelief.”

The witness, Petra Henry, is Nachtman's former roommate. She comes in and tells the court the witnesses were not discussing the trial. She said she has not watched a live stream of the trial. Said the witnesses just talked about how long its been and round table in witness room.
