GUILTY GA - Joni Clements, 47, dies in contract killing, Warner Robins, 8 Feb 2011

Never cease to be amazed by the lengths people will go to - I'll wager it had something to do with insurance $$.

WARNER ROBINS, Ga. -- Three men, including the victim's husband, have been charged with felony murder in the shooting death of a 47-year-old Warner Robins woman.

Police say Joni Clements was found shot to death in her home last month.


I thought it was strange the police took evidence from where the husband works. I still wonder about the guy in the "hoodie" the daughter saw the week before? A trial run by the husband?

District Attorney Hartwig said he may add more charges including, one of kidnapping. I can't help but wonder what does this means exactly. Did the shooter try to make Joni leave her house?

"(James) Eddy Clements is adamant that he had nothing to do with these crimes in which he is charged with and has stated he 'would never do anything to harm Joni,' " Bussineau wrote....(snip)...Police described the Syberts as acquaintances of the Clements family. Robert Sybert cleaned the family pool, Williams said.

"What would you charge me to clean the pool and kill my wife?" Williams asked to demonstrate his point. Hartwig said he is seriously considering seeking the death penalty.

Williams said it appears to him that the accused shooter is being leaned on to attempt to get him to implicate James Clements in the killing.

He again states the possible addition of kidnapping charges. He also says he expects the case to go to the grand jury in 60 -90 days.

Georgia statute on kidnapping:
According to O.C.G.A. § 16-5-40 a person is guilty of kidnapping when s/he abducts or steals away another person without lawful authority or warrant and holds such other person against his or her will. There shall be movement for the offense of kidnapping to occur, although slight movement is sufficient. However, that slight movement of another person which occurs while in the commission of any other offense shall not constitute the offense of kidnapping if such movement is merely incidental to the offense.
Movement shall not be considered merely incidental to another offense if it:

  • Conceals or isolates the victim;
  • Makes the commission of the other offense substantially easier;
  • Lessens the risk of detection; or
  • Is for the purpose of avoiding apprehension.

So, I wonder if she was moved within the house for one of the reasons listed, making her being moved not "merely incidental" to the offense of murder or burglary?

The problem I have with this is that she was killed 2/8/11 but no arrests were made until 3/21/11. That's about six weeks to look into things. I'm assuming LE has more reason to arrest him and add'l evidence other than the word of the other two men.

By the way, kudos to LE for solving this. I'm waiting to see how they solved this.

I am also waiting to see what evidence they have against Eddy. This is very unfortunate for their children to first lose their mother in such a horrific way and now have to watch their father go on trial for the murder of their mother. I am hoping that the truth comes out and that justice prevails for all.
 

He was denied bond...

Bond denied for husband in alleged murder for hire case

Judge Edward D. Lukemire denied bond on the grounds that Clements would be a risk to intimidate other witnesses.
The bond hearing in Houston County Superior Court included testimony from family and friends of James “Eddy” and Joni Clements in favor of bond, including their 20-year-old daughter Jorden Anne “Jordi” Clements.

Hartwig questioned a friend of Clements who worked with him on the base about whether he knew Clements had asked others about hiring someone to kill his wife and whether Clements had a drawing of a silencer for a weapon inside his work tool box. Hartwig declined to elaborate after the hearing.

I wish they had reported on the response of the friend that worked with Eddy when questioned did they know if Eddy had asked others about hiring someone to kill Joni.
