State now calls ME....he says he is associate ME for the area. Telling about when he came to the U.S. and education and certifications and licenses.

DLR asks him what an autopsy is. He has done more than 3000 autopsies and has previously testified as an expert. Accepted as expert by judge and defense.

Trayvon's autopsy was done in ME office in Volusia Co., cause of death was gunshot wound, manner is killed by another person. Trayvon was not identified at the time; his body was sealed in plastic bag; gave his height, weight, clothes, and describes wound.

The Trayvon Autopsy

Determined cause of death: Gunshot wound of chest.

Manner: Homicide

Came to office as Unidentified.

First did x-ray to try to locate bullet/s. X-ray showed bullet fragments.

Bullet went straight through anterior right ventricle of the heart. Two bullet fragments recovered in the right plural cavity of the lung.

Medical Examiner saying that he believed Trayvon was still alive after the gunshot, that he was in pain, that he was suffering..

West Objects. Overruled. West Objects again, saying speculation. Bao says it is his opinion. Judge tells Bao he is not to say anything. Sidebar.

Objection is sustained.

Identifying the bullet entrance wound in this case is easy, there is no exit wound.

Bullet went straight from the front to the back.

Bao believes Trayvon was alive for one to ten minutes after he was shot.

Was a contact wound but 'loose' contact with the gun due to the clothing in between. He cannot determine if TM was standing on ground, position at time of shot, but can say the gun was in front of him.

Dr Bao seems not to "get" how he needs to wait for questions from the attorney. He is trying to express how the difference between FACT and OPINION is very important.

Intermediate Range is by definition not by measurement.
Based on exam of clothing and body: I believe there was Lose Contact of gun to clothes which caused the stippling pattern.

WEST CROSS OF BAO

West wants to do a "walk through" of the Autopsy.

Asking about the role of Bao's two assistants.

Bao: One of them, Priscilla, writes down what Bao tells her as he and the other assistant are doing autopsy with their contaminated gloves on.

West now asking about hands not bagged. Asking about notes from person (Ms Malfours) who went to the crime scene .
What time did she get there?: Her notes say 9:44 PM.

West is wondering IF the event occurred at about 7:15, and Ms Malfours arrived at the scene about 2 and a half hours later, (ref 9:44 PM) in her notes she left at about 10:10 PM, the body was at the scene for about 3 hours and unprotected from the elements.

Bao, is saying he cannot testify to all that, because he wasn't there. The only thing he can say is that the hands were not bagged.

Bao says that without notes, he cannot recall any of the events on the day of the autopsy or surrounding the Autopsy itself.

Bao: I do not remember anything, zero, on the day of the autopsy. I rely on the notes and photos of the autopsy.

West: Asking about autopsy protocol.

Bao: starts a minute by minute description of a typical day.

Four people speaking at the time.

West: Did you see the body fully clothed? Or, after the assistants had declothed the body?

Bao: Yes. Because that is how I always do it. Does not recall if he watched Ben remove the clothing on that day or not. He believes he did see it.

West: What happens to the clothing after it is removed from the body.

Bao: We pack them and give them to the police department.

West: Was the clothing removed and packaged in paper bags.

Bao: It should have been.

West: Procedure is to dry clothing and pack it in paper.

Bao: Does not know if that is what happened that day.

Bao: There are no plastic bags other than the one that carried the body.
It is a rule. If anyone did that they would be gone the next day.

West: Are those the shoes?

Bao: Studied for his testimony for hundreds of hours. Took notes. Oh, dear god. He doesn't want the attorneys to see them.
Judge declares that they are entitled to see them. They were notes he took on his own, they were not part of the autopsy report.
Counsel can sit down with the notes and look over them, but they cannot copy them and they must be returned to Dr Bao.

West and O'Mara are looking through the notes.

Bao: "Something funny there?"

Judge: "There is no question, just sit and wait."

Judge asks if Defense is through with the notes? If so, please give them to Bernie.

West asks for lunch, and asks if they can copy the notes so they can read through them more during lunch?

Bao: Interjects that they are his notes and they can not copy them.

Judge okays lunch break.

Judge says clerk can make a copy Bao's personal notes for each side, but they are confidential and may not be shared, and are to be destroyed after his testimony is done.

She agrees and dismisses jury. Judge tells witness she understands his worry about his notes, she will instruct both side provided copies and original back to him and then all copies will be destroyed. She instructs him in not discussing case during break.

Bill S. a witness is allowed to refer to notes but this witness had anticipated questions and made notes for those, and told West he would testify to those anticipated questions. Defense must impeach him because of testimony TM could not move since it contradicts GZ statements.)

Bill S. saying this is unfortunate for prosecution about the 'notes' controversy since Dr. Bao had added very strong testimony about TM not being able to move or speak after being shot, contrary to what GZ said. All witnesses use notes, but the difference is Bao said he prepared answers in advance to what he thought would be questioned.

Bill thinks prosecutor raising his right hand for judge and she is raising her R hand also...she is putting DLR under oath to swear (he thinks) that he did not know about the Dr.'s notes and did not withhold evidence from defense....

We got a picture. Attorneys are at sidebar. George is watching. Defense assistants flitting around.
Attorneys return to their desk. Going through papers. O'Mara licks finger to turn pages.
It appears something has been lost by the Defense but perhaps the State has it, whatever it is. Attorneys approach bench.

Perhaps its Bao's notes? What can and can't be asked?

Judge is having Bernie swear to something at the bench, "To tell the truth" about something, perhaps? Can only see, cannot hear. Judge appears to be questioning Bernie as in testifying. West appears to be objecting? West appears to go on and on. Bernie and West in back and forth. Judge listening. Everyone else seems uncomfortable. O'Mara and West conferring. West speaking to Judge. Bernie going through some papers, referring Judge to something or some page. Bernie talking with Judge. George's eyes flit a little bit. George tries to hide a burp. He just sits stoically. Back to attorneys at bench. And, now back to their own places.

Judge asks clerk for another copy of the notes. Bao is on the stand. No jury present.

West is doing a limited enquiry of Bao. (A Richardson Hearing)
Your opinion has changed on the matter of how long Trayvon might have lived after substaining the gunshot wound. He changed his opinion as of 3 weeks ago, after an autopsy he did in another case.
He had given a deposition to Defense in November of 2012. (He said one to three minutes)

West: Did not contact State to tell them he had changed his opinion.
Prior to yesterday, did you meet or enquire of State Attorney's Office. Yes, with a staff member.
Met yesterday with Bernie in his office. Did he talk about Bernie about anticipated testimony today? Yes. Met about 40 minutes. Doesn't remember if he told Bernie yesterday about his change of opinion regarding how long Trayvon lived after the gunshot that he testified to, today.

West: at depo last November, Bao acknowledged the presence about THC in Trayvon's body and said it would have no effect.
Since then Bao has changed his opinion to that of the THC might have had some effect after reading lots of literature and consulting with Dr Brooks. Has spent time in last 60 days about the effects of marijuana. Yesterday, Bao told Bernie that the marijuana is part of the autopsy report and that we should talk about that. However, he did not tell Bernie he had changed his opinion. (This guy reminds me of Sarah Palin.)

Any other witnesses you wish to call regarding a Richardson Hearing? No, but I have a couple of followup questions.
Clarifying what the guy just said. Same thing over and over.

Richardson issue is was the information made known to the State's Attorney's Office or not?

West tries to change the ground rules of the subject of hearing, Judge says no.

Judge declares there was no violation of the Richardson Hearing. Let's move on.

West wants to ask Bao, something about toxicology, okay but not in front of Jury.
Bao says THC his opinion is the marijuana could have had no effect or some effect. He can not tell how much. Judge declares order in liminy to remain (I have no idea what that means)
