Casey Anthony: Why a plea deal now in check-fraud case?

Or as WESH&#8217;s Bob Kealing succinctly summed up analyst Hornsby&#8217;s comments: &#8220;The fraud case is a trial that Casey just can&#8217;t win, and by accepting a plea she can save herself a lot more bad publicity and the risk of significant jail time.&#8221;

It appears Casey Anthony&#8217;s defense team is planning to bypass prosecutors and take its chances on a check fraud plea deal with the judge. Between an expected plea and trial delays, it seems like her defense lawyers are doing everything they can to avoid a jury.

&#8220;If you can't do any worse with the judge than what the state has offered you in a plea, then you can do better,&#8221; WFTV legal analyst Bill Sheaffer said Wednesday.

Sheaffer suspects the defense and prosecutors couldn't come to terms on the issue of adjudication, whether Casey would be adjudicated or convicted. If she were to be convicted, it might limit her option to take the stand during her murder trial, because prosecutors could ask her whether she's ever been convicted and it would damage her credibility with the jury.

The expected plea is not etched in stone. Anytime between now and Monday afternoon, Casey could change her mind.

If Casey decides to go to trial, it might start Monday, even though the defense has not yet questioned alleged victim Amy Huizenga under oath. The judge has said in court that her check case would be resolved either with a plea or trial on January 25.

A guilty plea could open the door for prosecutors to impeach any of her statements introduced in the murder trial in which Anthony is charged with first-degree murder in the disappearance of her daughter, Caylee Anthony.

"If you get guilty to five felonies and suddenly the jury gets the picture this person can't be trusted," defense attorney Richard Hornsby said.

If Anthony goes through with pleading guilty to bank fraud Monday, Hornsby said prosecutors can use that plea to refute any of her statements introduced in the upcoming murder trial.

"That's very important. Even if she doesn't get on the stand and testify, they already damaged her credibility by showing she's been convicted of a felony," Hornsby said.

"She has little to gain by going to trial she doesn't have a valid defense," he said.

The check fraud hearing is set for Monday afternoon, and another hearing has just been set for Tuesday on the defense motion to get more access to the records of Texas Equusearch.

WFTV-Channel 9 reported tonight that Casey Anthony&#8217;s attorneys evidently plan to take their chances with Judge Stan Strickland in the check-fraud case.

I think that&#8217;s what she&#8217;s saying. Of course, this story leaves a lot of room for speculation until we hear from Anthony on Monday.

Casey Anthony Case Back In Court Monday

While there's no confirmation at all that Anthony plans to change her plea at a hearing on Monday, it wouldn't be the first time a high profile defendant surprised everyone with a plea change.

What's not clear with Anthony is if any deal has been struck between her lawyers and prosecutors.

Legal experts said a felony conviction on check fraud charges wouldn't come up in her murder case unless she took the stand.

That's not all expected to play out on Monday.

Sources said two different motions will be heard by the judge.

The first deals with the Texas EquuSearch group.

The other motion expected deals with Jill Kerley, an ex-wife of meter reader Roy Kronk.

Court administrators said Thursday that the defense team's motion for access to Texas Equusearch records will be argued in Monday's court hearing.

The 23-year-old has a plea offer on the table in her bank fraud case. Judge Stan Strickland will decide whether to accept it at that same hearing.

Jose Baez, Anthony's attorney, would neither confirm nor deny that a plea deal has been struck or even discussed.

New motions in the case against Casey Anthony show the defense is still trying to pin Caylee's murder on former meter reader Roy Kronk, who found her remains on December 11 in a wooded area near the Anthony family home.

The defense wants to depose one of his ex-wives, who claims Kronk bound her with duct tape more than once while they were married. Caylee's body was found with duct tape over her mouth.

Meanwhile, prosecutors in the case are once again requesting that Casey's lawyers disclose the witnesses they plan to call and begin questioning the investigators in the case.

The testimony will come from Jill Kerley, Kronk's ex-wife.

Anthony's defense team will argue that they need Kerley's testimony as soon as possible because she is sick with cancer.

Anthony's attorneys will argue Monday they should be allowed to introduce Kerley's testimony that she believes Kronk should be "considered a suspect" in Caylee's death.

Despite Kronk's denials, defense attorney Richard Hornsby said he believed it is likely Judge Stan Strickland will allow Anthony's defense to introduce this unflattering testimony -- and it could help introduce doubt in jurors' minds.

"Most defense attorney's win their cases by challenging the credibility of the witnesses against their client," Hornsby said.

Also Monday, it will be determined if Anthony will accept a plea deal in her check fraud case.

There is a major hearing coming up in the case against Casey Anthony. On Monday January 25 at 1:30pm, for the first time, the public could actually hear Casey Anthony admit she's guilty of something.

In Monday's hearing, Casey is expected to plead guilty in her check fraud case. Casey's defense team will also make several motions Monday in the murder case.

Casey is planning to take her plea directly to the judge, with the hopes of a more lenient sentence on charges she stole her ex-best friend's checks, forged them and cashed them to buy beer and clothes. Casey will have to stand up in court and admit to it.

&#8220;Own it. Take responsibility for it, without equivocation,&#8221; WFTV legal Analyst Bill Sheaffer said.

A judge granted a continuation for the volunteer search group Texas EquuSearch.

The defense wants any and all information on the hundreds of volunteers who joined in the search for Caylee Anthony.

The judge was expected to hear this motion Monday, but News 13 has just learned it won't happen.

Mark NeJame, who represents Texas EquuSearch, filed a continuation and it was granted Friday afternoon.


NeJame said this will likely come up again in February.

The hearing is at 1:30 p.m. Monday

The lead investigator in the death of Drew Peterson's third wife said he never collected any forensics evidence from the home where her body was found in a dry bathtub, telling a pretrial hearing Friday he never considered the possibility she was murdered.

One of the things that led him to believe Savio's death was accidental was that he found no defensive wounds on her body.

But when someone else at the scene suggested Savio may have received a gash on her head by accidentally hitting the back if the tub, Collins said he never tried to verify that. Collins also didn't attempt to account for why her body was slumped forward when investigators arrived; he said he didn't ask if anyone had touched or moved her body.

Monday could be a big day in the case against Casey Anthony as she heads back to court.

Because that trial was postponed, legal experts said a plea deal could very possibly be in the works, and Casey could plead guilty to at least some of the charges against her.

Also up for debate Monday is a potential ruling in her murder case.

Casey&#8217;s lawyers want to get sworn testimony from the ex-wife of Roy Kronk, the former meter reader who found the remains of Casey&#8217;s 2-year-old daughter, Caylee, in 2008.

A motion concerning Texas EquuSearch has been delayed.

Anthony is set to appear at the Orange County courthouse for hearings on both her murder and fraud cases at 1:30 p.m. Monday.

What Strickland decides at any sentencing will play a role in her murder trial, if Anthony chooses to testify in her defense.

If Anthony does enter a guilty or no-contest plea -- and there is no indication the state and defense have agreed to a plea deal -- Strickland will decide whether or not to adjudicate Anthony guilty.

Even if adjudication is withheld, a prosecutor could try to introduce evidence of her theft in the death-penalty hearing to counter a defense claim that she has no significant history, according to an experienced death penalty attorney.

Of course, jurors in any penalty-phase of the trial may hear about the thefts themselves -- but not the criminal charges or sentence that resulted -- in the guilt-or-innocence phase, if the judge deems her conduct in forging and cashing those checks is relevant enough to be admissible.

Judge Strickland had made it very clear on numerous occasions: the criminal check charges pending against Casey Anthony will be resolved via a trial or a plea, on or by Monday, January 25, 2010. A trial was widely anticipated by most observers. However, based upon reliable information and observation of the conduct of both the State and Defense, all indications now point to a change of plea as opposed to a trial.

Obviously Defendant Anthony hopes to argue for a more favorable sentence than what has been offered by the State, assuming that one was even offered. It is more likely than not that a plea agreement was offered to Casey Anthony by the State, as historically, plea offers are made in the vast majority of cases prosecuted. However, if an offer was made by the State and rejected by Defendant Anthony, the defense lawyer must believe he can argue to the Judge for a better sentence than that offered by the State, or, failing to gain a lighter sentence, any sentence imposed by the Judge would not be any harsher than what had been offered by the State.

The ex-wife of the man who found the remains of 2-year-old Caylee Anthony, may testify at a hearing on Monday.

In Dec. 2008, then-meter reader Roy Kronk discovered the little girl&#8217;s remains in a wooded area near the Anthony family home. Caylee&#8217;s mother, Casey Anthony, is charged with her first-degree murder and Kronk has denied anything to do with the girl&#8217;s death.

His ex-wife Jill Kerley, however, believes Kronk should be considered a suspect in Caylee&#8217;s death, according to WESH 2 News.

Attorney Mark NeJame, who now represents Texas Equusearch, but at one time represented Casey Anthony&#8217;s parents, George and Cindy, and also represented Kronk, believes Casey&#8217;s case may be damaged by trying to paint Kronk as a suspect.

&#8220;I have no doubt. He found Caylee and had nothing to do with the case other than that,&#8221; said NeJame

During the hearing, it came out that prosecutors had offered Casey a 5-year sentence; it's more than she wanted and it's more than she ended up getting. She got credit for the 412 days she's already spent in jail. She also has to pay almost $6,000 in court and prosecution costs, which she says is too high.

&#8220;Five years [in jail], in our position, is extremely absurd,&#8221; Baez argued regarding the sentencing they are requesting with the plea. "We simply ask that she receive equal justice under the law."

&#8220;She&#8217;s charged with 13 separate crimes or offenses as a result of the four stolen checks,&#8221; Judge Strickland said after hearing both sides&#8217; arguments. &#8220;On counts 3, 6, 9 and 12, those are the forgery counts, there is going to be an adjudication of guilt and time served is 412 days.&#8221;

Strickland also adjudicated guilt on counts 1 and 2 with time served.

&#8220;As for the four counts of uttering a forged check, 4, 7, 10, 13, and as to counts 5, 8, 11, three of the four fraudulent use of identification counts, the court is going to withhold adjudication with time served and one year of supervised probation,&#8221; Judge Strickland said.

Two other motions were also addressed during Monday&#8217;s hearing relating to the murder case against Casey.

The judge granted the defense's motion to get testimony before the trial from the ex-wife of Roy Kronk, who found Caylee's remains.

The judge also granted the prosecution's motion to get a schedule together for discovery and a preliminary witness list in an effort to move things along towards a trial. A date was not set.

Meanwhile, the defense's motion to stop the Orange County jail from taping Casey when she meets with her attorneys was denied late Monday.
