Suspect Says Homicide Victim Hurt Family

KANSAS CITY, Mo. -- An eastern Missouri truck driver accused of helping to kill a drifter said he became embroiled in a drug scheme with the victim when the family fell on hard times while caring for a gravely ill child.

But in a series of interviews with The Associated Press, murder suspect Chester "C.J." Harvey Jr. said it was an alleged attack on his wife and three of his five sons -- not drugs -- that led to the death of James William Boyd McNeely. The body of the 20-year-old was found Dec. 22 in the refrigerated compartment of Harvey's rig.

"That man will never hurt another child," Harvey said in one of the interviews. "And as far as I'm concerned, that's a great thing."

Harvey, his wife, Angela, and three of his sons -- ages 19, 16 and 14 -- face first-degree murder charges in Audrain County Circuit Court. Three other men have been charged as accomplices with kidnapping McNeely.

However, Harvey repeatedly insisted his wife and the two younger boys are innocent in the killing, which he said was part of an "unbelievable" story spanning multiple states and including others who have yet to be charged.

The 38-year-old Harvey said he met McNeely in November at a Charleston, Tenn., truck stop and gave him a ride after the younger man told him he was hitchhiking across the country to meet a toddler son whom he claimed he had just learned about. Relatives of McNeely have said he had a son during a brief marriage and knew of his birth.

Harvey said that while helping McNeely get closer to his destination of Columbus, Ohio, the conversation shifted to drugs, with McNeely talking about the chance to earn big money.

Harvey, who said he had dabbled in drugs, was desperate for cash. He already had filed for bankruptcy as his wife cared full-time for their 9-year-old son who required daily dialysis.

To make ends meet, Harvey had been making it look like his wife, also a licensed trucker, was operating his rig part of the time. That allowed him to skirt federal limits on how many hours drivers can spend on the road and go as far as "my body would allow," he said.

What? Which is it? First drugs. Then no drugs. Back to the drugs and then the torture/murder?

He attacked the wife and three of the sons? Of course we can't say from just the phtographs we saw of the victim, but that wife looked like she could kick some azz all by her lonesome.

Sheeeesh. Didn't this guys attorney tell him to keep quiet?
 
Well, Chester did say that it was an unbelievable story. I don't believe it as McNeely posted all about his baby boy and the baby's mother on his MS page, almost a year ago. He was very proud of both of them. I don't see how he could have posted much after he ran into Mr. Harvey and his family.

That one didn't work, try another lie.

Murder suspect speaks out

"Murder suspect Chester C. Harvey Jr. called the man he’s accused of smothering with a garbage bag a “very bad person” who hurt his family.

So far, the 38-year-old truck driver is the only one of eight suspects in the case to speak out. Harvey talked briefly Wednesday as he was led in arm and ankle shackles from the Audrain County Courthouse in Mexico following a hearing.

Harvey is accused of first-degree murder, kidnapping and armed criminal action in the Dec. 18, 2009, death of 20-year-old James William Boyd McNeely in the basement of Harvey’s home at 312 Young in Laddonia.

“He did attack my family” but “ I’m not going to comment on that,” Harvey said about McNeely.

“I’m definitely looking forward to my day in court,” Harvey continued. “We might as well go ahead and get it all out and do a fast and speedy trial, if you know what I’m saying. The truth will come out in the end......."

Well, with them all in jail, I wonder who is taking care of the son who needs dialysis?
 
My hope is that he's been placed in an appropriate foster care home trained to deal with his needs. The state always attempts to place with family but with that family, I'm not so sure you'd find an appropriate placement. If he does have some stable, loving relations, they'd be encouraged to be involved with his life. We've had some very disabled children who have maintained wonderful relationships with grandparents while never seeing parents. My prayers are with that little guy.

"A plea agreement shows a northwest Missouri trucker's son who admitted to participating in the killing of an Ohio drifter has agreed to cooperate with authorities and testify as needed.

The Associated Press on Thursday obtained a copy of what Chad Michael Harvey agreed to when he pleaded guilty Tuesday to a reduced charge of second-degree murder in the killing of James William Boyd McNeely...."

Note that people who knew him said he didn't do drugs and that he was smart. He did work hard to get his GED, after all. I am guessing that he was bright in some ways but possibly a bit slow in others due to his prenatal alcohol/drug exposure (which was well reported). His aunt says that he wanted to be liked and to "fit in". I still think that he was talking too much for this horrid family's comfort.

COLUMBIA, Mo. (AP) -- A 20-year-old eastern Missouri man who admitted to participating in the killing of an Ohio drifter wants to withdraw his guilty plea.

Chad Harvey told KMIZ in Columbia on Monday that he and other family members accused in the case had been using methamphetamine and were under the control of his father, Chester "C.J." Harvey, when 20-year-old James William Boyd McNeely was killed.

Audrain County Prosecutor Jacob Shellabarger told the AP that the defense hasn't filed a motion seeking to withdraw Chad Harvey's plea, but that the state would oppose such an effort.

Under a deal with prosecutors, Chad Harvey agreed to cooperate with authorities and testify as needed in exchange for being allowed to plead guilty to a reduced charge of second-degree murder, as well as kidnapping and abandonment of a corpse. He originally was charged with first-degree murder.

The plea agreement shows prosecutors also agreed to dismiss a charge of armed criminal action at Chad Harvey's sentencing, which is scheduled for Dec. 20 in Boone County, where his case is being heard on a change of venue.

I have to admit that I'm confused. Does this sentence reflect the plea or the retraction of the plea? I'm very pleased to see that McNeely's young wife and her mother testified. Even though they were separated at the time of McNeely's death, she has been extremely respectful of his memory. James "Bo" McNeely's pride in his little boy was quite obvious.
