Not believing this -- to clarify, I believe the cell mate, but not the 's story. (Sorry I don't remember his name and I don't care to). I believe it will be found that Jasmine was molested. He is blaming her for his crimes, and trying to "sound crazy", IMHOO. I speculate he offered her something to eat, but took advantage of her once she was in the room. We will see....

In many criminal cases when a person’s mental competency is in question, a defendant will be found not fit to stand trial, and that defendant will be evaluated and treated for months while prosecutors attempt to get that person fit for trial.

In some cases, like with the murder case of Mohamed Dawod in Springfield that closed in May, the case is eventually dismissed if it’s determined the defendant will never be competent to stand trial.

What happens then? Does he get locked up in a mental institution (do they still even have those?), or does he just get set free?
Even though I understand that everyone deserves a fair trial I'm floored.

In the case of Mohamed Dawod, the charges were dismissed without prejudice. So if he ever becomes well enough to be competent, he can be arrested and charged again. Until then he is under guardianship in a psychiatric hospital.

Remember what that monster's mugshot looked like?!? Who wouldn't be scared/creeped out by that man? I hate to have to call it like I see it on this one, but this poor little girl lost her life to addiction, neglect, and a lack of proper oversight by social services. Many red flags had been thrown out from what I recall. That hotel, and many others on the 'strip' in Branson, are occupied primarily by child molesters (no background check for those renting rooms by the day, week, etc.,), drug addicts, and degenerates. There are a handful of family-friendly shelters in that area, and more non-profit (mostly faith bases-hello, bible belt) agencies that are around specifically to assist the homeless to find housing. Most have stipulation: you must remain sober. Thus, these motels that have all gone to sh.. since tourism has been declining so over the last 20 years or so, are happy to rent to whoever, whenever. Those who have their children there are perfectly aware of the environment which they are placing their child. That was a deteriorating old motel that is operating as an extended-stay type place, not an apartment, and I would bet that if you were to go there yourself, you would come across a couple of people that could seem scary to you as well. This is not a bashing on the homeless. i have worked with the homeless community for over a decade. This is about addicted parents placing their child in harms way due to their addictions, and a lack of follow-thorough on the behalf of social services.

Some of the elderly people who lived at one time in the same apartment complex with the man accused of strangling a 6-year-old in Branson remember being terrified of him.

A man accused of killing a 6-year-old girl in a Branson hotel room last year could be facing a court hearing in the next two months to determine if he is fit to stand trial.

In early July, the online docket for the case showed that an order filed by the Department of Mental Health found that Roberts is “permanently incompetent to stand trial.” The online listing was later changed to state only that a mental exam had been filed and sent to Eighmy for review.

Taney County Prosecutor Jeff Merrell filed an objection to the proposed order. On Thursday, Eighmy ruled that the Department of Mental Health could release Roberts’ documents to Taney County Prosecutor Jeff Merrell and that he would provide a complete copy to Roberts’ public defender James Egan. According to online court records, Eighmy will meet with the two attorneys Nov. 10 to determine a date to hold a competency hearing. The records show that Eighmy would like the hearing to take place in December or January.

Nearly two years after a six-year-old girl was found dead in a Branson motel room, a Taney County court continues to review the mental competency of the man accused of murdering her.

John Roberts, 57, is charged with first-degree murder in the death of Jasmine Miller.

During a hearing Friday at Taney County Courthouse, Judge Eric Eighmy listened to multiple witnesses as they were questioned by Prosecuting Attorney Jeff Merrell and Public Defender James Egan.

Witnesses ranging from previous cell mates to mental health experts were called to testify throughout the day-long hearing. Due to time constraints, Eighmy had to end the proceedings at 5 p.m. with the motion to continue at a later date.

A Taney County judge is in the final steps in deciding whether or not a man accused of murdering a six-year-old girl is competent to stand trial.

John Roberts, 57, is charged with first-degree murder in the death of Jasmine Miller.

At a continuation hearing Friday, Judge Eric Eighmy listened to two more witnesses before instructing the council to “prepare proposed findings of fact by April 15,” according to online court records. Prosecuting Attorney Jeff Merrell said the judge will probably make his decision after that in about a week.

The two witnesses included Dr. Lisa Mathews, who is a licensed psychologist and certified forensic examiner with the Department of Mental Health, and Sara Kern, a social worker and case worker with Fulton State Hospital.

A public defender for John Roberts, 56, had filed a motion in the state’s southern appellate court, hoping to overturn a Taney County Court’s decision that Roberts is competent to stand trial.

On Monday, a three-member panel of the court denied the appeal, according to online court records.

Roberts will face a preliminary hearing in Taney County Court Aug. 16.

The defense continues to argue Roberts is not mentally competent to stand trial, but Associate Circuit Judge Eric Eighmy ruled to move the case on to circuit court.

Fifty-eight-year-old John Roberts of Branson appeared in court before newly-assigned Judge Jason Brown on Tuesday, and pleaded not guilty to first-degree murder after asserting an objection to the arraignment based on competency, which Brown overruled, according to court documents.

Brown set a pre-trial conference for December 12th, and plans to schedule a trial date at that time.

Roberts’s attorney announced his intent to file a new motion regarding competency by November 20th.

Nearly three years after the murder of a 6-year-old girl, the accused killer might undergo more examination by the Department of Mental Health.

During a hearing Dec. 19, Judge Jason Brown announced he is considering whether to permit an exam, limited in scope, by the Department of Mental Health, according to online court records.

“The judge basically indicated that he is entertaining the idea of the Department of Mental Health do a limited review of defendant’s situation,” Taney County Prosecuting Attorney Jeff Merrell said after the hearing.

After reviewing propositions by Roberts’ attorney James Egan and Prosecuting Attorney Jeff Merrell, Judge Jason Brown announced on Jan. 2 via online court records that he would grant a limited examination to evaluate Roberts.

Certain aspects of Roberts’ mental health were discussed during a Dec. 19, 2017 hearing; however, on Dec. 8, the court ordered that media is “strictly prohibited from reporting, repeating or divulging any healthcare or mental health evidence or information mentioned or referenced in any court proceeding or filing, until further court order.” That order still stands as of Branson Tri-Lakes News deadline.
