No proceedings in the Adam Montgomery murder trial will occur Monday because it's Presidents' Day.

Testimony instead will resume at 9 a.m. Tuesday.

Before jurors were dismissed for the day Friday, Judge Amy Messer told them the trial is moving a bit faster than anticipated, and that it was possible all testimony would conclude later this week.

Adam Montgomery wants estranged wife’s testimony blocked from jury deliberations in his murder trial

Lawyers for Adam Montgomery, the New Hampshire man accused of killing his 5-year-old daughter, Harmony, reportedly want his estranged wife’s testimony blocked from jury deliberations in his murder trial.

The defense’s request came over Presidents Day weekend when the court was closed Monday, according to the Union Leader. They argue that prosecutors acted improperly when it came to interactions with Kayla Montgomery and her legal team.

The first witness to testify Tuesday was Douglas Small, the grandfather of Kelsey Small, Adam Montgomery's girlfriend who was found dead in a hotel room in March of 2022. She did not face charges in connection with the case and her death was not considered suspicious.

Douglas Small said Adam stayed at his home in Carmel, Maine, for several weeks. He said he drove to Rochester, New Hampshire, on Nov. 11, 2021 to pick up Adam and his granddaughter. They reportedly stayed with him on two separate occasions, and possibly one night with his daughter-in-law as well.

Small said around that time, he lent his granddaughter and Adam Montgomery his Pontiac Grand Prix so they could drive back to Manchester.

He said at some point, a group of police detectives searched an old schoolhouse on a property he owned. But he said he didn't know at the time what they were searching for.

The second witness was Massachusetts State Police Trooper Bryan Hernandez, who works as a detective with the Suffolk County District Attorney's Office. He acted as a liaison between Massachusetts State Police and the Manchester Police Department during the investigation into Harmony Montgomery's disappearance.

In their motion, the defense says prosecutors informed Kayla Montgomery's attorney that Kayla Montgomery being alone with Harmony would be “an area of attack by the defense” during cross-examination and asked Garrity to “discuss that with Kayla, to apprise her of it.”

In its objection, the state calls the defense's motion, "fantastically mistitled." Prosecutors say the state did not direct Kayla Montgomery's attorney to speak to his client. Rather, the state provided Attorney Garrity with information to adequately represent his client.

Adam Montgomery's attorney has also filed a motion to dismiss the charges of second-degree assault, second-degree murder and witness tampering. The judge has denied the motion.

Adam Montgomery has not been in court for the trial since jury selection. Messer noted that if he waives his right to appear in court Wednesday, that will also mean he is waiving his right to testify.

Why would he need a U haul to dispose of a body that fit in a diaper bag??? I wonder if he could have put her in something much larger and heavier???

Smith: Adam did not kill his baby girl. He made horrible and criminal decisions after Harmony's death to keep his family together.

Smith: When you look at critical eye at Kayla’s lies, you will see they are lies intertwined with the truth.The allegation that Adam beat his child for days and then on 12/7 for hours, is crazy.

Defense rests. No witnesses called. We’re heading right into closing arguments. The defendant’s chair is empty. #AdamMontgomery once again waived his right to be here.

Judge also ruled that Kayla Montgomery's testimony will *not be excluded from jury deliberations. Adam's attorney, Caroline Smith, is telling the jury that Kayla lied during testimony.

Smith notes that Kayla testified Adam beat Harmony 10-15 times around 2/3AM the morning before they went to the clinic. Also testified that Harmony had no injuries when they arrived at the clinic. "How can that be?" Smith asks. "It doesn't make sense because it's a lie."

Smith says Harmony was a loving child. She says instinct would cause someone to protect her if she was being hit.

Smith brings the jury to the intersection of Webster and Elm, where prosecutors say A&K realized Harmony was dead. Smith says Harmony died before that moment. She says A&K were going somewhere to get rid of her body when the car broke down.

Smith says Harmony was already dead in a bag in the trunk of the car. That's why, Smith says, #AdamMontgomery was able to remove Harmony from the car without anyone at the intersection seeing the little girl.

Smith says Kayla's love for Adam would have died if he truly beat Harmony. She says no one can maintain love for a man who could do that to a child. Kayla testified that she still cares for Adam.

Smith says when police first spoke to Kayla, Adam was living in Maine with his gf. She says Kayla did not tell police what happened to #HarmonyMontgomery. Smith says rather, Kayla called Adam to get back to NH. Says the two were partners in this conspiracy.

Smith highlights a transcript b/t Kayla and police when investigators asked her if Adam ever purchased or stole power tools. Kayla told them no.

#HarmonyMontgomery's mother, Crystal Sorey, leaves the courtroom as Atty. Smith goes over the alleged dismemberment of Harmony's body.

Smith says #AdamMontgomery was driving Anthony Bodero, leaving Kayla alone with the children. She says Adam returned to find #HarmonyMontgomery was dead.

Smith highlights lack of blood found inside the family's car where #AdamMontgomery allegedly beat #HarmonyMontgomery 10-15 times.

Smith: "Why does Kayla make up these truths or hide and work hard to make you think a different story? Because the truth leads to her."

Smith ends her closing arguments by reminding jurors that they can only convict #AdamMontgomery if they believe the state has met its burden of proof beyond a reasonable doubt. Court is in at 15-minute break. State is up next.
