“All he has is his car, and his rage, and his fists,” Agati said, later adding, “She doesn’t get a headstone in the ground above the head that he battered. She doesn’t get to be at peace and death because of what he did, because he can’t afford to tell anyone where she is.”

Montgomery "may have genetically donated half his DNA to [Harmony], but he was never her father," Agati said. "She was an object that he beat, stuffed, put in a cooler."

MANCHESTER, N.H. – Adam Montgomery, the New Hampshire father accused of killing his daughter, 5-year-old Harmony Montgomery, was found guilty of second-degree murder on Thursday.

Montgomery was also found guilty of second-degree assault, falsifying physical evidence, abuse of a corpse, and witness tampering.

Jurors deliberated for about seven hours after getting the case on Wednesday. They asked the judge one question Thursday about the legal definition of the word "recklessly."

Montgomery was not in the courtroom when the verdict was read. He chose not to be in the courtroom for the entirety of the trial.

Harmony's mother, Crystal Sorey, locked her arms with Harmony's foster mother in the courtroom for the verdicts. The room was packed with reporters and law enforcement, and an audible sigh could be heard as the guilty verdicts were read.

"I'm finally feeling relieved that there's some justice being served," Sorey said. "Obviously, it's not over, but I have a little bit of peace knowing that he's being held accountable, because he thought he was so untouchable and that she didn't matter and nobody would miss her, and he was so wrong. He was so wrong."

Adam Montgomery: Father of missing 5-year-old Harmony Montgomery found guilty of second-degree murder in her death | CNN
“It was a very, very difficult case,” Assistant Attorney General Benjamin Agati said during a news conference following the verdict.

“Every person who has their life taken from them, by murder, whether it is a 5-year-old child, or a 63-year-old man, or a 45-year-old, every single person has a value of their lives,” Agati said. “This case was different in terms of some of the attention that it garnered but not in terms of the value of Harmony’s life or the value of anybody else’s life.”

Agati noted law enforcement continues to relentlessly search for her. “We’re hoping somebody sees something,” he said.

A date for sentencing has not yet been determined but Montgomery faces the possibility of life in prison on the second-degree murder charge, according to online court documents.

... They said they have been able to ping the vehicle's movements between Manchester and the Tobin Bridge in Boston using toll data.

Accounting for the distance between Manchester and Boston leaves 26 miles of driving that Montgomery could have done as he searched for a place to dispose of her remains.

One area specifically mentioned by prosecutors was the Rumney Marsh Reservation, a large wetland area near Revere and Saugus, Massachusetts. In April, Massachusetts and New Hampshire police were seen searching the marsh as part of an operation connected to Harmony.

Investigators also mentioned searches around Sales Creek in Revere and Chelsea Creek a few miles north. Adam Montgomery was from the Revere area.

Manchester police Chief Allen Aldenberg said there needs to be more accountability for Harmony's death.

"This little five-year-old girl, she deserves somebody to be held accountable that failed along the way because we wouldn't be standing here today if other people had done their job," Aldenberg said.

Sorey's attorney said she will not get true closure until Harmony's body is found.

"I do look forward to representing Crystal and helping her to hold the state accountable for what happened to Harmony. There are people that dropped the ball in state government, and if they had done their job, I truly believe Harmony would still be here today," Rus Rilee said.

Massachusetts DCF employees had requested what's known as an ICPC check, which would require New Hampshire to guarantee that Adam was sober, had a safe place to live, was employed, and was ready to parent Harmony, who had special needs and serious medical issues, including total blindness in one eye.

That check never happened, and the Massachusetts judge granted Adam custody without any guarantee that he had a place to live.

"Adam had only spent - in the period just before the transfer of custody - had only spent 20 hours with his daughter, and so he had never had her for a full day," explained Maria Moissaides, the Director of the Office of the Child Advocate. "The visits occurred in a DCF office that was supervised by DCF staff. He had never put her to sleep. He had never given her a bath. He didn't know, or his wife did not know, what it was like to actually parent Harmony over a weekend."

Still, Adam was granted custody, and Harmony was moved to New Hampshire, no longer under the watch of Massachusetts DCF. Ten months later, she was killed.

Aldenberg said he's also on another mission, to increase focus on the Division for Children, Youth and Families. He said his actions have ruffled feathers and prompted upset calls.

"I'm looking for some type of recognition that says, 'We missed the opportunity. We missed it, and had our employee or employees acted differently on that fateful day went they went over to do the check on that day, maybe the course of history on Harmony Montgomery would have changed,'" Aldenberg said.

Aldenberg said there is a long-standing good working relationship with his department and DCYF. He said he doesn't want to compromise that, but he said positive change can't happen without transparent accountability.

The woman who confessed to witnessing Harmony Montgomery’s murder and hiding the child’s body for months may soon walk out of prison a free woman.

The plea agreement, obtained by Court TV, was filed on Nov. 16, 2022, and states that Kayla would receive a sentence of 3 1/2 – 7 years on each of the two charges. However, the agreement said that prosecutors would recommend that 18 months of the minimum term be suspended on one charge, and the entire sentence of the second charge be suspended.

That means Kayla gets her first chance at freedom this month. On March 7, Kayla is scheduled to appear before the New Hampshire Adult Parole Board, which will determine whether she can be released.
