Alex Murdaugh's Lawyers Slam Embattled Court Clerk in New Documents​


Alex Murdaugh's lawyers have laid out new claims of misconduct against clerk of court Becky Hill - who they've accused of tampering with the jury in his double murder trial. A new judge, retired South Carolina Supreme Court chief justice Jean Toal, has scheduled a hearing on Murdaugh's bid for a new trial later this month. Law&Crime's Angenette Levy talks with criminal defense attorney Lori Murray about the defense's latest filing and the state's response in this episode of Crime Fix - a daily show that delves into the biggest stories in crime.

J.P. King and Crosby Landy Company announced Monday it'd be selling the Moselle Estate in an online auction Feb. 15 with a listing that makes no mention of the crimes that took place there years ago.
 
COLLETON COUNTY, S.C. (WCBD) – Tuesday marks a year since one of South Carolina’s most notable trials got underway from the Lowcountry’s front porch. Once prominent attorney Alex Murdaugh was tried for the murders of his wife and youngest son.

Margaret and Paul Murdaugh were gunned down nearly three years ago at the family’s sprawling hunting property on the border of Colleton and Hampton Counties. The small community was left shocked in the wake of the murders – murders that would prove the be the beginning of Alex Murdaugh’s unraveling.

Jury questioning hearing 1/29/2024:

Toal stressed that the hearing, including the questioning of jurors, would be conducted in open court, with public and media access. Court TV will broadcast the hearing as a pool source for other media, in addition to pool photographers for "still" photos.

On Friday, the judge questioned the foreperson in the #AlexMurdaugh trial. Today the other 11 jurors will be questioned in Murdaugh's bid for a new trial. We will have that LIVE. Jurors will not be shown on camera. This afternoon clerk Miss Becky takes the stand.

Murdaugh attorney Dick Harpootlian asks the judge not to use the term "merits" when questioning jurors. He said on Friday when questioning the foreperson, judge asked if Miss Becky had spoken to them about the "merits" of the case. He says that's a legal term and might be better to simply say "about the case" or something similar.

Foreperson on Friday told the judge Miss Becky said something about: Today the defendant is going to testify, this is epic, or something like that. (Why would she say anything to jurors about that????)


First up is juror "Z".

Juror Z says clerk Miss Becky Hill told her to watch #AlexMurdauhgh's actions and to watch him closely.

BREAKING: Juror Z says YES, her verdict was influenced by clerk of court Becky Hill. "She made it seem like he was already guilty.” ‘




Here are the FOUR questions Judge Toal will ask each juror: 1. Was that an accurate statement about your verdict at that time?2. Was your verdict based entirely on the testimony, evidence, and law presented to you in this case?3. Did you hear Miss Becky Hill make any comment about this case before your verdict? If yes, what did Miss Hill say?4. Was your verdict on March 2, 2023 influenced in any way by any communications by the clerk of court Becky Hill in this case?


This is what Judge Toal starts out saying to each juror then goes to the 4 questions: You rendered a verdict on March 2, 2023. That verdict was read in open court by the foreperson of the jury. Then the court said this: “Madam forelady and member of the jury, if that is your verdict, of each and every juror, let it be known by raising your hand.” The transcript then indicates that the jurors complied. The jury was individually polled and each was asked, was that your verdict? Each juror answered yes. Each juror was then asked, is that still your verdict? And each juror answered yes.



Juror Z affidavit states that Miss Becky told her/them to watch #AlexMurdaugh carefully among other things and she took all of that to mean Murdaugh was going to lie.

Juror Z: When we began deliberations Miss Hill told us this shouldn't take too long. (All of this, if true, is so inappropriate)

Juror Z says she voted guilty because she felt pressure from the other jurors.

Juror Z: After the verdict Miss Hill pressured the entire jury to speak to a television show.
Judge: The jurors' cellphones were not confiscated and so they have tuned in and listened to everything that just went on in court. (Unbelievable!)



I really don't see how #AlexMurdaugh is not getting a new trial simply based on the first juror's testimony this morning. 10 more to go.

This might be the craziest thing I've seen in a trial/in court in the MANY years I've been watching and covering trials. And I've seen a lot of crazy!


Juror C: He wasn't influenced by Becky Hill. He's done, next juror coming up.


Juror F: She says another juror didn't have today's proceedings on their phone and she saw it. She says it won't impact her testimony today.
Juror F says her verdict was not influenced by Becky Hill.


Juror L: He did not hear Becky Hill make any comment about the case before the verdict. He was not influenced.

Juror E: He did not hear Becky Hill make any comment before the verdict. His verdict was not influenced.

Juror P: He did hear Becky Hill tell jurors to watch #AlexMurdaugh body language when he took the stand. He says his verdict was not influenced by comments by Hill.


Juror 0: He did not hear anything said by Becky Hill.

Juror Y: He says Becky Hill didn't make a comment to him before verdict. His verdict was not influenced.

Juror W: No comments from Becky Hill. Verdict not influenced.

Juror Q: Didn't hear Becky Hill make any comment. Verdict not influenced.

Juror K: Didn't hear any comments from Becky Hill.


That completes the questioning of the jurors.

RECAP: Juror Z says Miss Becky influenced her verdict as well as other jurors during deliberations pressured her to vote guilty.Juror P did hear Becky say to watch Murdaugh's body language but it didn't influence him.Foreperson heard Hill talk about watching Murdaugh closely when he testifies and that this is epic or something like that. Her verdict wasn't influenced by it.Remaining 9 jurors heard nothing from HillLunch until 1:15 and then clerk of courts Miss Becky Hill will take the stand.

the fact the jurors were sitting in the back room streaming the hearing is shocking.they were being called in one by one ... and not supposed to hear what each other were saying or the arguments being made by the lawyers.judge says their cell phones have now been taken.

Two big developments so far in Alex Murdaugh hearing.1. juror said her verdict WAS influenced by the clerk of court.2. judge just said the jurors have been streaming the livestream in the back room -- cell phones were not confiscated. This could be a big problem.

 
Afternoon in #AlexMurdaugh hearing, defense bid for new trial.

Defense asks the judge to allow them to put on witnesses before the state since this is their motion and they have the burden of proof.

Toal: The pretrial was the time to figure out what we're doing today. She says today is "pretty late in time" to talk about order of witnesses/or any witnesses. She also says Becky Hill is a witness that both sides need.

Toal says she wait to see what Becky Hill has to say and then decide if there is a need for any other witnesses.

NEW: Attorney representing juror Z (the main juror in this hearing) wants to "enhance" her affidavit.

WATCH: Clerk of court Becky Hill denies all allegations that she attempted to influence the jury and denies the specific allegations.



Miss Becky testifies she directed comments to the bailiff about #AlexMurdaugh about to testify and that there could have been jurors in earshot. About telling jurors to pay attention, body language, etc.. She denies that but says she would always check on jurors if they needed coffee, etc.. and she said "Pay attention, it's a big day today.”

Under cross-exam Becky denies taking a juror home.

Harpootlian: Did you text, email or communicate on the morning before final arguments were completed to people that if they wanted to see the trial they should come, because the jury probably wouldn't be out very long? Hill: I do remember saying that, yes. Harpootlian: Why did you think they wouldn't be out long? Did you communicate with jurors? Hill: I had not communicated with jurors about anything related to this trial, at all.

Harpootlian: How much money did you make off the book? Becky: Around $100K (with her co-author)

Becky Hill testifies she stopped selling her book because she admits to plagiarism.

Justice Toal asking her own questions of Becky Hill about "egg" juror.



Toal quizzing Hill about the hearing Judge Newman had about "egg lady". That juror told Newman that Hill had asked the juror about a post her ex-husband allegedly made on FB. Hill says she doesn't remember saying anything like that to the juror. (Newman was angry at Hill during that hearing)

Hill says all she knows is it wasn't her that talked to the juror about the FB post.

Hill says on the way escorting 'egg lady' from the jury room to Judge Newman's chambers the juror was very "chatty" and was talking about 3 restraining orders she had against her ex.

Sounds like Toal isn't fully believing Becky Hill about "egg lady"

Toal to Hill: Don't just nod, answer the question (almost with an explanation point)

Toal: The judge said he was not too happy with you talking to the juror, do you recall that? Hill: Yes Toal: And did you pop up and say what you're saying now? Hill: I wasn't in the room when he said that.


Toal now asking Hill about photos of the deceased victims. The judge had them under seal and they were "under your control". Then the photos made them into the public. Hill says she thinks someone in the gallery took photos of the the photo of the bodies with their phone.

Toal asks Hill if she ever gave Netflix or other media access to the photos of the deceased victims. She said she did not.

BTW, what I remember about the leaked autopsy photo is it was likely a screenshot from one of the live streams when the pool camera inadvertently captured the autopsy photo that was displayed on the prosecutor's monitor.

NEW: Justice Toal WILL allow Barnwell County clerk of court to testify. This is the witness that will allegedly say that Becky Hill did or told her she did give a ride to a juror.

Toal made the decision to allow the defense to call the other clerk "In light of some of the answers..." Becky Hill gave.

Also, when questioned about sealed exhibits going to media/Netflix, Becky Hill said that was a mistake and said something about the court reporter not marking them properly in the transcript (sorry, didn't catch verbatim).

Harpootlian says "egg lady" juror is across the street right now if Justice Toal wants to hear from her. Toal says her affidavit and Hill's testimony about the incident are enough. Break until 3:15pm.

Court back in session.

NOW: Barnwell county Clerk of Court Rhonda McElveen on the stand.

McElveen is a friend of Becky Hill.

McElveen says her and Hill discussed writing a book about #AlexMurdaugh trial, "because she needed a lake house and I needed to retire." (She's been funny/bit sarcastic during testimony)

McElveen testified that Becky Hill said to her a guilty verdict would be better to sell books.

McElveen said she arrived in court one morning and was told that Becky Hill had taken a juror home the night before. She saw Becky and said, "Please tell me you didn't take a juror home." Becky told her she did but she didn't talk about the case......

Here is McElveen saying Becky Hill admitted to her to giving a juror a ride home.


Under cross-exam, McElveen says there wasn't ever anything that happened where she thought she should report it to Judge Newman.

NOW: Defense calls alternate juror #741.

Juror 741 signed an affidavit this morning. In her affidavit she said before the defense began their case, Becky Hill told jurors "The defense is about to do their side. They are going to say things that will try to confuse you. Don't let them confuse you or convince you or throw you off. “



Juror 741 also says that Becky Hill told jurors not to be afraid to show emotion because "That's what they want to see."

Note: Because I know this is confusing. Juror 741 is not "egg lady".


Justice Toal not having it! "Mr. Meadows are you lecturing the witness or me?" Also, she tells him he doesn't need to walk all over the court. (This is his style)

Closing arguments just concluded. Justice Toal will take a break until 4:55pm.

Because Justice Toal isn't taking this under advisement and she's only taking a 15 minute break before ruling.............I'm assuming her mind is made up about #AlexMurdaugh getting a new trial.

Justice Toal: I believe the trial judge (her in this case) should rule on this quickly so it can get back to the appeals court, which has been paused, for them to do the lengthy reviews they do.
