It is the opinion of expert witness, Grant Fredericks that the truck in both videos from CCTV are that of the M's.

Judge says he does not have any questions about the methodology or the science used. But does question breadth of how it can be applied.

Well, he's qualified, so that's something. Doesn't the court determine who can be an expert, and the jury decides what and how much of that expert's opinions and testimony to take into account? That's what I seem to recall from the Jodi Arias trial. Especially if there are dueling experts.
 
Since Judge Dennis jumped in right away when she ask Mr. Fredericks if all other courts allowed his testimony, he cut her off and didn`t allow that question to be answered. IMO, he has already come to his conclusion that he isn`t going to allow it or at least some important issues. He didn`t want to make it look bad on himself. He is being like most of us thought. And those 2 are going to walk because of it.
 
The solicitor's question was "so if this court determines that your opinion cannot be rendered, it will be the first time this decision ever occurred in a forensic photo vehicle case in this country, to your knowledge?" That's when the judge jumped in and said "come on you know that's not a good question!"
 
Defense expert isn't coming off well IMO- seems defensive (LOL no pun intended)

Bruce E. Koenig, the senior examiner of BEK TEK LLC, has been involved in the forensic analysis of audio and video recordings on a full-time basis since 1974. Mr. Koenig was a Supervisory Special Agent for the Federal Bureau of Investigation from 1974 through his retirement at the end of 1995, ending his career as manager and senior audio examiner for the Audio/Video Signal Processing program. His formal education includes a B.S. degree with majors in Physics and Mathematics, and an M.F.S. degree in Forensic Science. He has published over 40 peer-reviewed papers in his fields of expertise, testified as an expert witness on over 390 occasions, attended numerous seminars and specialized short courses, and has been actively involved in numerous significant investigations. A more specific compilation of Mr. Koenig's background is listed in his curriculum vitae.

Pretty sure technology has advanced quite a bit in 20+ years. Looks like the expert isn't as up to date as he needs to be, imo
 
Prosecution talking to Koenig about his previous testimony in court cases. On the first page the two are reviewing, he said he testified in one criminal case involving video. They have moved on to the second page of his testimony experience.

He does sound defensive and condescending.
 
This guy is not nearly as seasoned as the state's witness. Yes, he's testified in 390 trials, but the vast majority were civil cases. He didn't even write a report for this hearing. The state's witness did. Plus he comes across as *extremely* defensive. Of course we know the judge will give this guy great latitude because that's just how Judge Dennis rolls.

The judge just lectured the state again because she's trying to impeach the witness's own statements and he won't answer her questions. sigh...

Judge has already hinted that he (judge) considers both civil and criminal testifying 'valid.'

Judge will allow the defense witness to testify as an expert witness.

(Ok I simply hate this judge. Sorry I know that's a strong word, but I do).
 
This guy is just giving his opinion, huge difference between research vs opinions.
