Affidavit: DNA of missing Fort Worth woman found on trunk of suspect’s Camaro
Published: December 19, 2014 10:37 am

New details released Friday show that a swab taken from the edge of the trunk opening of Enrique Arochi’s Camaro was a perfect match to DNA of Christina Morris, despite Arochi’s statements to police that the missing woman was never in his car.

Documents related to that arrest had been sealed but then were released by the court on Friday morning.

Police say interviews show that Arochi was angry that night because another friend had “refused his sexual advances” and that “an opportunity presented itself for him to act upon his anger and sexual frustration when he found himself alone” with Morris.

According to the probable cause affidavit for Arochi’s arrest, the DNA sample of Morris on Arochi’s car was not from mere touch but more likely from a bodily fluid such as blood or saliva, according to analysis by Dr. R. Staub, the Plano Police Department’s expert on DNA.

According to police records obtained on Friday, officers found a “significant amount of DNA” in Arochi’s car. The DNA came from the blood and saliva of a female. It was recovered from the edge of the car’s trunk opening. The police search and arrest warrants suggest that Arochi left the parking garage “with Christina Morris in the trunk” of his car.

Missing Woman Left Shops at Legacy in Friend's Trunk: Warrant
Friday, Dec 19, 2014 • Updated at 5:30 PM CST

According to the arrest warrant affidavit, Plano police believe "Arochi left the Shops at Legacy area and returned to his residence ... with Christina Morris in the trunk of his 2010 Chevrolet Camaro contrary to his statements that Morris was never in his vehicle" and that "he intentionally or knowingly abducted another person, Christina Marie Morris, with the intent to inflict bodily injury on her or violate or abuse her sexually."
During a news conference Friday afternoon, Morris' mother, Jonni McElroy, said she was disgusted by what she read in the report and that she remained as committed as ever to finding her daughter.

Toll tag records show Arochi’s car traveled through the Custer Road gantry on State Highway 121 at 4:08 a.m. Aug. 30. However, cell phone records show Morris’ and Arochi’s phones pinged a cell tower at 5800 Granite Parkway at 4:47 a.m. and 4:56 a.m., respectively, indicating Arochi returned to an area just north of The Shops at Legacy.
Arochi’s attorney, Keith Gore, released the following statement:

Christina Morris kidnapping suspect denied bond reduction

During the hearing, a Plano Police Department detective testified that Morris' DNA was found on the trunk mat in Arochi's car. There was also a significant amount of DNA evidence on the trunk's interior rubber seal.

Prosecutors said Arochi made one unanswered call and sent two unanswered text messages to Hunter Foster, Morris' boyfriend, on the night of her disappearance.

Rick Staub, Plano PD Crime Scene Investigation manager, testified that criminalists used a forensic tool called Blue Star to test for blood in Arochi’s vehicle. When the substance was sprayed in the trunk, two spots “luminesced faintly,” which Staub said indicated the presence of blood.
“It certainly would be consistent with a bodily injury due to the large quantity of her DNA,” he said.

Lead Detective Robyn Busby described the injuries she witnessed on Arochi’s hands and right forearm during interviews just days after Christina’s disappearance. In a Sept. 3 interview, Arochi told detectives he sustained the injuries while rotating his tires and peeling paint off the rims of his tires. The search warrant affidavit indicated that his story did not match the injuries.

During the hearing, Smith issued a motion to quash a subpoena duces tecum, which had been filed by Keith Gore, Arochi’s attorney, to require the detectives to produce evidence detailed in the arrest warrant affidavit. Smith partially granted a motion to preserve evidence, ordering the state to preserve biological and physical evidence and notify the defense after testing if evidence is totally consumed during the process.

From the courtroom: Arochi probable cause hearing notes

Recorded interviews between Arochi and Stamm on 9/3 and 9/4
Arochi tells Stamm he went to Petrosky’s between 10-11 p.m. and parked by her apartment, then drove by himself to the bars, parking in the Blue Martini parking garage. He said the group of nine went to Henry’s Tavern, then headed to Scruffy Duffies between 12:30-1 a.m.
Arochi tells Stamm they left Scruffy Duffies just before 2 a.m. and headed back to Petrosky’s to retrieve her car and go to Whataburger with Sabrina Boss and Petrosky. First, Arochi said Morris and Steven Nickerson were waiting for them back at Petrosky’s, but then he said they arrived after they started eating their fast food at the apartment.
Arochi initially tells Stamm he and Morris parted ways when they reached the end of the apartment complexes near Legacy Drive. He said they did not cross Legacy together.
Arochi said Morris asked for an Adderall, which Petrosky gave her before going to the bars.
Arochi denied smoking weed or hitting on Morris, saying he had a girlfriend of five years.
Arochi said he knew Foster because he saw him several months ago at the hospital where their mutual friend, Jordan Brown, died.

Team Christina' won't relent in pursuit of answers
February 9, 2015

"It won't stop until we see justice or get answers," said Jonni McElroy, the mother of Christina Morris, the Fort Worth woman who has been missing since August 30.

Nearly a dozen family and friends stood outside Enrique Arochi's home on Monday evening. Arochi is accused of kidnapping Morris. It's been more than five months now, and no trace of her has been found.

Arochi indicted for aggravated kidnapping, 4 counts of child sexual assault
Defendant to enter not guilty plea, attorney says

More than six months after 23-year-old Christina Morris went missing, Enrique Arochi was indicted by a grand jury Tuesday for her aggravated kidnapping. In a separate hearing, Arochi was indicted on four counts of sexual assault of a child for a past relationship with a 16-year-old girl.

According to court records, the grand jury believes Arochi intended to inflict bodily injury, sexually abuse and terrorize Morris by “intentionally or knowingly abduct[ing her] by restricting the movements … without her consent so as to interfere substantially with her liberty … by secreting or holding her in a place where she was not likely to be found,” the indictment read.

On Dec. 9, a forensic report came back positive for a “significant amount” of Morris’ DNA, likely blood or saliva, on the trunk opening and trunk mat. Detectives said the DNA profile of an unknown male was also discovered. Plano PD did not have a DNA sample from Arochi to compare the unknown sample to until his Dec. 13 arrest for aggravated kidnapping. It has not been revealed if the sample has tested positive for his DNA.

7 Months Later: Christina Morris’ Mom Writes Letter to Suspect
MARCH 30, 2015

It’s now been seven months since anyone has seen 23-year-old Christina Morris.

“I’ve spent most of my morning crying. Surreal that we’re even here seven months later,” Christina’s mother Jonni McElroy said. “I haven’t gotten to see my daughter’s face. I haven’t gotten to hear her beautiful voice, see her smile.”

Trial date set for man accused of kidnapping Christina Morris
Nov. 30 start to be 15 months after woman’s disappearance
April 29, 2015

The aggravated kidnapping trial is scheduled to begin Nov. 30; the sexual assault trial will be during the week of Jan. 18, 2016. According to Prosecutor Zeke Fortenberry, the state anticipates it will need four or five days of testimony, based on current evidence and witnesses. Arochi’s court-appointed defense Attorney Keith Gore said he expects the defense will take about three days to present its case.

~~~
Gore had filed several motions, including a motion to preserve evidence and a restrictive and protective order, or gag order. After discussions during the hearing, Gore withdrew the gag order request, but Rusch made it clear that he will do whatever is necessary to ensure a fair trial for both parties.
~~~

When asked how much time is needed for analysis of the Shop Vac contents, Fortenberry turned to lead Detective Robyn Busby, who indicated it will take about 90 days to sort and process the hairs and fibers. The state estimated it will take at least four or five months for all DNA results to be back.
“Some hairs have been identified as being potentially relevant to this case,” he said. “In this case, DNA has been expedited. The Plano Police Department has paid extra money to receive results as soon as possible.”

New hairs to be tested for DNA in Christina Morris' disappearance
Trial not likely to start Nov. 30

Brittany Feagans September 18, 2015

Authorities announced Friday that newly discovered hairs from a vacuum will undergo DNA testing to determine whether they belong to Christina Morris, who disappeared more than a year ago after a night out with friends at The Shops at Legacy in Plano.

Collin County prosecutor Zeke Fortenberry told Judge Mark Rusch that he was made aware of the new evidence by the Texas Department of Public Safety on Wednesday, and notified Enrique Arochi's defense attorneys on Thursday.

~~~
Fortenberry said the Plano Police Department plans to send the hairs - at least one of which contains the root - to the University of North Texas forensics lab for DNA testing by Monday. If the hairs are viable, results will take about 12 weeks, which would mean Arochi's jury trial would not begin Nov. 30, as planned.
Testing new DNA evidence could delay Arochi trial
Carla Wade, WFAA September 18, 2015
McElroy was in the courtroom along with other family members when prosecutors announced more evidence had been found this week. Prosecutors said more hairs had turned up in the contents of a shop vacuum. Those hairs will be sent to a lab at the University of North Texas in Denton next week, but DNA testing on the hair could take up to 12 weeks making it likely that Arochi's trial will not start on Nov. 30 as scheduled.
