Enrique Arochi’s Kidnapping Trial Delayed

Prosecutors asked for a delay. They're waiting for DNA tests on hair samples found in a shop vac near Arochi's work. That'll take about 12 weeks, if the hairs can be tested at all.

So now, the aggravated kidnapping trial that was set to start next month is put off 'til June.

After two years, hundreds of tips and an arrest, family and friends still don't know what happened to Christina Morris.

The 23-year-old woman hasn't been seen since she walked with an acquaintance into a Plano parking garage. The time stamp on the Shops at Legacy surveillance video was 3:55 a.m. Aug. 30, 2014.

Despite intense, high-profile pleas and searches by authorities and those close to Morris, her whereabouts remain unknown.

On Sept. 6, all eyes will shift to a Collin County courtroom where the man accused in her disappearance is set to go on trial. Enrique Arochi, 26, is the acquaintance from that surveillance video. He has said he doesn't know what happened to Morris.

Plano police charged him with aggravated kidnapping, a first-degree felony that carries a penalty of up to life in prison. Arochi has pleaded not guilty.
 
Still No Jury For Christina Morris Kidnapping Case

MCKINNEY (CBSDFW.COM) – Opening statements are scheduled to start Wednesday in the Christina Morris kidnapping trial, as long as a jury can be seated first. Jury selection began Tuesday at the Collin County Courthouse in McKinney, and was supposed to be wrapped up by the end of the day. But the process is taking longer than expected.

Arguments begin in Christina Morris kidnapping trial

The state would argue that the most important facts of the case are the DNA evidence, the cellphone pings, and the surveillance video. Court documents revealed that Morris’ DNA was found in the trunk of Arochi’s Camaro. The state said the cellphone pings on both Morris’ and Arochi’s phones coincide, telling them at one point they were in the car together.

The defense was more concerned with the timeline of events that occurred the day Morris went missing. Arochi’s attorney Keith Gore brought up multiple text messages between Morris and her boyfriend, Hunter Foster that night and morning. Foster is currently serving time as a federal inmate on drug charges.

Boyfriend of missing woman pleads the fifth, declines to testify

Although Morris’ boyfriend, Hunter Foster, was not out with her and her friends the night she went missing, he has figured prominently in the trial.

Both sides had hoped to question Foster on his whereabouts that night. The defense was particularly interested in asking about texts Morris had supposedly sent him about threatening messages she'd received. However, Foster pleaded the fifth.

Christina Morris Kidnapping Trial Enters 2nd Week

MCKINNEY (CBSDFW.COM) – The second week of the Christina Morris kidnapping trial begins Monday, but it will likely be a shorter day than usual at the Collin County Courthouse in McKinney. One of the jurors has an important appointment in the afternoon, cutting Monday’s courtroom proceedings a bit short.

Last week in the trial, the jury heard from a range of witnesses including one of the victim’s ex-boyfriends, a technology expert and employees from The Shops at Legacy. The defense has pointed toward other people who could be held responsible for the disappearance of Morris such as boyfriend Hunter Foster. He invoked the Fifth Amendment and will not testify.

Testimony continued Monday in the trial of a man accused in the disappearance of Christina Morris. The 23-year-old Fort Worth woman was last seen at Plano's Shops at Legacy with Enrique Arochi just before 4 a.m. Aug. 30, 2014.

Plano police arrested Arochi in December 2014. He is charged with one count of aggravated kidnapping. The 26-year-old Allen man has pleaded not guilty.

The judge called for a break in the trial just before lunch on Monday, and it will resume on Tuesday. After three days of testimony in what's expected to be at least a two-week trial, here are some highlights:

Witchcraft,' magic spells, oily liquid become focal point at Christina Morris trial

An olive jar and its contents suggesting a magic spell were the focal point Wednesday in the Christina Morris kidnapping trial.

Prosecutors were in their fifth day of presenting evidence in the case against the man accused in Morris' disappearance. Enrique Arochi, 26, is charged with aggravated kidnapping.

A Plano crime scene investigator testified about evidence collected from Arochi's Allen home after his arrest in December 2014. Jurors saw photographs of the jar containing a dark-colored liquid and learned that it had been found inside a shoe in Arochi's bedroom. Prosecutors asked that the jar — kept in an evidence bag that noted which direction was up — be admitted as evidence.

Defense attorneys asked that investigator Michelle Boubel open the jar in court. But before she could get her evidence gloves on, the defense requested to be heard. Jurors were sent out of the courtroom.

DNA from Christina Morris was found on the trunk mat and the edge of the trunk opening of a Camaro that belonged to the man now on trial in connection with her disappearance two years ago.

The DNA evidence appears to put Morris inside Arochi's Camaro, something that Arochi told police during multiple interviews never happened. What jurors won't get to hear — at least for now — is one expert's opinion that the source of that DNA comes from about six droplets of Morris' blood.

Several Plano Police Department criminalists explained how those two areas of the trunk mat were selected for DNA testing. The focus turned to the trunk after police found surveillance video of Arochi using a squeegee on the back of his car at an Allen gas station. They sprayed the trunk's interior with a chemical agent that reacts to blood as well as non-biological substances such as cleaners, paint and some soils. The chemical reaction creates a luminescence, similar to a glow stick.

Jurors are expected to begin deliberating Tuesday on the fate of the man accused of kidnapping Christina Morris from a Plano parking garage two years ago.

Prosecutors rested their case Monday against Enrique Arochi, and the defense expects to call its final witness Tuesday morning. Arochi, 26, is charged with aggravated kidnapping.

Jurors have been instructed to bring a suitcase in case they fail to reach a verdict by the end of the day. District Judge Mark Rusch said that once jurors begin deliberating, they will be sequestered until they reach a verdict.

After nearly two weeks of testimony, a jury will soon decide if Enrique Arochi is the person who kidnapped Christina Morris from a Plano parking garage more than two years ago. Closing arguments in this high-profile trial are expected to begin on Tuesday morning.

Prosecutors rested their case Monday afternoon on the eighth day of trial testimony. Defense attorneys have said they plan to rest Tuesday morning. Closing statements are expected by late Tuesday morning.

After seven hours of deliberating, Collin County jurors went into sequestration Tuesday night in the kidnapping trial of Christina Morris.

Prosecutor Zeke Fortenberry said the evidence presented, including DNA, surveillance video, cell phone messages and location data, were enough to convict Arochi despite the fact Morris’ body has never been found.

MCKINNEY, TEXAS - A jury in McKinney has found Enrique Arochi guilty of aggravated kidnapping in connection to the disappearance of Christina Morris.

There was no reaction from Arochi as the verdict was read Wednesday night. After Arochi was escorted from the courtroom, Morris' family embraced.

The jury announced the decision after more than 24 hours of deliberation.

Jury Finds Enrique Arochi Guilty of Kidnapping Christina Morris

"We can breathe. I feel like the right thing happened. It's not over. It's far from over. Christina is still missing. I hope that this will possibly get us the information we need to bring her home," stepmother Anna Morris said.

Jurors deliberated for about seven hours Tuesday before one juror fell ill and was excused by the judge. An alternate juror joined the deliberations Wednesday morning, and the deliberations continued for about 10 hours before the jury informed the judge that they had reached a verdict.

The judge instructed everyone in the courtroom to refrain from showing any reaction to the verdict and a gag order remains in place.

Morris' mother, Jonni McElroy, said she is forbidden from speaking with the media until after the punishment phase but she pumped her fist as she left the courthouse Wednesday evening.

The man convicted in the aggravated kidnapping of Christina Morris is waiving the jury for punishment and will let the judge decide his sentence.

District Judge Mark Rusch explained that waiving jury punishment takes the option of probation off the table. Arochi will be going to prison.

"I'll do what I think is appropriate," Rusch told Arochi in explaining his rights.
