Derion Vence, who was charged with tampering with evidence in connection with the death of Maleah Davis, was in family court Friday to sign away his parental rights to Maleah's half-brother.

Before the court proceedings began, witnesses say Vence and Craig Davis, the father, exchanged either words or looks.

Witnesses say Davis then jumped across several tables and attacked Vence who was handcuffed and sitting in the jury box of the court room.

Vence apparently did not want to press charges so no charges will be filed against Davis.

According to testimony, Maleah’s mom, Brittany Bowens, who has undergone extensive psychological assessments at the request of CPS, is in counseling and she’s asking for her mother to get custody of her 6-year-old son.

Bowens’attorney says Davis tested positive for marijuana last year, hasn’t consistently paid child support and should not get custody.

Davis’ attorney Julie Ketterman says he is negative for current drug use and Ketterman says Maleah suffered such a traumatic brain injury in 2018 she had to have a portion of her skull removed during the time she, her mom, her brothers and Derion Vince lived with the maternal grandmother.

Attorneys for Bowen described her as a loving caring grandmother who has a stable home and is financially capable of caring for Maleah's 6-year-old brother.

That's something they say Craig Davis is not able to do. Davis was thrown out of the courtroom by the judge Thursday afternoon when he yelled an obscenity at the grandmother's attorney who said he had no idea how to be a dad.

Davis's attorney Julie Ketterman told jurors Bowen knew about Maleah's head injuries and other instances of abuse.

"Both Brittany and Brenda Bowen are still both persons of interest in the criminal investigation," Ketterman said. "So we could be back here sooner rather than later."

An attorney representing the 6-year-old boy and an attorney representing CPS also wanted the grandmother to have custody of Maleah's brother.

Thursday would have been Maleah Davis’ fifth birthday.

To celebrate her life, Craig, the little girl’s biological father, is throwing a party Saturday at 3 p.m. at Sunnyside Park, 3502 Bellfort St.

Anyone who wants to go celebrate Maleah is asked to wear pink and bring lots of bubbles and love. Craig also asked that no one bring balloons because they are not permitted at Houston Public Parks.

He must submit to random drug testing and wear a GPS monitor. The defense argued that was “overkill,” but the judge allowed it.

He must have no contact with Brittany Bowens, the mother of Maleah Davis, or any member of the Davis family, as well as any children under the age of 17. He must submit to random drug testing and wear a GPS monitor. And he must not own a gun.

Derion Marquise Vence, 28, remains at the Harris County Jail in Texas, but as with any defendant, he will have to follow certain conditions if he posts the $90,000 bond in the death of Maleah Davis, 4. He appeared at hearing on Friday, according to Click 2 Houston. The judge approved the state’s requests, including that the defendant–who used to date the victim’s mother–stay away from her Maleah’s family, stay away from kids younger than 17, do random drug tests, and keep on a GPS monitor. In another demand, prosecutors asked that he stay in Harris County and the contiguous counties.

Derion Vence pleaded guilty Thursday to tampering with a corpse and injury to a child -- 4-year-old Maleah Davis -- and was sentenced to 40 years in prison, officials say.

“True justice will not be served until everyone had something to do with her disappearance and murder is brought before a judge and sentenced,” Mendoza said.

Intentional injury to a child, which causes serious injury by act or omission, is a first-degree felony. Vence was sentenced to 40 years in prison for intentional injury to a child and 20 years for tampering with a corpse. He will serve the sentences concurrently.

“Children are the most vulnerable members of our community and young Maleah’s death is tragic,” Ogg is quoted as saying in a news release. “We may never have all the answers in this case and our thoughts are with her family.”

"There will never be enough justice for Maleah. This has been a long two years. It has been very traumatic for me and the family. This could never be my true closure for me because we still dont know what really happened and I think thats something hell take with him to the grave. Its very upsetting and heartbreaking to know we may never know the truth. Charges of injury to a child and tampering with a corpse, do not feel like enough. My daughter was killed. Why?"

Vence was sentenced to 40 years for intentional injury to a child and 20 years for tampering with a corpse. He will serve the sentences concurrently, the district attorney's office said.
