Attorney Neal Hamilton said Monday in Salt Lake City’s 3rd District Court that his office recently received a batch of evidence in the murder case for 32-year-old Ayoola Adisa Ajayi.

Ajayi has not yet entered a plea to aggravated murder, a capital offense and first-degree felony.

During the brief hearing Monday, 3rd District Judge Vernice Trease set another scheduling date for June 29. She similarly postponed a hearing in the case last month after prosecutors said they continued to sift through evidence.

Ajayi wore a yellow jail uniform and glasses Monday, appearing over the video feed from the Salt Lake County Jail. He has been held there since June 28, 2019, and has not yet had a preliminary hearing, meant to determine if the case is strong enough to go to trial.

SALT LAKE CITY — More than a year after prosecutors charged Ayoola Adisa Ajayi with murdering 23-year-old Utah college student Mackenzie Lueck, a judge on Monday set a hearing to decide whether they have enough evidence to go to a trial.

Third District Judge Vernice Trease ordered a three-day preliminary hearing to start Oct. 28, a development that comes after months of delays as attorneys have argued that investigators needed more time to sort through the evidence.

Ajayi is charged with aggravated murder, a capital offense, after prosecutors say he bound Lueck’s hands with zip ties, bludgeoned her and burned her body in June 2019. He could potentially face the death penalty if convicted.

Ajayi has not yet entered pleas to the charges of aggravated murder and aggravated kidnapping, first-degree felonies; desecration of a human body, a second-degree felony; plus obstruction of justice, a third-degree felony.

A 32-year-old U.S. citizen originally from Nigeria, he previously waived his right to a speedy hearing.

On Monday, he wore an orange jail uniform, glasses and a green face mask in the brief hearing held via videoconference from the Salt Lake County Jail. Court dates like Monday’s and the upcoming preliminary hearing are currently being held remotely under coronavirus restrictions in the state court system.

7/13/20 Update: No plea was entered. Waived rights to a speedy trial. A 3-day preliminary hearing is set for 10/28/20.
9/2/20 Update: Third District Judge Vernice Trease on Wednesday granted Ajayi’s request for an interpreter in “substantive” court proceedings like an upcoming preliminary hearing to determine whether prosecutors have enough evidence for a trial. Defense attorney Neal Hamilton argued Ajayi needs translation into his native language, Yoruban, so he can confer with his attorneys on the spot & suggest questions for them to ask in court. Most hearings in Utah are being held remotely amid the pandemic, but Hamilton said he would like Ajayi, the interpreter & defense attorneys to be allowed to appear together in court at the October 28th preliminary hearing. The parties are expected to hash out the details when Ajayi returns to court Sept. 16.

7/13/20 Update: On Monday, Trease also scheduled a separate trial on Dec. 2-3. In that case, he is accused of sexually assaulted a woman during a dinner date at his home in March 2018 after the woman saw news coverage of Lueck’s death, recognized Ajayi and got in touch with police. Ajayi has pleaded not guilty.

Ajayi pleaded guilty to aggravated murder and desecration of a corpse in an agreement with prosecutors that removed the possibility of the death penalty. Prosecutors dropped charges of aggravated kidnapping and obstructing justice.

When they returned to his Salt Lake City home, Ajayi tied her up and began to choke her. She tried to stop him, after which he put a belt around her neck, pushed her onto her stomach and strangled her, the attorney said.

Ajayi then burned her body and buried it in his backyard, Hamilton said. After detectives came to his door to question him, he dug her up and buried her in a shallow grave in a canyon nearly 100 miles (161 kilometers) north of Salt Lake City.

Ajayi also pleaded guilty to sexually abusing another woman he met on a dating app in 2018. They went to his house for dinner, and the abuse happened while they were watching television, he acknowledged. He pleaded guilty to forcible sexual abuse in that case.

As part of the plea agreement, prosecutors dismissed 19 counts of sexual exploitation of a minor related to child *advertiser censored* allegedly discovered on his devices during the investigation into Lueck's death.

Two days later, after searches inside the home and the backyard turned up evidence pointing to McKenzie, detectives tracked Ajayi to a friend’s home.

“How did you know where I am?” he asked them.

“I’m the police,” an officer responded.

During a nine minute phone call, a detective coaxed Ajayi to come outside.

Police knew Ajayi was the last person to see McKenzie.

“What kind of car do you drive?” the detective asked. “We have video of you at the park… I know already that your phones met up there. I want you to explain that.”

Detectives questioned Ajayi over the course of several hours, never losing their focus on the young college student who would never talk to her father again.

“This is 100 percent focused on not you, on McKenzie,” one detective said. “My focus is on her.”

SALT LAKE CITY, Utah – More than 18 months after University of Utah student Mackenzie Lueck was abducted and murdered, we have new insight into the police investigation.

In response to a public records request submitted by KSL TV, the Salt Lake City Police Department released hundreds of documents, photos and videos Wednesday.

Already known was how a dating app and cell phone records initially prompted police to focus on 32-year-old Ayoola Ajayi.

Officials had already released information into Mackenzie’s disappearance and murder. The latest information released gave insight into the investigation in a new way – through the words of the family, detectives and the suspect himself.
 
Detective: "AJ, I just told you that your phone records and the location put you up at the meet. Do you think, honestly, and expect me to believe, that you ended that conversation and somehow you and her and her location end up in the exact same spot?"

Ayoola Ajayi: "Oh, I'm not doubting you. If I see that too if I'm in your case, I would be asking myself what you are asking me right now."

Detective: "It's not a miraculous question."

Ayoola Ajayi: "Yeah, I agree with you. Stuff doesn't just happen."

Detective: "No."

Ayoola Ajayi: "Yes, I agree with you."

Detective: "I'm telling you to explain that. And so far, you have not."

Hundreds of photographs are of evidence markers all over the house and yard. Police took pictures of several items of clothing, some of which appeared to have bleach stains or dirt stains. They take pictures of Ajayi's bathroom sink under blacklight, where splatters show up in the light.

They zero in on a burn pit in Ajayi's backyard. Neighbors told Fox 13 at the time they remembered Ajayi lighting the fire after Lueck disappeared, and that it emitted a strong odor unlike anything they ever smelled.

Photos showed charred pieces of fabric found in the yard and burn pit. Other pictures show a burnt Coach purse and MacKenzie's wallet with her ID visible also burnt.

Pictures of Ajayi's car show stains across the backseat, as well as dirt all over the floor in front of the driver seat.

Along the Jordan River, photos depict a number of female clothing items pulled from out of the water and off the riverbanks. There are pictures of Lueck's University of Utah ID which appeared to have been found on the riverbank near the clothing.

Police piece together surveillance footage, from when MacKenzie landed at the Salt Lake International Airport and got into a Lyft on June 17, to when Ajayi's car and the Lyft driver headed in the same direction near the park in North Salt Lake where Ajayi met Lueck.

"I told Ayoola that he was talking about 'his' information, that he can delete, he can hide as much as he thinks he can. I told him I think he is very skilled in IT and technology, but there was one thing he forgets, and that there is another person that didn't delete their stuff, didn't delete their conversations," Salt Lake police detective Nathan Wiley wrote in his report regarding his interview with Ajayi.

As the warrants were being drafted and signed by a judge, police went to Ajayi's residence to secure the property. Body camera videos from the scene show Ajayi being calm and cooperative. He is seen lying on a small grassy area next to his driveway in the shade, apparently to get out of the heat. Officers explain to him the warrant process and tell him he is free to leave, but he is not allowed to take anything out of his home or his car or his cellphone.

"I can hold the house until the search warrant gets here," an officer tells Ajayi.

Ajayi tells an officer he is going to walk to the library down the street. After he leaves, an officer is heard telling others to keep surveillance on him.

After first requesting his lawyer, Ajayi changed his mind and agreed to be questioned.

At one point, Ajayi, who claimed he suffered from post-traumatic stress disorder and glaucoma, said he was experiencing a shortness of breath. Medical staff evaluated him and determined he was hyperventilating, a report states.

"I told him that we have obtained those records already and that the records that we have show a lot more than what he is telling us," the report states. "I told Ayoola that the records were showing that the conversation continued after the screenshot that he sent to us and it showed that the conversation didn't end after he sent his photo to MacKenzie."

Ajayi said that was not possible.

"'I told him that wasn't true either,'" the detective replied, "'because we have her (MacKenzie's) records as well.' Ayoola started to rock back in forth and take short breaths again," according to the report.

"I again reiterated with Ayoola that the location services on his T-Mobile account to his device are very good, they are very accurate, and that they put him in a not good spot," the report states.

Ajayi tells police several times he is willing to take a lie detector test.

Salt Lake police detective Pat Mount then directly asked Ajayi if he had killed MacKenzie Lueck.

"I can't even kill a fish. When fish die I cry all night," he replied, according to the report.

When asked how then he is able to kill goats in his backyard, Ajayi said, "Because it is for food, because anything that is not food I cannot hurt."

On June 28, as a SWAT team was moving into position around an apartment complex at 1028 S. West Temple where Ajayi was now staying with a friend, the detective in the case called Ajayi and asked him to come out and talk to him, saying he had two cups of coffee waiting in his patrol car. An audio clip of that conversation was released as part of the open records request.
