What I can't figure out is what she is trying to say. He had PTSD on the 5th anniversary of Natalee's death but he didn't kill Stephany? He was set up by a huge conspiracy? So a bunch of people sent Stephany into his room and then beat her to death after he left to set him up? How does this mean that he was suffering PTSD? She makes no sense. Does she think he killed Stephany or not? :waitasec:

The prosecution has rejected the request from the Flores family to charge Joran with robbery followed by murder which would have a maximum penalty of life in prison. They are going with the original charge of murder followed by robbery which has a maximum sentence of 30 years for which he will likely only serve a third...or 10 years. :banghead:

Meanwhile, van der Sloot's lawyer said that he plans to file a motion with the court, requesting his client be set free.

As of early next month, van der Sloot will have spent 18 months in Peruvian prison. Jimenez will argue that under Peruvian law, it is considered excessive imprisonment when a person has been jailed for more than 18 months without having had his day in court.

No date has been set yet on the case.

"The delay is not his fault. We have been acting in good faith. He has been cooperating with the authorities. And they still don't have a translator," said Jimenez.

It will be up to the court to decide whether van der Sloot is freed. Because of the case's complexity, a judge could rule to keep him behind bars. Once Jimenez presents his habeas corpus motion, a panel of judges will meet to interview van der Sloot and make a determination.

Jimenez said he is not hopeful the case against his client will be heard any time soon, given the upcoming court calendar. In Peru, judges are switched out in January and the courts take vacation in February.

I really hope the Flores family can use their influence to make sure this doesn't happen but nothing would surprise me with Joran's teflon luck. :furious:
 
Peru establishes crime of femicide

Following a wave of crime against women, Peru on Tuesday introduced the crime of femicide - the killing of women by men - into its penal code.

Peru is the sixth country in Latin America to include femicide in its penal code. The other countries include Mexico, Guatemala, Chile and Colombia.

The highest profile current case of femicide in Peru is that of Dutchman Joran Van der Sloot, accused of murdering a 21 year-old Peruvian woman in May 2010.

In Session obtained a copy of the indictment. It details what the Prosecution believe happened on the night Flores died.

According to the indictment, on May 30, 2010 Flores arrived at the table where Van der Sloot was playing poker. They talked and played poker until 5:15am, when they left the casino and went to Van der Sloot's room at Hotel Tac. Once in the room, they played online poker ("Full Tilt Poker" and "Poker Starts") until 6:14am. After the game Van der Sloot told Flores about the Natalie Holloway case, which caused Flores to hit him on the head. Van der Sloot reacted by hitting her in the face with his elbow, strangling her with his hands and suffocating her with a shirt. After he killed her he stole 860 Peruvian New Soles (about $318 USD) and various credit cards with the intent to flee. At 7:15am he left the room and returned at 8:24 with two coffee cups. He left the hotel at 8:45am.

Why are Peruvian prosecutors so willing to believe that a small woman struck a 6'4" JVDS while alone with him in his hotel room? Is it just because they have no evidence other than the defendant's testimony?

I think to most of us, the claim that JVDS was the "victim" of the initial violence is patently absurd.

I'm thinking the strategy might be a bit of "jury trial aikido" : since JVS's defense will probably involve his claim that SHE hit him first, provoking his self defense, the prosecution will just go ahead and say "ok, so she hit him first, so WHAT?". It takes the power out of their argument. I kinda think it's brilliant, even if it is not true.

Since pathological narcissists are known to weave elaborate lies from a tiny bit of truth, I tend to believe Joran and his victim may have had some conversation about Natalee. What started it and the nature of it is probably nothing like JVS claims, IMO. My guess is he tried to win her "winnings" unsuccessfully with poker in the room, then he tried to con her, then had to resort to outright robbing her and she said "fu", so he told her he killed Natalee and wouldn't hesitate to kill her too and she gave him her best full-on punch instead of cowering. I hope she gave him hell with everything she had.

Okay, let me get this straight. In Peru, if you rob and then murder someone the max penalty is life in prison. BUT, if you wait until AFTER you kill them to rob them, max penalty is 30 years? Do I have that right?

How can that be?

Oh, that doctor needs professional help herself. She has a VERY warped view of what a "beautiful person" is. He admitted to killing Flores...that alone eliminates even the most remote possibility of him being anything resembling "beautiful". :rolleyes:
 
Ok, I wanna vote that after Joran is found guilty in Peru and serves at least 10 years (if he survives), and AFTER he comes to the U.S. and answers extortion charges here and serves his time, that they release him to Aruba.

Make him persona 'non grata (?) or whatever in the U.S., terrorism alert, whatever it takes to keep him off OUR shores, and Aruba could live with what they created in this sad person. Aruba, IMHO, dodged a LOT during the Holloway fiasco and when he went to Holland, he raised heck there.....Then Tailand, or where-ever it was.........then South America.

Wow!

He's a walking time-bomb.

His attorney better watch out. He may be his next target, ie lawsuit recipient.

Ok, gotta get off this thread. I already know wayyy too much about this guy. I'll watch for his trial in January. Hope it's swift justice. Then he can ride into the highway of prisons, ........

All that has been said so far is all those names have been included in his lawsuit/demand, for allegedly having violated his human rights directly or indirectly.

(CNN) -- The Dutch man suspected in the 2005 disappearance of Natalee Holloway has sued the Chilean government for more than $13 million, alleging his human rights were violated when Chile extradited him last year to Peru to face charges in the death of a Peruvian woman.

"The lawsuit is against the Chilean government, for having violated Joran van der Sloot's basic human rights," his Peruvian lawyer Aldo Cotrina told In Session. The suit was filed September 4 with the Inter-American Commission on Human Rights in Washington....

the lawsuit refers to the apparent typo as evidence that chilean and peruvian officials were violating the dutch man's rights.
