GUILTY AL - Kamille "Cupcake" McKinney, 3, kidnapped from party, Birmingham, 12 Oct 2019 *Arrests, 1 Guilty* #8

In opening statements, the defense contends Brown was not an active participant and that she just “minded her own business.” The defense put the blame on Stallworth and said Brown was on Methamphetamine and was dozed off.

Ummm, if you're hopped on meth, you will NOT be dozing off........ mad emoji

MOO
I watched this hearing once where an FBI woman testified, that when you come off the meth ,it is common for people to sleep a complete 24 hours. She probably mentioned the meth to stress that she was minding her own bussiness and sleeping . because she know they know ,when you come off it you sleep. Sometimes they even do more meth because they would rather not sleep a whole day away, it is insanity I tell ya. moo and all that

Brown was no wallflower here! Brown is a nasty, liar, liar, pants on fire! In her final interview, Brown finally led investigators to the dumpster where to locate Cupcake. She also fed the baby meth. (ME previously testified there was no visible sign of sexual trauma).

Stallworth and Brown were seen sitting in their Toyota Sequoia and, when confronted by a resident, Brown asked where were all the children that used to play on the circle. That woman testified that Brown seemed overly interested in children.

On Tuesday, Federal prosecutors called several more witnesses, including two special agents, who discussed Derick Brown’s timeline based on surveillance videos.

Then we heard testimony from a fourteen-year-old who said Stallworth and Brown talked to her at an area middle school and offered her candy the day Cupcake was kidnapped.

Next on the stand was a woman who testified the defendant and Stallworth were parked in a cul-de-sac outside her residence. She talked about the conversation she had with Brown that day.

[..]

Sgt. Brown with the Birmingham Police Department took to the stand next. She was a homicide detective on the case. She testified to interviewing Derick Brown approximately four times. We saw clips from those videos.

In the interviews the story evolved. The defendant left out details the first time. Her story changed in the video clips we saw in court.

Later on in interviews, Brown tells detectives she saw Cupcake in the car. She later admitted to investigators Cupcake was alive in the apartment. Brown made accusations of a sexual assault she claims to have witnessed inside the apartment.

It was details from Derick Brown that led investigators to the dumpster with the child’s body ten days after she disappeared.

[..]

After that, they took a brief break to prepare the courtroom and called up the next witness, a former special agent with the FBI. Monitors were turned around so no one except for jurors could see pictures shown of Cupcakes body when she was found in the landfill.

[..]

The Government then called up another special agent who specializes in cell phone analysis.

The trial continues Wednesday.

ORDER as to dft Derick Irisha Brown re 85 Motion to Dismiss Counts One and Two of the Indictment and 87 Motion to Quash the Writ of Habeas Corpus Ad Prosequendum; As grounds for her motion to dismiss counts one and two of the indictment, the defendant argues § 1201(a)(1), on its face and as applied in this case, is unconstitutional insofar as it exceeds the scope of Congress' power to regulate commerce. As grounds for her request that the court quash the writ of habeas corpus ad prosequendum, the defendant asserts (1) the federal government does not have a superior interest in prosecuting her that justifies interference with the earlier-instituted state prosecution and (2) she has an interest in resolving the state case first, given the penalty she faces in that proceeding is death. The court DENIES the defendant's motion to dismiss counts one and two of the indictment, 85 , and motion to quash the writ of habeas corpus ad prosequendum, 87 , for the reasons stated further within. Unlike her co-defendant Stallworth, Brown is being tried in the Northern District of AL (Tuscaloosa).

This is crap! Regarding their apt being vandalized and the washer and dryer etc removed. They most likely sold it right along with other stuff they sold for gas/drugs and candy. IMO. Dear Lord!

Interesting that her body was recovered from a landfill. I wonder why they were able to recover her body so quickly?

Wait. Above in the Twitter feed, it stated "landfill". I just double checked, and this article states "dumpster"

They had collected the dumpster from around his apartment block and isolated them in a separate area of the landfill because they thought she might be in there, or one nearby. It was lucky that they hadn't been taken before LE knew to keep them from being emptied. I think they sat there unemptied for a while. This is just from memory, which may be sketchy, but I think it's the gist of it. MOO.

UPDATE: A jury has decided Derick Brown is guilty in the abduction of Kamille "Cupcake" McKinney.

Brown was found guilty on both counts in the kidnapping case.

Brown faces a mandatory life in prison, and she showed no emotion when the verdict was read.

The jury begin its deliberation shortly after at 11:20 a.m. The verdict was reached around 12:40 p.m., after about an hour and 15 minutes.

Jurors were given two options: decide whether brown was a bystander to Stallworth’s plan to kidnap cupcake McKinney, or if she actively participated in the crime.

“Multiple times that she had to stop it, there were plenty of times where she was left alone, and she didn’t,” said Assistant United States Attorney Lloyd Peeples.

According to federal prosecutors, Brown told police only things a kidnapper would know, such as the drugs found in cupcake’s body.

Prior to Thursday’s verdict, attorneys on both sides presented their closing arguments.

Lloyd Peeples, chief of the U.S. Attorney’s Criminal Division, said beyond a reasonable doubt that Brown committed kidnapping and conspiracy of kidnapping.

“This trial is about the defendant and her actions,’’ Peeples said. “She knows the plan. She’s not about to let that little girl get away.”

[...]

“Kamille McKinney didn’t find a hand of safety,’’ Peeples said. “She didn’t find a hand to help her. She certainly didn’t find someone ‘minding their own business.’’'

“She found her kidnappers. She found a hand that covered her nose and mouth,’’ Peeples said. “She found evil. She didn’t find one monster, she found two.”

[...]

“When this defendant was left alone with Cupcake, with Patrick Stallworth at the Chevron gas station for at least 15 minutes, she should have rescued that girl. She did not,’’ he said. “Because of this defendant, she’s gone.”

[...]

Prosecutors presented more than 100 pieces of evidence and more than 20 witnesses during the three-day trial.

“We will never the exact horrors of what happened inside that apartment. But we know the defendant does,’’ Milner said. “We also know the defendant knows exactly what happened to her body. This defendant stripped this little girl of all her humanity. She removed her clothes…took her to that construction dumpster and dumped her in it.”

[...]

There is no joy in this verdict.

Cupcake can never come home, grow up, have boyfriends, get married, be a mom and it goes on and on.

Yes, I’m glad they are both going to pay but I feel an overwhelming sense of sadness.

Our Cupcake never stood a chance against these two monsters.

MOO

WOOHOO, I should have reading down.

YAY, Guilty for Brown too! It won't bring Kamille back and for that I'm truly sorry. Hopefully the family can begin to take one step forward to healing now knowing that these monsters are and will be behind bars where they belong.

It was defendant Brown that actually led investigators to the dumpster where she deposited the child as if she was rubbish (leading to the landfill search quadrant). This was part of Stallworth's defense that Brown and Kamille disappeared one morning from the apartment.
