William Tyrrell's foster mother has failed to have her trial for charges of allegedly stalking or intimidating an 11-year-old girl heard in secret.

It comes as a judge said that the child's fears of 'physical violence, humiliation and punishment' may have been valid.

The foster mother's lawyer John Stratton SC then applied to have her trial for the remaining charges held entirely behind closed doors.

But Magistrate Susan McIntyre dismissed the application on Monday afternoon, find 'it goes beyond the principles of open justice.'

Her Honour also dismissed an application to have the prosecution's tendency evidence thrown out.

The magistrate found that it had 'probative value' in pointing towards the foster mother's guilt.

The 58-year-old woman, who cannot be named for legal reasons, pleaded guilty to two charges of assaulting the girl on Monday.

To protect herself from the law and consequences of her own actions and outbursts.

Someone of this cunning is 100% suspect #1 in disappearing a situation that doesn't benefit her.

I think FM will likely be sentenced with a community services order. I think that is what the initial magistrate said he would sentence, when this case was first heard in court.

I hope so South Aussie.
IMO, the Police will want more than a just Community Service Order, as it clearly showed they charged her but showed no concern for the Child's safety as they wanted more evidence on other matter.
But the Mob with the rope will be waiting for her a the Inquest.

Yes, she had initially plead not guilty to all the charges.
Today her Barrister Stratton told the court she was changing her plea to guilty on the 2 assault charges ….


The foster mother maintained pleas of not guilty to two separate charges of stalking and intimidating the young girl.

The unbiased reality here is the wheels of justice are actually starting to turn.

Maybe Wm did give a final roar. As he fell.

Maybe Wm's last act, an attempt as self-preservation, as a toddler with limited means to protect and defend himself was to BITE. Or kick.

Maybe someone attempted to retrieve a die from his mouth, less than gently, on the high verandah. And what followed was a visceral response to a bite... a kick to the shin....

I don't believe Wm was still playing a game when he ran from the patio. I think he was trying to protect himself from mommy monster and certain corporal punishment of a degree.

Resulting in an unexpected, lethal fall.

I think you will find that it was in regard to the victim, as it seems it was in regard to one of the charges the Prosecutor was speaking about.

Stratton said another matter put forward by prosecutors was his client telling the child that she would speak to someone about “in effect, ending the child’s custody with her”.

He said this occurred after the husband and wife took on another foster child, and a conflict arose because the child believed they were “no longer the centre of the attention, because the attention was going towards this other child”.

Stratton said a comment that the child could be removed from the family’s care, in the context of “household disharmony”, was not violence or a threat of violence. He said none of the matters put forward by the Crown should be permitted as tendency evidence in the case.

I wonder what counselling was given to William’s sister to help her process the raft of emotions that no doubt hit her as a result of the sudden & unexplained loss of her little brother.
I wonder if she blamed herself for not looking after him, big sisters often tend to assume that ‘protector’ role.
or I wonder did she worry that one day she’d suddenly ‘disappear’.

As she matured, imo her mind & her questions ( her hormonal changes too I‘d guess) will have gone to overdrive.

IMO, that young girl could’ve been an emotional wreck - then suddenly her little brother has been replaced in the household by another young child.

Was she jealous of the attention given to the other child ( not an unusual situation to manage with children, tho usually not successfully managed with a wooden spoon in my experience )

Was she concerned for the younger child & whether she may attract the same fate as William.

Whatever the situation, I can’t imagine that threatening to have her removed from the only home she’s pretty much ever known will have done anything but fuel her emotional letdowns. Her whole sense of security has been threatened and left hanging by a thread !

That’s emotional & mental abuse and those responsible should be hanging their heads.

agreed SLouTh, it’s all so very sad. No child should be in such a situation, even if so many are. We do it so badly.

thanks for the article as I read it closer this time & noticed a few interesting things:

The period of said abuse is from 26 January 2021 - 30 June 2021

The offences allegedly occurred at two different Sydney North Shore residences.

There's mention that the 44 min time-out punishment occurred in Nov 2021

Lawyers for the accused lodged an objection at the beginning of the five-day hearing to at least one psychological expert, Dr Banks. .. wonder why .

Well said k-Mac. Why is there a need for talk of Mobs with the rope, hounds baying etc. . Let’s keep this level - where it is & where it should be - people are being judged in a court of law. The Court will decide.

If little sister had even the slightest suspicion, that the fosters were to blame for her little brother's disappearance, then the threat, that she would be expelled from her foster family, might have been something of an acknowledgment. "They wanted to get rid of W and now they want to get rid of me too - we disturb the family harmony (one in 2014 and one now)" - MIGHT she have thought and felt.

My understanding bearbear is that he is charged but he is still pleading 'Not Guilty'.
