Leitch says, either way, even if they go with the defence suggestion about three trips, the three of them are still in the truck here. "The killing of Tim Bosma happens when the three of them are in the truck."
by Adam Carter 11:37 AM

Leitch now talking about Rick Bullman seeing the truck and SUV leaving the field near the Bosma's home around 9:15-9:30.
by Adam Carter 11:38 AM

Leitch says the Crown believes Bosma was dead by 9:20 a.m., because they're in two vehicles afterwards.

Smich turns his phone back on in Oakville just before picking up his girlfriend, morning of May 7

Never heard this, always thought he turned it back on after he charged it back at his mom's.

MOO

"We don't have all the answers, ladies and gentlemen ... you don't need to know exactly how it happened," Leitch says.
by Adam Carter 11:40 AM

Another issue - why does Millard leave his phone on? "He felt that it was safe to leave his own phone on, because the only way they were going to track him was on the burner phone. Millard just never thought they could make that association between the two phones as quickly as they did."
by Adam Carter 11:41 AM

"Why would you take a dead man out on the 403 with the lights and the other cars?" Leitch says.
by Adam Carter 11:42 AM

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Crown says Smich and Millard may have driven by Super Sucker twice because they were unfamiliar with area.

molly hayes ‏@mollyhayes 35s35 seconds ago
Leitch says if Crown's timeline is correct, then #Bosma is dead by 9:20 p.m. "Because they go from 1 truck, the three of them, to 2 trucks."

Susan Clairmont ‏@susanclairmont 1m1 minute ago
If Crown's timeline is correct, #Bosma is dead by 9:20 p.m. because they go from 1 truck to 2 trucks. Took him to Bullmann field and...

Lisa Hepfner ‏@HefCHCHNews 57s58 seconds ago
If the crown's timeline is correct, #Bosma is dead by 9:20pm. It's possible they took him to the field for murder, Leitch says

molly hayes ‏@mollyhayes 52s53 seconds ago
Leitch says they don't have all the answers. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
...something went awry...We don't have all the answers ladies and gentlemen," Leitch tells jury.

molly hayes ‏@mollyhayes 44s44 seconds ago
9:40 pm Millard's phone pings on route to farm. #Bosma

Lisa Hepfner ‏@HefCHCHNews 41s41 seconds ago
We don't have all the answers, Leitch says. They don't have to, they just have to prove both were in on the plan for murder

molly hayes ‏@mollyhayes 1m1 minute ago
Leitch says Millard felt it was "safe" to leave his own phone on, bc it was burner phone police would be tracing. #Bosma

A diesel engine is about 25% more efficient, so in the grand scheme of things it would only save him about $2500 having a diesel, barely the cost of his gun. Not making a huge amount of sense.

That's what I asked ages ago! Tim was murdered for $2500 in gas savings.

He says that the two likely took back roads, not the highway -- which accounts for the ten minute discrepancy before they got to Bobcat of Brantford.
by Adam Carter 11:43 AM

Leitch now talking about the Bobcat of Brantford video that the court has already seen.
by Adam Carter 11:45 AM

Bosma's phone shuts down at 10:01 p.m., Leitch says -- consistent with what we see happening. His phone was thrown out, Leitch says.
by Adam Carter 11:46 AM

Susan Clairmont ‏@susanclairmont 4m4 minutes ago
Millard turned Bates phone off. Left own phone on because he figured cops would track the Bates phone.

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
Millard didn't turn odd his personal phone because he didn't think police would be able to trace him so quickly, Leitch says

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
"Millard never thought they'd be able to make that association between the two phones as quick as they did. And it was pretty quick."

molly hayes ‏@mollyhayes 4m4 minutes ago
It is roughly an 18 minute trip from SuperSuckers to Bobcat of Brantford (on hwy 403). Leitch says Smich says they took back roads. #Bosma

Susan Clairmont ‏@susanclairmont 4m4 minutes ago
Crown believes they took back roads to Brantford. "Why would you take a dead man out on the highway?"

molly hayes ‏@mollyhayes 3m3 minutes ago
Leitch says back roads make a lot more sense--you don't take a dead man on the highway, with all the passing cars and lights. #Bosma

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
That can account for longer trip to Brantford, according to Brantford video.

molly hayes ‏@mollyhayes 3m3 minutes ago
It takes them 27 minutes to get to Bobcat of Brantford. #Bosma

Lisa Hepfner ‏@HefCHCHNews 3m3 minutes ago
Smich says they took back roads to Brantford, arr 27 minutes later. Makes sense, Leitch says. Video of vehicles there & #Bosma phone found.

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
Smich testified shooting happened in Brantford. Crown says no. Makes sense #Bosma's phone was taken off him there, thrown out of car.

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
Unlike defence closings, Leitch admits to jury several times that Crown doesn't know everything. But offers logical, strong possibilities.

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
9:48 pm #Bosma truck pulls up to Bobcat of Brantford, followed by Yukon. Smich admitted that was them.

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Crown accepts two vehicles in Brantford video are Yukon and Bosma truck. See Bosma phone shuts down at 10:01 p.m., fits with Brantford stop.

molly hayes ‏@mollyhayes 2m2 minutes ago
Tim #Bosma's phone was shut down at 10:01 p.m. Which Leitch says is "completely consistent" with stop in Brantford.

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
#TimBosma phone is shut down at 10:01pm. They realized it was on and they needed to shut it down so they can't be tracked.

molly hayes ‏@mollyhayes 1m1 minute ago
Leitch tells the jury to look carefully at these videos. "There's no flashlight," Leitch says (as Smich claimed). #Bosma

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Leitch on videos: "Look at them very carefully." Says no flashlight in the frames, contradicting Smich testimony of changing plates.

Lisa Hepfner ‏@HefCHCHNews 37s37 seconds ago
You can see the back of the vehicles in the BobCat video, Leitch says. No sign of a flashlight or Smich changing plates, as he testified

That's what I asked ages ago! Tim was murdered for $2500 in gas savings.

It's not about the money saved. Bet the coolest folks at the Baja towed their vehicles with diesel trucks, and DM wanted to be one of the coolest.

MOO

Leitch says there's no flashlight in these images, debunking Smich's story about swapping the plates at that time. "You would see the flashlight. There's no flashlight."
by Adam Carter 11:47 AM

Millard at 11:34 p.m. texts Noudga "gonna be an all nighter." Leitch says that's because Tim Bosma is dead by then.

Photos of Millardair hangar. Video at hangar, showing trucks arriving at 12:19 a.m. May 7, towing Eliminator.

Susan Clairmont ‏@susanclairmont now
Smich testified Bosma put in Eliminator at farm. Crown disputes that.

This is has been a sticking point for me for a long time too. If they were really just psychopaths, then they would have had no problem with going back and eliminating witnesses. Especially if leaving no witnesses alive was part of the plan, as the crown is asserting, leaving 2 good witnesses doesn't make sense.

There is a difference between a witness that meets you briefly and one that sits next to you in a truck ...with the ability to spot things like tattoos

Lisa Hepfner ‏@HefCHCHNews 37s37 seconds ago
12:19am the Bosma truck arrives at hangar, towing the incinerator. Leitch says they picked it up from the farm first

12:42 a.m. Yukon leaves hangar. "This has become an important piece of evidence," says Crown. Yukon gone for 30 minutes.

molly hayes ‏@mollyhayes 43s44 seconds ago
The Yukon leaves the hangar for 30 mins. Leitch says Smich says MIllard left for gas, and the Millard says he left to get away from Smich.

molly hayes ‏@mollyhayes 39s39 seconds ago
Leitch suggests it could be both of them leaving. #Bosma

Susan Clairmont ‏@susanclairmont 28s28 seconds ago
Smich said Millard went to get gas. Millard team said Millard going to cool off, angry with Smich for killing Bosma.

molly hayes ‏@mollyhayes 36s36 seconds ago
At 1:12, Yukon returns. At 1:33 am we see them on camera walking through the hangar w Pedo (Millard's dog). #Bosma

Lisa Hepfner ‏@HefCHCHNews 35s35 seconds ago
Yukon then leaves hangar for half an hour. Jury has heard two different stories why. Leitch says it could be both Millard & Smich leaving

Susan Clairmont ‏@susanclairmont 49s49 seconds ago
Crown says maybe they both left for 30 minutes. Tim was dead, so didn't need to stay with him.

Susan Clairmont ‏@susanclairmont 35s35 seconds ago
Now infamous video of Smich and Millard (and Pedo) inside hangar at 1:33 a.m.

molly hayes ‏@mollyhayes 26s26 seconds ago

I know it has to be said and it's important to be said, but I really hope this is the last time the Bosma family ever has to hear it said so matter-of-factly like this ever again. :(

molly hayes ‏@mollyhayes 52s53 seconds ago

8:29 a.m. text Millard to Noudga: "Stage 1 complete, taking a respite." Again, Crown calls him "cavalier" and "pretty matter of fact."

Lisa Hepfner ‏@HefCHCHNews 21s22 seconds ago
8:29am Millard to Noudga, "stage 1 complete, taking a respite." Seems matter of fact, cavalier, Leitch says

Especially if leaving no witnesses alive was part of the plan, as the crown is asserting, leaving 2 good witnesses doesn't make sense.

If they were just two psychopaths why bother tying in a truck theft and lots of extra witlessness's???? How about one psychopath using the truck excuse?

Leitch again points out that Millard and Smich were "celebrating" when they picked up Meneses.
by Adam Carter 12:01 PM

"Stage one complete, taking a respite" Millard texted to Noudga at 8:29 a.m. on May 7. "This is the man who according to his counsel's address is surprised by a shooting and is obligated to help Mark ... seems pretty matter of fact."
by Adam Carter 12:02 PM

"Had a nice five hour nap & bath, refreshed and ready for the next stage of mission digestion." Millard texted Noudga. "That's Dellen Millard after this murder," Leitch says. "This isn't the guy who is upset in the aftermath of some accidental shooting."
