Deceased/Not Found CA - Kristin Smart, 19, San Luis Obispo, 5/25/1996 *Guilty* #4

Wow! just wow!

So am not saying this might happen (am not a glass half full person) but...

what if, from this "near death experience" he has a kinda epiphany and decides he must reveal where Kristin is, or...

what if, Susan gets an epiphany from her son almost dying that gives her a feeling that makes her suddenly realise she feels how the Smarts must've felt and is compelled to tell...

of course a basis of normal empathy would be needed and I've not seen a modicum of that from any of the Floreses....we can but hope

Paul Flores was relocated to Pleasant Valley State Prison in Coalinga last week. This morning, he was admitted to general population for the first time. Less than an hour later, another inmate slit his throat. I have no details about what led to this incident.

Paul reportedly experienced substantial blood loss as the result of multiple severe lacerations to his neck, and was airlifted to a trauma center in Fresno where he was stabilized but remains in serious condition.

I know that this news will stir up very strong emotions. Please keep your comments here civil. Feel free to share your unrestrained thoughts and feelings by sharing this post to your own stories.

Thank you

Wow. Just wow!

I would assume they knew he was coming and who he is. Either that, or (equally believable) he's just that obnoxious. I wonder if he pulled out Arrogant Paul with his new friends and they just weren't having it.

Crazy story.

IMO.

Yeah, with their (the whole family) behavior over the past 27 years, I think we can safely rule out getting a conscience and divulging Kristin's whereabouts.

The only way I see that happening is offering PF a sentence reduction in exchange for her remains.

Its also possible PF is a punk and it showed up immediately.

I was recently reminded of a case in SC where two inmates lured four men to their cells to be brutally murdered using promises of cookies and drugs. One of the inmates said in an interview with the Associated Press (AP) that the pair (serving life) made the pact in order to get the death penalty. He also said they had nothing against the murdered men, one was even a friend. "They, they trusted us. We talked to these people every day. One of them was a friend of both of ours. And they just trusted us. We come up with something for each one."

In other words, sometimes it's just about a means to an end by the selfish exerting their power.

Inmates used drugs to lure fellow prisoners and then kill them 'to get on death row'

Wow, that was a super disturbing read. They have 8 murders now between them…

Kind of long since I last posted this... will shorten it up a bit now. :)

2/28/23 Update: Defense attorney filed a set of motions seeking to throw out Flores' guilty verdict. One of the motions filed by attorney Robert Sanger requests an acquittal & dismissal of charges (filed 2/24/23) for the 2nd time, "on the grounds that a rational trier of fact could not find the defendant guilty beyond a reasonable doubt based on the State of the evidence at the conclusion of the trial." Another requests a new trial, claiming "prosecutorial errors & the admission of junk science as evidence." and that there was insufficient evidence to find Flores guilty. The motion also claims the verdict "was based on a violation of the defendant's constitutional rights to due process & a fair trial." Defense was already denied this same motion on 10/5/22. In the court filing, which was submitted to the Monterey County Superior Court on Friday, 2/24/23. The court filings request that the motions be heard at 9am on Friday, 3/10/23. 3/6/23: State files motion to deny new trial for Flores. 3/8/23: Judge O'Keefe has approved the media's request to film Flores' sentencing. The Motion for new trial will not be filmed. Braodcast will not be live. Sentencing scheduled on 3/10/23 after motions hearing.
3/10/23 Update: Monterey County Superior Court Judge Jennifer O’Keefe on Friday denied a motion seeking an acquittal/new trial for Flores. Judge sentences Flores to 25 years to life in prison with no probation. He will be eligible for parole. With time served & good behavior he’s eligible for a parole board hearing in about 15 years. The parole could grant or deny paroled release at that time. Probation is governed by the county & can allow custody credit programs to decrease sentences. Parole is governed by the state & a minimum sentence must be served. Paul was under 25 at the time he killed Kristin, so despite life without parole being the max sentence for 1st degree murder, CA’s young offender law doesn’t allow him to get more than 25 to life with parole. Violent crimes in CA are 1/3 custody credit for good behavior. So if Paul has good behavior in prison, his sentence is around 17 years. He’s already served around 2, so he will be eligible for a parole board hearing in 15 years. Flores is also required to register as a sex offender for the rest of his life.
4/10/23 Update: A notice of appeal was filed with Monterey County Superior Court on April 10, 2023 by Flores' attorney, Robert Sanger. Sanger represented Flores throughout his lengthy preliminary hearing in 2021 & then months-long jury trial in 2022 in Monterey County. The recently-filed documents request that a court appointed attorney be assigned to Flores for his appeal. The Court of Appeal, Sixth Appellate District, confirmed that it has received the pending appeal.
8/2/23 Update: Paul Flores is expected back in court next month where a hearing is set to discuss a change of counsel for the man convicted of murdering Kristin Smart. With Robert Sanger, who represented Flores since before his 2021 preliminary hearing, now reportedly off the case, at least temporarily, Flores is requesting new counsel represent him and the attorney is no stranger to the case. Harold Mesick said that Flores has requested him as substitute counsel for the restitution portion of the Kristin Smart case. The hearing would only relate to new counsel being appointed. A hearing on the determination of restitution would take place at a later date.
8/23/23 Update: According to attorney Harold Mesick, Paul Flores was taken to a hospital after being attacked in Pleasant Valley State Prison. He was stabbed in the neck or his throat was cut. Corrections officials transferred Flores from a prison in Kern County to the North Kern State Prison in Coalinga last week. It is unclear the exact date Flores moved to Pleasant Valley State Prison. The Fresno County facility provides long-term housing for inmates of all custody levels. This morning, he was admitted to general population for the first time. Less than an hour later, another inmate slit his throat. Was airlifted to a trauma center in Fresno where he was stabilized but remains in serious condition. 8/24/23 Update: Seems Flores upgraded from 'serious' to ''fair condition as of Thursday morning. 8/25/23 Update: A spokesperson with the California Dept. of Corrections & Rehabilitation says Flores returned to the prison in Coalinga Friday morning.
9/7/23 Update: Flores missed Thursday's court appearance where he was expected to request attorney Harold Mesick represent him for the restitution phase of his case. The hearing was postponed to 9/28/23.
*Ruben Ricardo Flores (55 @ time of crime/80/now 82) - Found not guilty of accessory after the fact on 10/14/22.

Sept. 29, 2023
Paul and Ruben Flores were back before a Monterey County Superior Court judge Thursday.

Chris Peuvrelle, the prosecutor for the Kristin Smart murder trial, and Judge Jennifer O'Keefe were in the courtroom Thursday morning.

Appearing remotely were DA investigator JT Camp and some Smart family members along with Ruben and attorney Harold Mesick. Paul was requesting Mesick represent him during the restitution portion of his case.

Since Mesick represented Ruben during the lengthy trial last year, both father and son had to wave conflict of interest, which was done before Judge O'Keefe Thursday and approved.
[.....]
A separate hearing for the restitution determination was set for Nov. 16.

I can not access this article - can someone give a 10% synopsis on this? TIA! :)
The man suspected of attacking Paul Flores murdered his cell mate 2 years ago - the cell mate was a convicted serial killer, Roger Kibbe. The suspect is Jason Budrow, who has convictions for murdering his girlfriend and sexually assaulting a teenage girl.
