Man Charged in Malibu Campground Slaying Ordered Out of Court After Outburst

Mar. 16, 2022

A man charged in the killing of a research scientist from Irvine, who was shot while camping with his two young daughters in Malibu Creek State Park, was ordered out of court Wednesday after an obscenity-laden outburst.

Superior Court Judge Charlaine Olmedo told Anthony Rauda before he was removed from the hearing that he did not have the authority to file motions on his own behalf, including a request for a change of venue in the trial, because he has a defense attorney and is not representing himself.

"The court will not entertain any of those motions at this time,'' the judge said.
[.....]
The judge ordered Rauda to be removed from the downtown Los Angeles courtroom by bailiffs after a verbal outburst that continued as he was wheeled out in a restraint chair with a spit shield over his head -- both of which he was in when he was brought into court. She had noted earlier in the hearing that he was being restrained due to "unpredictably violent behavior.''
[.....]
After he was taken out of the courtroom, a May 3 pretrial hearing was set.

11/29/21 Update: Rauda was found mentally competent Monday to stand trial. Criminal proceedings were suspended after a doubt was declared in October 2020 about his mental competence, but ordered to be reinstated following the determination that he was competent. Rauda is due back for a pretrial conference/trial setting hearing 1/24/22.
1/24/22 Update: Next pretrial conference/trial setting hearing on 3/16/22. 3/16/22 Update: Rauda was ordered out of court Wednesday after an obscenity-laden outburst. Superior Court Judge Charlaine Olmedo told Anthony Rauda before he was removed from the hearing that he did not have the authority to file motions on his own behalf, including a request for a change of venue in the trial, because he has a defense attorney & is not representing himself. "The court will not entertain any of those motions at this time," the judge said. The judge ordered Rauda to be removed from the downtown Los Angeles courtroom by bailiffs after a verbal outburst that continued as he was wheeled out in a restraint chair with a spit shield over his head-both of which he was in when he was brought into court. She had noted earlier in the hearing that he was being restrained due to "unpredictably violent behavior. After he was taken out of the courtroom, a 5/3/22 pretrial hearing was set. Also trial setting hearing was rescheduled on 5/3/22.
3/24/22 Update: Rauda was ordered Thursday to stand trial for allegedly attacking two sheriff's deputies since he has been in custody. Superior Court Judge Mark S. Arnold said he found "more than sufficient evidence" to require Rauda to stand trial on two felony counts of battery on a peace officer. The charges involve a L.A. County sheriff's deputy who was allegedly punched in the jaw & suffered a wrist injury after a March 30, 2020, hearing at the downtown Los Angeles courthouse & a sheriff's deputy who was allegedly attacked with a pencil at Men's Central Jail while Rauda was being removed from a restraint chair following a hearing last week in which he was ordered to be removed from court after an obscenity-laden outburst. Both of the alleged attacks were captured on surveillance video, which was shown in court. The judge rejected a request by defense attorney Kevin Avery to dismiss the charges against Rauda or to reduce them to misdemeanor counts. Rauda is set to go on trial in September for the murder.
4/7/22 Update: Rauda was back in court this week to face unrelated charges stemming from violent attacks on two deputies. Rauda arrived in Los Angeles Superior Court on Thursday & pleaded not guilty to two felony counts of battery on a peace officer stemming from two separate attacks on Los Angeles County sheriff's deputies in March 2020 & last month. Despite having been in jail for nearly four years, Rauda, a career criminal, has managed to rack up additional charges while in custody & earn himself a reputation as a violent inmate, leading to the use of a restraint chair & occasionally a spit hood, during his court appearances. At a subsequent probable cause hearing on March 24, another judge found 'more than sufficient evidence' to order Rauda to stand trial for the alleged attacks on the deputies & refused to downgrade the felony battery charges against him to misdemeanors. On Thursday, Judge David Fields ordered Rauda back in court on 5/3/22 for a pre-trial hearing.

@gitana1 - was wondering if you were able to find Rauda's case # for the 2 felony counts of battery on LE?

TIA! :)

Well - since I didn't have a case # for his battery on 2 LE - I didn't know he was having a trial on this already....

June 9, 2022

A jury in downtown LA convicted a man of attacking two deputies while awaiting trial for the murder of a father shot to death while camping with his daughters at Malibu Creek State Park.

Anthony Rauda, 46, was not in court when the verdict was read Thursday afternoon in downtown LA.

The jurors also found true an aggravating factor on one of the counts: that Rauda is a danger to society. That finding can affect sentencing.
[.....]
The jury Thursday returned guilty verdicts on two counts of battery on a peace officer for two incidents that happened inside the courthouse lockup following his arrest in the murder case.

One happened in March 2020 when Rauda was accused of punching a deputy in the jaw and wrenching the deputy’s wrist.

The second was in 2021 when Rauda was accused of attacking a deputy with a pencil, after Rauda was removed from a hearing for an outburst.

@gitana1 - I was wondering if you could find a case # for the battery charges, so I can find out when he will be sentenced for this. TIA! :)
