Would this have happened if SP wasn't a pretty, young white woman? Honest question.

Sickening IMO after all the wasted resources, $$$, and the psychological damage she did to her husband and children.

The problem with this type of mental illness (narcissism & psychopathy) is there isn’t a cure. She was a Mother of babies when she pulled all this very theatrical behavior so I would be very concerned going forward. What prevents her from doing something else?

The time served seems out of balance to the crime. Real people are really missing that deserve time and resources.

While SP's treatment in the criminal justice system is indeed questionable, I find her early release very perplexing.

SP was ultimately charged with Count 3, Mail Fraud, and Count 35, Making False Statements. (Counts 1-2 and 4-34, Mail Fraud were dismissed).

Although SP caused innocent individuals to become targets of a criminal investigation and left the public in fear of her alleged Hispanic capturers who purportedly remained at large, she was not charged with a federal hate crime.

Similarly, SP was not fined or charged under Title 18 of the United States Code for knowingly and willfully making false statements or representations of a material fact to apply for Social Security Disability benefits under this title, after receiving benefits in excess of $127K for falsely claiming to have been kidnapped.

SP was also not charged for committing fraud against CalVCB after claiming benefits in excess of $30K.

On April 12, 2022, SP entered into a plea agreement that cited her Criminal History Category as I, and Offense Level calculation at 11 or Zone B (i.e., 8-14 months imprisonment pursuant to the Federal Sentencing Guidelines). However, the plea agreement further provided:

The defendant understands that the Court must consult the Federal Sentencing Guidelines and
must take them into account when determining a final sentence. The defendant understands that the Court will determine a non-binding and advisory guideline sentencing range for this case pursuant to the Sentencing Guidelines and must take them into account when determining a final sentence. The defendant further understands that the Court will consider whether there is a basis for departure from the guideline sentencing range (either above or below the guideline sentencing range) because there exists an aggravating or mitigating circumstance of a kind, or to a degree, not adequately taken into consideration by the Sentencing Commission in formulating the Guidelines. The defendant further understands that the Court, after consultation and consideration of the Sentencing Guidelines, must impose a sentence that is reasonable in light of the factors set forth in 18 U.S.C. § 3553(a).


B. Violations of Supervised Release.

The defendant understands that if she violates a condition of supervised release at any time
during the term of supervised release, the Court may revoke the term of supervised release and require the defendant to serve up to three additional years imprisonment.


On Sept 19, 2022, sentencing proceedings were held before Senior Judge William B. Shubb, and for Counts 3 and 35, SP was sentenced to serve 18 months imprisonment, both counts served concurrently for a total of 18 months, with a recommendation of a facility in CA, and 36 months supervised release. SP was given a surrender date of 11/08/22 by 2:00 p.m. (See Docket #54).

Under federal statute, an 18-month sentence translates to 15.3 months imprisonment or 85% of the sentence (i.e., estimated release date Feb 29, 2024).

IMO, the Court took both the 8-14 months plea agreement Federal Guideline Sentence calculation and the Government's recommendation for an 8-month sentence into account (See Fed Docket #43) but returned with a sentence of 18 months because the proposed sentences did not fully and fairly account for all relevant factors. I'm disappointed that the probation department interfered with the Court's sentence whereby SP will ultimately be fully released four months before the date imposed by the Court.

SP's Presentence Investigation Report (PSR)--amended multiple times, was sealed from public view. IMO, it seems to me that SP learned the system before entering and/or was subjected to the US Probation Office interviews, or began working with her BOP case manager immediately upon entry! I'm reminded that SP also successfully tricked her therapist into believing that she was a kidnap victim. (See Federal Docket entries 38-42).

And... once again, SP is going to be taking federal assistance dollars in the re-entry program for employment counseling, job placement, financial management assistance, and other programs and services that help inmates gradually rebuild their ties to the community.

What are the odds SP won't violate the terms of 36 months of Supervised Release?

Per the details outlined above, IMO, I doubt a woman who was not young, photogenic, and white would have fared as SP did here. For example, 31-year-old, unattractive, addict, Kayla Montgomery was facing 5 years imprisonment for obtaining $1500 in food/Snap benefits when Harmony was no longer alive. And the real or imaginary, Hispanic woman would still be sitting in jail, without bond release, awaiting trial after being assigned four different public defenders in two years. JMO

OT, Don’t let this derail the thread, but if you want to get reeeeeaaaalllly angry, read about the case of Marci Kitchen, driving drunk, who struck and killed her own daughter and her friend, fled the scene and attempted to cover up what she had done. This case still infuriates me, seven years later.


Sentenced to eight years, she was out in less than two, partly due to the pandemic.


She was well-connected to attorneys (boyfriend’s father) and worked the system continually even before her trial. She was attractive, well-liked and considered a “good Mom” in the community, so I expect that this “one mistake” won’t count against her among her friends and those in the parole system she manages to con, like Papini will.

Back to Papini. I do think she has the potential to be a danger to her children. IMO Early release will just play into Papini’s sense of entitlement and “specialness.” Any constraints/requirements placed upon her will be viewed as unfair and add to her sense of victimhood. She is likely go blame her ex-husband and attempt to hurt him through the children IMO. She has shown a total willingness to hurt those close to her, dating back to lies about her parents even before marriage. I’m not sure that whatever her diagnosis is can be overcome enough to guarantee her children’s safety in her presence. She may not have a history of harming others physically, but escalation happens and there’s always a first time.

I follow mostly Federal Court cases where outside of the court system, it's near impossible to accurately estimate the potential sentence for a convicted defendant. However, it's highly unusual for the Court's final sentence to be overruled -- especially when the imprisonment term exceeded both the range per the plea agreement and the recommendation by the Government.

Unlike State Courts where the penalty range for any offense is established by the state legislation, providing for immediate sentencing upon conviction, federal penalties are based on a federal guideline calculation prepared by the Judge, using the "Criminal History Category," "Base Offense Level," and other + - enhancement/behavior adjustments to determine the full sentence.

Typically, federal sentencing takes place about ninety days after a guilty plea or guilty verdict to allow the Court sufficient time to reference the statutory Presentence Investigation Report (PSR) by the US Probation Office and calculate the sentence per the applicable guidelines range.

In the case of SP who entered a plea agreement fairly early (April 2022) but was not sentenced until September 2022, I also noticed several amendments to the sealed PSR-- a sentencing component by the US Probation Office.

Since SP's PSR as amended is sealed, all we can do is speculate about what conditions were cited where SP might enter community confinement early. In other words, except for (private) health reasons, it's highly unusual for the Court's final sentence to be revised.

I'm curious how SP fared during incarceration. IMO, I think early release is most likely where a bed became available in August for the final phase of the inmate's behavioral treatment/rehab.

Unfortunately, I also don't think we've heard the last of SP. MOO

i dont understand why those children were not taken from Josh -----

He did not have custody of the children and was allowed supervised visitation. However, two things occurred here: 1) JP locked the social worker out of his house, and 2) Social workers tasked with protecting the children of Josh Powell did not consult with law enforcement before allowing him to host supervised visits at his home.

Social Workers faulted on young sons' visits

Keith has already won a series of legal battles in the divorce – including having his ex-wife declared an 'unfit parent' and gaining sole legal and physical custody of Tyler and Violet.

Papini is allowed only supervised visits with the children which take place at a court building in Redding and voice and video calls at Keith's discretion.


He also saw off an attempt by Papini earlier this year to overturn a postnuptial agreement signed in 2012 that agreed both would keep their own separate property and would waive the right to make any demand on the other.

From her cell at Victorville in April this year, Papini told court she had been 'coerced' into signing it – claiming she had suffered a 'violent relationship' with Keith, despite having no witnesses to corroborate it.

But in a ruling made at the start of May, Judge Summer Ryan said Papini was not a credible witness, enforced the postnuptial agreement and ordered her to pay her own credit card bill – a ruling that she is still contesting and will take to trial later this month.
