GUILTY MN - Samantha, 15, & Gianna Rucki, 13, Lakeville, 19 April 2013

Sandra Grazzini Rucki posted bail ($100,000). I keep wondering if she will appeal.

Hard telling. Seems like the whole crew--attorneys and supporters are about half crazy. Choices defy logic.

Here's the sentence:
http://www.kare11.com/news/mom-who-hid-daughters-gets-6-years-probation/323068089

34 days in jail now. 15 days each year until 2022. 6 years probation. So, she'll be out and about most of the time. I just don't see how that's going to work.

I believe that she is restrained from any contact with the children. This article includes the father's victim statment: http://missinginminnesota.com/author/mbrodkorb/

The judge certainly applied some creativity in sentencing. There are 2 fines of $900 something--to match the number of days the girls were missing. And the 15 days each year begin on the anniversary of the date that they were found.

I don't know if there's a cure for what ails her (Sandra), but I would have like to have seen some treatment required as well.

Trial for Dede Evavold begins next week--and I believe she will be representing herself. The Dahlens go to trial in January and February. Meanwhile, Michelle McDonald is on the ballot for judge again--despite popular opinion that she should be disbarred.

IMO--it's frightening the number of truly wackadoodle people are running around and put themselves on the wrong side of some really heart-wrenching cases like this one.

So, she has chosen to serve all the sentence at once - could be out in 5 months. Restitution of $944 per child, plus $10,000 to MN Crime Victims. No contact with children.

Since for two years, SGR had no contact with her children, I doubt she cares about the no contact. The money? Seems minimal. 5 months? Definitely not enough!

Heartening to see that she will have to pay for counseling and repay the Minnesota Victim's fund for reunification services.

Also seems as though the Judge has to approve her request? Frankly, I hope not. I sorta liked the annual reminder of what she did.

Next (January?) comes the Dahlens. IMO they are as guilty as SG-R. Sure would like to get inside their minds as to why they did this with no thoughts of getting caught. Pretty brazen.

Yes. And Dede Evavold will be in court, representing herself, next week.

I've been following blog/twitter from Michael Brodkorb, a journalist who has been following this case very closely. SGR (through attorney Michelle McDonald) requested a restraining order against him to try to eliminate his coverage. Apparently SOP is for the court to put the restraining order in place immediately on request and then set a hearing--provides immediate protection for people in imminent danger. The hearing was yesterday and he had his opportunity to present himself as a journalist and counter SGR's claims. Judge has it under advisement now.

But, the truly interesting part is that Michelle McDonald presented a stack of "evidence" including recent emails between Evavold and SGR about Brodkorb's coverage. He suggests that this may have been a violation of Evavold's conditions of release. Not good for her.

You may recall that when 20/20 did its piece on this case, McDonald provided the crew with boxes of "evidence" in response to their query about any substantiation (police reports, medical reports, etc) of the physical abuse that was being claimed. Turning over files to the press is certainly an odd legal behavior. But 20/20 provided staff to sift through all of the boxes, and came up empty when it came to any of the evidence that SGR told them existed. All of which is to say that Michelle McDonald strikes me as being wackadoodle in the extreme--someone who probably shouldn't even be practicing law (and I believe that there are some ongoing complaints/investigations based on her courtroom behavior). I believe that she also remains a person of interest in the Rucki girls' disappearance.

Really glad the girls are now safe and that the siblings can move forward.

McDonald is again on the ballot for MN Supreme Court. Please exercise your vote in the correct way.

Today's news - Judge dropped restraining order against Brodkorp.

Apparently Evavold presented no defense. Questioned nor cross-examined no witnesses.

Witnesses called by the prosecution include arresting officers, Dahlens, the oldest Rucki girl, as well as a police investigator who interviewed her while the girls were missing and she claimed no knowledge.

Jury is now out.

I cannot imagine they will take long to arrive at their verdict.

The verdict probably won't take long, but what sentence will she receive? Hopefully, not more time than S G-R.

Update SG-R jail time request denied by judge. She will serve 8 months, then 15 days per year for the next 6 years. Can she appeal this? I don't know the legality.

I missed this until just now. What interests me is both that her attorney says she has no intention of abiding by probation and that she gets out next week.

I have been following Michael Brodkorb's blog. According to him, Stephen Grigsby (the criminal attorney) is out. SG-R's protection order against Brodkorb was tossed on procedural issues (SG-R used Michelle McDonald's office address as her place of residence in order to be heard outside of Dakota Country), but apparently McDonald has suggested that they will be filing again next week when Sandra gets out.

SG-R makes the news again. Apparently, Dakota County didn't inform about SG-R's release until 4 hours after she was out.

AND, whoa on this one: "In an interview this morning, a member of the Rucki family expressed concerned for their safety based on Grazzini-Rucki’s past behavior, and also because of comments made by Grazzini-Rucki’s attorney which forewarned trouble ahead from Grazzini-Rucki."

Isn't it time for a mental evaluation?

BBM

Reading through the probation order, it would appear as though she has already had one (is this required of prisoners?) as she is required to authorize release of results to any state or federal programs.

S G-Rucki has violated probation, and there is a warrant for her arrest.

http://kstp.com/news/sandra-grazzini-rucki-arrest-warrant-probation-sentence-lakeville/4308828/

And Dede Evavold--convicted of six counts of interference with custody, and awaiting sentencing, has apparently been threatening officials from jail. http://missinginminnesota.com/dede-evavold-threatens-public-officials-dakota-county-jail/

These two, together with attorney Michelle McDonald, who apparently has some issues of her own, come perilously close to the textbook definition of a public menace. IJS
