The prosecution earlier indicated it would drop "death specifications" if Wagner IV's mother Angela Wagner and brother Edward "Jake" Wagner" followed through with a deal they struck with the state in 2021, when both switched their pleas to guilty in the case. 2/8
Under the deal, the state agreed to drop the death penalty for them, Wagner IV and his father, George "Billy" Wagner III, if they testified in the trials of Wagner IV and III. The elder Wagner will be tried next year. 3/8
To take death penalty off the table, the state asked Deering to dismiss three specifications in all eight aggravated murder charges against Wagner IV. Deering granted the request. 4/8
"I want to make it clear this is not a merit-based decision," Special Prosecutor Angela Canepa said in agreeing to modify the charges. 5/8
Wagner IV's lead defense attorney, John P. Parker, asked the court to resolve the matter this morning as both sets of attorneys prepare closing statements to deliver this coming Monday and Tuesday. The jury will learn about the decision before the statements begin. 6/8
With the jury on a holiday week break, lawyers met with Deering in court this morning to consider eight motions from Wagner IV's attorneys related to jury instructions. They filed one in January, five on Monday and two more today. Deering denied six, leaving two to go. 7/8
The prosecution objected to the motions, saying Deering's 150-page draft of jury instructions covered most everything already, in compliance with guidelines from the Ohio Judicial Conference's jury instructions committee. 8/8
