According to Jake, Billy was the first to mention killing of the Rhodens.

At one point, Jake said, "I had decided … I had no other choice than to kill Hanna."

But Jake testified he was not the one who initially felt that way, saying, "My father first mentioned it to me."

Jake said he initially “had a suggestion,” which was to kill Hanna and make it look like her then-boyfriend Corey Holdren “had done it” to make it look like a suicide.

Too late. Judge Hein already officially sentenced her and Jake. It's up in the air as to whether they have to testify against Billy now. That's why the prosecution, the victims families and all of us are upset with Judge Hein. He also took the DP off the table for Billy. In spite of all that "persuasion" by the new Judge, Billy still insists on going to trial. The problem is that the state may not be able to make Angie or Jake testify against him. They'll have to make the case on their own, in another county.

Judge Hein claims he made all these changes to get the trial over with quicker or to force Billy to sign a plea deal. He handed out a lot of favors, but Billy still insists on going to trial. Whatever plea deal Hein offered for Billy (details aren't public) prosecution thought it was too generous and presented a burden to the surviving family members. My guess is that Hein's deal for Billy was a rather short sentence with parole. It was lenient enough that Angela Canepa appealed to have the judge removed from the case.

I am absolutely dumfounded. I was checking to see if Billy's trial had a date yet and stumble on this mess. I sure didn't think Billy's mom still had this kind of power and if not her than someone needs to check on this judge's mental statis, This is crazy. Guess when Jake gets out, he can now kill for jesus. Dayum what is wrong with this judge?

I get the impression that much down there in Pike County, etc. depends on who you are and who you know. JMO

Thanks for this article. The judge did rule for a change of venue even though the article says all attempts have been denied. He did then say he would have discussion on the 21st to consider the victims arguments against the change of venue or something along those lines.

The defense still has not filed their motion to sever certain charges about 1 1/2 months overdue at this point. In the last pretrial verbally it was stated they would have it done in two weeks. Maybe they got an extension from the judge.

1/17/25 Docket update: Defendant's memorandum contra to the State's Motion to amend Bill of Particulars & indictment filed by attorneys Mark C. Collins & Thomas F. Hayes. Next pretrial hearing on 1/24/25 @ 10am. 1/17/25 Docket updates: Warrant for removal from Pickaway County jail on 1/24/25, 2/10/25, 3/21/25, 4/26/26 & 5/30/25.
1/24/25 Update: Judge Hein wants hearings to be productive. 2-3 subjects today including amending bill of particulars (charges), firearm specs & motion to sever other charges. Prosecution wants to change what's in the indictment based on previous evidence in trial, including the actual address of one of the crime scenes (which is in Scioto not Pike County). Hein will issue a written decision - says he needs to decide if prejudice against defendant. Wagners lived in three different places over course of events, lived in Adams County when murders happened. Moved to Scioto. Evidence destroyed in Adams but hidden in Pike. Now on to other acts - or alleged crimes possibly not prosecuted by the family - can be admitted. Defense wants tampering evidence, forgery (of custody documents), interception communications (hacking into social media) charges dismissed & severed out. Defense says Wagner was not involved in those crimes etc. Charges 15-20 is what they want dismissed. Hein says he's told lawyers he does NOT want this trial to go 10 weeks like George's. Says there was lot of evidence in last trial that may not be as relevant. Motion from defense due in 2 weeks & then prosecution response due 2 weeks after that on other acts/severing charges. Arguing over how court will handle jury view if venue is changed. Hein ruled it should be moved, but victim's family appealed & waiting on that decision. Defense says jury view might not be relevant because so much has changed since crimes occurred in 2016. Defense lawyer Marc Collins also asking about judge Hein's voir dire jury selection process. Hein says he will be assertive & lawyers will know what they can & can't do very clearly. Defense lawyer Hayes asks for help with logistics & possibly nail down trial dates even with everything on hold. But hard to schedule given the current situation with appeals court. Hein brings up plea negotiations. Just saying he's checking on whether it's happening or not. Wagner indicated he wants to go to trial & that's what he wants so that's what we're working toward," lawyer Mark Collins said.
