Something odd has to be going on. They usually at least have the judge say is opening statment for the beginning of the day and at least say the witnesses name before the camera goes off. ETA-none of the tweets so far that are posted say anything about the first witness opting out.

Just getting ready to post the same thing. They're probably arguing again about the crime scene pics. They don't want them to show Hanna May's death photos. Probably the same for Chris, Jr.

Finally starting. Very long delay. Now talking about a mistrial again about the photos being shown. Also talking about GW4 being complicite. Also talking about him not being the shooter. They needed to have something in writing. ETA-The defense will have a continuing objection about photos being shown. The upclose photos.

PIKE COUNTY TRIAL: Today we expect to move to Scene 3 - Dana Rhoden's home.

Bryan White, a former BCI agent who processed it, will be on stand first.

Court has returned to session - to discuss the motion for mistrial. it was just oral yesterday - and denied.

Now it is written and being argued.

Defense attorney John Parker argues the case against #GeorgeWagnerIV is about complicity - never a question of the manner or cause of death.

He says repeated showing of gruesome crime scene + autopsy photos is prejudicial.

PIKE COUNTY TRIAL: Defense attorney John Parker argues the case against #GeorgeWagnerIV is about complicity - never a question of the manner or cause of death.

He says repeated showing of gruesome crime scene + autopsy photos is prejudicial.

Judge overrules the motion for mistrial.

State (Angela Canepa) argued the number of shooters was "absolutely in dispute" - and notes the burden of proof. Said they have to prove there was an aggravated murder.

nterestingly, Canepa referenced defense opening statements calling Jake Wagner a liar.

She says all the evidence - graphic photos included - will prove his story. So they must show them.

Bryan White takes the stand, as expected.
He is a former BCI agent, who was assigned to what they call "Scene 3." Now works in Madison Co. Sheriffs Office.

White was 2nd most senior crime scene investigator.
Remembers getting a call before 9 a.m. on 4/22/2016 - need to respond to Pike County for 2 victims, then jumped to 5 (and then obviously 8)

White was assigned to 3122 Union Hill Road - this was Dana's house. Chris Jr and Hanna May were also there.
Investigators call this "Scene 3."

Like we've heard about the prior two scenes, White says there were two agents assigned to the scene - he was lead.
They met law enforcement there and then started taking photos from the outside moving in.

White says he found cigarette butts and a $5 bill in the grass - most important things found outside.
Started processing the scene around 2:30 p.m.
