PIKE COUNTY, Ohio —

A town woke up one morning to the horror that eight people were brutally killed. The Rhoden family suffered an unthinkable loss eight times over on one late April night in 2016. And years would go by before an arrest was made, and the massacre of an entire family still haunts Pike County, Ohio to this day. On April 22, 2021 Edward Jake Wagner pleads guilty and agrees to testify against family members.

This trial is expected to be very long, and with any case there will likely be topics or claims presented that one personally disagrees with. Starting new thread for testimony in Wagner murder trial in Pike County. Also just learned appeals court ruled in media's favor allowing us to photograph and video any exhibit or evidence shown in court. It's up to us whether to publish or broadcast. Thanks

*Trial continues (Day 20) (@ 9am ET) - OH - Pike County 8 people dead: Christopher Rhoden, Sr. (40), his ex-wife, Dana Manley Rhoden (37), their three children, Clarence "Frankie" Rhoden (20), Christopher Jr. (16), Hanna Mae (19); Frankie's fiancée, Hannah Hazel Gilley (20), Christopher Rhoden Sr.'s brother, Kenneth Rhoden (44), & a cousin, Gary Rhoden (37). Hanna Rhoden's baby girl (5 days old), another baby (6 mos.) & a young child (3) were unharmed. (April 21-22, 2016, Pebbles) – for *George Washington Wagner IV (27/now 31) (Jakes’ bro) indicted (11/12/18), arrested (11/13/18), charged (11/15/18) & arraigned (11/28/18) with 8 counts aggravated murder, (plus gun specifications on each), 1 count of 1st degree conspiracy, 4 counts of 1st degree aggravated burglary, 1 count of 5th degree unlawful possession of dangerous ordnance, 3 counts of 3rd degree evidence tampering, 1 count of 5th degree forgery, 1 count of 5th degree unauthorized use of computer or telecommunications, 1 count of 4th degree interception of wire, oral or electronic communication, 1 count of 5th degree obstructing justice, & 1 count of 1st degree engaging in a pattern of corrupt activity. Plead not guilty. Held without bond. DA will seek the DP. Per Jake’s plea agreement, DP is off the table if his testimony is truthful.
Trial began on 8/29/22 with final jury selection & the jury was seated on 8/30/22. 12 Jurors & 6 alternates. Jury: (9 women & 3 men) & 6 alternates: (5 women & 1 man). 9/30/22: Ill juror replaced with alternate. 12 jurors & 5 alternates. Jury: (9 women & 3 men) & 5 alternates (4 women & 1 man).
Trial began with opening statements began on Monday, 9/12/22. (Trial is scheduled for 30 days).

Good morning from Pike County BCI agent Perry Roeser - part of the first search of the Flying W - up on the stand first. LOTS of evidence to get through.

Before jury is brought in, defense argues firearms about to be introduced not involved in murders. Should not be introduced. But prosecutor argues guns were on list from Jake Wagner's form. To show it's not a wish list but an actual list - which included George's name.

Also wants to show how they were ruled out by BCI's Matt White. Judge asks about list on Jake Wagner's phone. Prosecutor: evidence shows it is not a wish list as George says. Instead shows actual guns they owned - including SKS under George's name

Canepa: "great effort by George" on recording on R&L truck wiretap to describe as wishlist and that he knew he was being recorded. Prosecutors say this is independent proof of conspiracy. And they found 9mm Beretta George bought just days after murders

Defense: Can't link the list to actual guns ... it was only a type of gun - it was created a year before the murders.

Defense: Doesn't matter that this is part of their investigation. Not relevant to trial - especially since Jake told them were actual murder weapons were.

Adds that all the guns used were recovered - but not being introduced today.

Prosecutors - not introducing them to show they had guns and were homicidal maniacs. Instead, they are showing guns that are on the list. Judge asks they haven't issued his denial that it is a wish list. Canepa says they haven't heard Jake's statement either.

Prosecutors say they are amenable to cautionary instructions to jury either now or when they get instructions before deliberations

Prosecutor Wilson - also need to show how we ruled these firearms out during investigation, and how to show George was member of consipiracy. The list and subsequent guns shows he's part of it.

Judge denies defense motion in limine - says he will issue caution at jury instructions that evidence/guns can't be used as propensity. Given later evidence shown George denies the list shows consipiracy.

Actually BCI agent Ryan Scheiderer up first - led investigation. Starting with review of Peterson Road searches of Wagner home.

Was present at both - and he was the one who sent BCI agent to a Walmart to confirm what kind and size shoes were purchased.

SKUs on the receipt matched that of the shoes - this was in a different Walmart from where they were purchased.

Scheiderer says BCI also looking for murder weapons plus those on list on Jake's phone as potential "contributors" to the murders.

Didn't find any - and they knew Wagners were moving to Alaska and couldn't take them across Canadian border. So they wanted to look at other places that could store guns, hence the Flying W Ranch where Billy Wagner was living.

First search of Flying W done on May 13, 2017. Scheiderer was there for that.

Scheiderer: After the second search, it was "out of the bag" that BCI was looking at the Wagners. State put out press release after the Wagners moved to Alaska asking people to come forward but didn't say anything specific about weapons etc.

BCI also asked for a special judge for the case to handle search warrants etc. and control information. All sealed in separate county

Didn't yet know what guns fired the .30 caliber or .22 long rifle rim fire bullets when Peterson Road search. BCI didn't identify the actual guns until July 2017.

Outlined his duties as lead agents to coordinate warrants, direct agents, have an ops plan etc. Then get information and findings and consult with others.

Onto cross examination - asks about items on the Walmart list - gas medicine, baby wipes, cough syrup etc.

Scheiderer recounts first meeting Jake at Peterson Rd. around fire pit outside in April 2017. Did not ask about homicides at that point. Then met him again May 3 when George, Jake and Angela were loading stuff up into trailer.

George left as soon as Scheiderer arrived at that point. Scheiderer says Jake previously told him they were moving to Alaska at some point.

At second meeting - they were storing their belongings at Brown property where they were eventually searched.

Scheiderer says both lied to him about the murders at that meeting. Parker asks about media showing up at second search. Asks if there are leaks? Scheiderer says BCI did not alert anyone - and perhaps a neighbor called when they saw agents show up.

Parker asks if BCI ever asked George for his phone. No. Now on re-direct: Scheiderer says Jake called the Alaska trip just a recon trip to check it out, not that they were going to move. And that Billy expressed reservations about going.

Next up is return of former BCI agent Bryan White - who handled a lot of the search warrants. He is now lieutenant with Madison Co. Sheriff.

He was part of the team who searched Flying W Ranch in May 2017. He handled searching outside the house including outbuildings.

Gone through several barns and trailers with no evidence but now onto found some shell casings marked by flags

Defense objects again to the introduction of shell casings not directly associated with murders and anotehr bench discussion. Apparently overruled.

The shells in question were .22 magnum rounds.

More shell casings 9 mm caliber. Defense keeps objecting but overruled.

Junk asks if White was the lead crime scene agent on the search - yes he was. We're done with direct and headed for 15-minute break.

Good grief so this search of Flying W was done after the Wagner's left for Alaska and were moved out of their home on Peterson Road? So far we've seen 2 firearms just laying around in bedrooms.

PIKE COUNTY, Ohio — In a ruling issued Tuesday morning, the local appellant court issued a finding in favor of the Guardian and other media outlets, striking down archaic rules set by the judge overseeing Ohio’s worst homicide trial.

In a unanimous vote announced before 11 a.m., the justices of the Fourth District Court of Appeals ordered Judge Randy Deering of Pike County Court of Common Pleas to allow news media and the public to film exhibits in the trial of George Wagner IV.

Joining the Guardian was the Cincinnati Enquirer, CourtTV, WLWT channel 5, WKRC channel 12, WXIXchannel 19, and WCPO channel 9 of Cincinnati.

This morning and likely all day will be a volley of objections and sidebar conversations. This is NOT the search where police found the three weapons they say were used to killed eight members of the #rhoden family in April. Hearing that evidence won't come until next. week.

In their ruling on Tuesday, Judges Mike Hess, Jason Smith, and Kristy Wilkin said, “The right of the general public (and, by extension, the press) to attend criminal proceedings is a fundamental right guaranteed by the First Amendment to the United States Constitution. This right of access promotes both the fair administration of justice and the public’s confidence in the judicial system.’ The Ohio Supreme Court has observed ‘without the freedom to attend such trials, which people have exercised for centuries, important aspects of freedom of speech and ‘of the press could be eviscerated.’ Freedom of the press includes the right to ‘gather, write and publish the news’ including events occurring in open court.”

The Supplemental Media Order and Paragraph 16 of the initial Media Order are hereby stricken and deemed unenforceable.”

If trial watchers today are wondering why camera is showing us so much evidence, it is because of Court of Appeals ruling...a good day for freedom of speech, first amendment rights and freedom of the press. Don't worry, we won't see any blood.

I am viewing trial. I did not see any reflections. But if there were reflections, I guess it would depend on the quality of reflections and if people reflected could be identified.
