State will present texts between Jake and Hanna. Andy talking. Nature of relationship between them is relevant to the motive, etc. regarding custody.

Defense gets to argue before its admitted.

Oct 21, 2013 til ? Says these texts pre-date the incident.

AC says Jakes texts, threats before S was born are consistent, spread out over so much time that he threatened to take her away before she was even born.

AC says GW4 not being involved, the point is, like with Tabitha, when GW4 ran her off and took custody, the whole family was involved in that effort, just as they were when fighting for Jake to get custody by getting rid of Hanna.

Judge says he thinks its too early in their relationship to assume those disagreements could be considered part of the motive for murder.

AC is arguing that when Jake says "this child will always be with me" it indicates his mindset and how he controlled things after that regarding Sophia.

Starting new thread for afternoon session for Wagner murder trial. Before jury brought up - two sides arguing about text messages between Jake Wagner and Hanna Rhoden found on the laptop seized in Montana

Prosecution says they show the state of mind of Jake - a co-conspirator.

Defense says they're hearsay and that many extend well beyond the time of the indictment - some are from as long ago as 2013.

Judge says he wonders about relevance from 2013 - but prosecution says one of the messages shows Jake will take the child by force if necessary. Goes to the motive over time.

Defense says - they are not about the defendant. But prosecution says the family is all in this together and this shows full state of mind for the conspiracy.

Prosecution also says this leads up to a point in December 2015 ... Jake says this child is going to be with us no matter what. And then he can't control the situation.

Prosecutor Wilson: reads text from Jake sounds like threat - will take Sophie by force.

Judge agrees that one statement is definitely relevant. Now prosecution is going to show defense what exactly going to be shown and what is being taken out

I totally missed the part where he was in the car when they were purchased. That kind of smokes AW's story of her bringing them home and the boys not liking them, so she threw them away.

I don't agree. She shops and buys the shoes, boys are in the car, loads purchases, takes them out when they get home, they try on and don't like them.

Could be possible.

Yikes, Jake was so controlling before she was born. Insisted Sophia would always live with him. Hanna said she won't tolerate them trying to control her the way they did with Tabitha and her baby.

He was very threatening and controlling with Hanna. Didn't want Chris Jr. around the baby or holding her. Chris Jr must have said something Jake didn't like. This was 2 weeks before Sophia was born.

Jake is really, really controlling. He tries to keep her away from her family. She left for a while after baby was born, when she was stuck at the Wagners.

So why were these texts on the laptop anyway? Was Angela saving all these texts also? If so this is just crazy.. well we know she isn't right in the head anyway, but why save texts from 2013 of your son threatening someone that you later killed?

Testimony from Everslage (?) about texts between Jake and Hanna around the time Sophia was born.

Hanna says she's not moving in with him until he gets his own home. He is a "family guy" has a "family business", she has to be "part of that". Doesn't want AW to raise her child.

Hanna wants her own house or trailer for her own family. Wants Jake to stand up for her.

Good grief if my math is right Sophia is only 2 months old and Jake is talking about having another baby and Hannah is still a minor also.

Hannah seems so mature and Jake is like the child here.

Perhaps she saved them in case some day she needed them for leverage against Jake; to control him.

You can see how Jake did eventually force Hanna and Sophia to move in with his family, against her dad's wishes. So much pressure, probably some threats against her parents.

Hanna was becoming more independent. Was going to college for her nursing certification. JMO, she wasn't going to be financially dependent on him. It must have been miserable if she had to stay at the Wagners home when Jake wasn't home. He's telling her which diapers to buy.

Agree. Hanna just wanted to have a normal family, live a normal life with friends and family. Jake wants her inside their cult family.

Oooh. March 2015, Hanna said she didn't want to be with him anymore. He hurt her. JMO, that was when he was violent with her.
