Nash looks like he is viewing a horror movie.
Everyone at Defense Table is exhibiting extremely nervous mannerisms, fidgeting, squirming, etc.

Sure he looks pale, as did Jake.. in fact, Jake looked pasty. It's not as if they are exposed to a great deal of sunshine. Nearing 4 years in jail does that to a person. Jake looks as white as the guy in the movie POWDER, he is hideous looking in appearance. MOO

I also asked prosecutors whether Jake is testifying "to their satisfaction" as plea deal stipulates, but they said too early to tell.

James Pilcher just posted his tweets in the last hour. Everything is pretty much the same as has already been posted, except this one. ETA-he also has a tweet that says Jake didn't cover up Dana, but she was found covered with a blanket and pillow.

What shocked me was Chris Sr knew the W's burned their house for insurance money because they hid some of their possessions on his property before they burned it.

This is why I was hoping Jake would not opt out of audio/video. I wonder if Jake said they put their possesions at Chris's house. Which could mean Chris Newcombe. That would make more sense to me for some reason then storing them 15 miles away at Chris Rhoden's house. just wondering if the reporter who tweeted this actually meant for it to be Chris Sr house.

Sure looks like #jakewagner; albeit six years older than when I sat across from him at his home in Peebles. This will be the first time he has seen his brother since their arrest in November of 2018. #GeorgeWagnerIV #pikecounty. Headed up to court now.

Jake Wagner, 29, testified this morning that it was his father's idea around January 2016 to "do something" about Hanna Rhoden. And he said he was initially against it 1/8

He said he was growing increasingly worried that the daughter he and Rhoden shared may become a victim of child or sexual abuse. "I had a fear for my own daughter." 2/8

"At first I blowed up and said that was my daughter's mother,'' said Wagner, who is the younger brother of #GeorgeWagnerIV who is on trial in the eight shooting deaths of member of the Rhoden family. 3/8

He said he thinks that "he thinks" his mother, Angela Wagner was there for the conversation. But then, he and Hanna Rhoden had an an argument and after that "I went to my father and told him we had to do it." 4/8

At that point, he testified that he and his father, George "Billy" Wagner — who has pleaded not guilty and his trial is pending — began to plan the homicides. At first, Wagner testified that he wanted to kill Hanna and her then boyfriend, Cory Holdren. 5/8

He said he thought he could make it look like a murder-suicide. But he determined he couldn't get access to the couple. His father said there was no way they could kill Hanna without killing her father, Chris Rhoden, Sr. 6/8

So then the plan become that they would kill Hanna; her father, Chris Sr., 40; her brother, Frankie, 20; and her uncle, Kenneth, 44. However, Wagner said they knew the others living with them would likely have to be killed as well. 7/8

"I think the proper word would be they would be witnesses,'' he said. His father would plan the timing and the "surroundings. Jake Wagner's role: Buy a truck to avoid detection and get firearms and silencers. 8/8

When he walked into the courtroom, handcuffed by a leather belt around his waist and in a mis-matched jail uniform, he sat and looked directly at his brother and held the stare for a few seconds. His brother looked down, as he often does doodling and writing on a legal pad. 1/6

At one point when lawyers were on a sidebar at the bench, Wagner scanned the packed courtroom and seemed to lock eyes with someone sitting among the family members. "I'm sorry" he mouthed. 2/6

Then he looked down, blinked quickly and cleared his throat. Throughout his testimony, he has shown little emotion and often pauses appearing to look for the right word. He often asks Special Prosecutor Angela Canepa to repeat her questions. He has impaired hearing. 3/6

His hair is shorter, pulled back in a short ponytail, has a closely shaved mustache and goatee and is wearing glasses. 4/6

Wagner's testimony is key to the largely circumstantial case against his brother. There is much more testimony ahead, but Wagner has only said his brother was with him and his father when they bought the Chevy pick-up truck from his great-uncle to be used in the homicides. 5/6

Jmo today looked like it sealed George’s fate, but I do believe Jake lied about some things to try to make himself and his mother look better (and they didn’t). I don’t believe H responded with we will have to deal with it over the chance of Sophia being harmed. I wish we could have heard it all. And why would he grin and smirk when viewing that video, was he reliving that night in that few seconds? I don’t believe CN went along willingly to risk his life for someone else’s insurance. I don’t believe he was easy as he tried to make it seem when he was choking H. We heard how important chores were to him, he told H to make sure S does hers (a baby now having chores) I don’t believe he closed his eyes when shooting Chris. I still believe him and Angela had some type of weird relationship. Jmo
I agree--I don't believe Hanna was cavalier about the possibility of Sophia being molested--or that she thought for one minute her new boyfriend was a danger to either of her kids. It makes no sense that CN would risk his life for the Wagner insurance fraud. And the testimony about his restraint in choking (!!!) Hanna is typical domestic abuse BS. Of course he didn't close his eyes when shooting Chris. He looked everyone else literally in the face. The chore thing---that strikes me as cuckoo. He was all over the boundaries appropriate to co-parenting. It's a sign that Hanna would never have been a satisfactory mother in his eyes because he couldn't control either her or Sophia.

There is "planning," as in initiating discussion about murder as a solution but there is also planning, as in buying, creating, modifying materials for the massacre, as well as stuff we haven't heard about disabling cameras, etc.

So Jake said he, George and Billy stole goods from (was it) trailers or transporters belonging to big companies. JMO I wonder what sort of things they stole, did they sell them hmmm.

I've asked before here if defense lawyers even bother to ask the defendant to tell them what happened or if they prefer to not ask and see all the evidence then fit their own narrative to that. I mean at what point can a defense lawyer not defend a client if they think they are guilty.

It's one thing to attempt to get a fair trial for someone and to pick apart evidence to put down in the jurors minds and it's another thing entirely to know your client is guilty and then attempt to present a defense that tells a different story. That shouldn't be allowed. If they believe he did it or he's made inconsistent statements to them, then they try to say he wasn't there or he had no idea.. how can that be allowed? If he has told them nothing and they prefer it that way so they can defend him with a clean conscious then that I could see. So I am curious if the George had to sit down and tell them a story or if he just let them request the evidence and wait for it to come in and then find ways to put holes in the story without even telling a story of what George says.
Ethically, they can't present something they know to be false. You get around that but not asking the question and not letting your client tell you. Defense attorneys can speak to their clients in hypothetical. Defense attorneys will also tell you that what they think is usually irrelevant. In essence, in my opinion, guilt is not relevant to a defense attorney. Putting on a fair defense is the only thing that matters

Does anyone remember where this came from?
I am pretty sure she would "nag bag nag" about everything. So it probably is posted somewhere. It sounds familiar

IDK but almost every single woman in this case has been sexually assaulted. Tabbi, Hannah, Beth, Angie.

I can't get over Billy wanting to kill a 2 year old girl.

If I understand the offer, the DP is on the table for GW4 since he didn’t take a plea deal. Would GW4 care that now Jake might be subject to the DP if he feel’s that Jake is throwing him under the bus?

I would hope the defense was given each version of Jakes story as part of the discovery. Then during cross, the defense asks Jake to explain the differences, thus pointing out where he has told multiple versions of events. Which is the truth and which a lie? Who knows but it would show Jake as a liar, which raises a reasonable doubt on his testimony/proffer. IMO
Based on ACs opening, there is no way in which the DP can come back on the table for JW. It can just stay on the table for GW and BW. Once your sentenced, it's done

I think it's very possible Jake never wants his daughter to grow up to see or hear him say what he did. If he has the ability to feel shame, it would be because of his daughter.

He may have mouthed "I'm sorry" towards the gallery but I didn't see one single tweet mentioning he prefaced anything with "At the time" (I didn't think I had any other choice but to kill Hanna). Maybe he did but reading through the tweets, it certainly doesn't sound like he's changed his mind.

Well isn't he just a sweetheart. If he didn't want his daughter to grow up reading about what a monster he is he should not have killed her mother. You think he feels remorse???? I know he does not. He laughed when they played that clip from the movie. He was reliving his killings.
