Is it typical to spend days admitting evidence and arguing over it once the prosecution rests? I could be entirely off base, but I've never seen this. If they sort it out during pre-trial motions and have objections sustained or overruled during the case, why do they need hours of back and forth about what to admit?

The expert told the defense on cross-examination that she could not say who wore any of the shoes, but only said she knew that the sizes found were 10.5 and 11; the state has yet to say what size shoes the Wagner family wore.

Has there been clarification on the cash found on one of the victims? Or that there was a fight between Billy & Chris Sr? Did Billy have his own motivation (besides custody) for the murders? Revenge, spite, or to elude a debt?
It was testified early on the cash was a few dollar bills and a couple of fives I think.

The fight was tossed out by the judge because he considered it rumor I think. So it never got past the pre trial motions.

That's about all I know about it. Maybe someone else knows more?

That size 14 was posted by someone on here based on their calculations based on Billy's height. That was never testified to in court by anyone.

Neither has it been testified to what size shoe George or Jake or Angie wears.

You know, that could have been me. LOL I forget, but I have been really searching for BW's shoe size. They've brought in evidence from everyone but the Pope, and only one piddly interview from BW, and none from G4 (if AW was read her rights at the border then either they forgot to read G3 his, or they just don't want to play his interview, yet, it is him who is on trial). I digress, I remember doing calculations but those were American averages. They didn't even match my s/o. Still on the hunt, for size for G3. Can't believe they've not shared that. Maybe it's a size...Eleven? :eek:

Everyone is entitled to their opinion, and I would never disrespect a sitting judge, but I feel different. My thoughts stem from how a normal trial is conducted. I was confused when the proceedings started in the beginning..when the defendants were allowed to wear street clothes while in custody, during motion hearings. I could never understand that but I moved ahead. Only one person rules a courtroom and some of his rulings and procedures is where I smh..JMO
The defendants are innocent until proven guilty. That is why they are permitted to wear street clothes. It's not just this judge. Note AW and JW no longer wore street clothes b/c they admitted guilt and are awaiting sentencing.

That is why I think if it ends in a hung jury they won't retry it. They will just move on to Billy.

But, who's feet matched? AW, JW, G3, or G4? Oh, AW said they only took in the three men.

They did say that the one shoe print's, Big Toe impression was how they calculated the 10.5 shoe size.

I wonder if hammertoes make a deeper indentation when one walks. If so, might one Wagner male's Big Toe, be a hammertoe? I do think I remember that the molds came back inconclusive though. :mad:

(OT: Every single time I've heard the word hammertoe, in this case, I cannot help it, but my brain goes back in time, to the 80's, and it's; Hammertime!! Let's hope it's a positive omen. :rolleyes:)
It was never said if any of the molds matched to any of the W's feet. You can bet if one of the molds matched George Canepa would be crowing from the rooftops. So far not a peep out of her about those molds and who they matched.

The cash on KR was less than 10 bucks, IIRC, the fight is said to have happened, but no one can corroborate it, so they cannot bring it up in court. JM2, I believe BW had some motivation of his own. Revenge and anger toward CR2 are my main theories. I think each had a few of their own motivations, but it rolled into one, based on that one email the prosecution keeps bringing up. One common motivator is easier to prosecute than multiple.

My sis wears a size 9 and her hubby wears a 10. She says she wears his boots all the time when feeding the horses.

I wear a 6.5 to 7 and bought a pair of size 8 heels because they exactly matched the color of a suit I have. I stuffed the toes with sponge to make them fit. But dang did those heels look good with that suit. lol

I agree with Parker at this point. Haven't the jurors seen enough? AC said in the beginning that she went through all of the murder scenes, the ballistics, from the day they got the 911 calls, until they arrived at the proffers and to trial. I think that if they've been shown once, the jury is pretty sure that eight heinous murders were committed and AW and JW have in fact confessed in front of the jury. I didn't even see any photos and hardly any evidence photos and am convinced that eight people were murdered, and were autopsied. I would be rather ticked off at having to sit through it again. I'd want to hear evidence, solid, hard evidence, not see pictures of the deceased, that their families have to see as well, that do not prove who murdered them. JM2.

I understand that! If my muck boots aren't handy and the s/o's are, I wear theirs. Theirs are 3 1/2 sizes larger than mine. (I've noticed on another case on here, Missy Bevers, that the perp walked odd, as if they had on boots much too large for them. I know I do when I wear the larger boots.) Back when we used to go out on the town (which meant driving a few hours and an overnight stay) if the shoes were fabulous, but a bit small or large, I'd make them work too if they matched the rest of the attire. Gotta look good on that arm, that's walking you inside. ;)

I am right there with you on that. I want to see hard solid proof on george, not a bunch of pictures. We all know 8 people were murdered and after they described how many shots, where they were, not much else to say about that.

*Judge & Attorneys (@ 8am) & Trial continues with jury (Day 43) (@ 9am ET) - OH - Pike County 8 people dead: Christopher Rhoden, Sr. (40), his ex-wife, Dana Manley Rhoden (37), their three children, Clarence "Frankie" Rhoden (20), Christopher Jr. (16), Hanna Mae (19); Frankie's fiancée, Hannah Hazel Gilley (20), Christopher Rhoden Sr.'s brother, Kenneth Rhoden (44), & a cousin, Gary Rhoden (37). Hanna Rhoden's baby girl (5 days old), another baby (6 mos.) & a young child (3) were unharmed. (April 21-22, 2016, Pebbles) – for *George Washington Wagner IV (27/now 31) (Jakes’ bro) indicted (11/12/18), arrested (11/13/18), charged (11/15/18) & arraigned (11/28/18) with 8 counts aggravated murder, (plus gun specifications on each), 1 count of 1st degree conspiracy, 4 counts of 1st degree aggravated burglary, 1 count of 5th degree unlawful possession of dangerous ordnance, 3 counts of 3rd degree evidence tampering, 1 count of 5th degree forgery, 1 count of 5th degree unauthorized use of computer or telecommunications, 1 count of 4th degree interception of wire, oral or electronic communication, 1 count of 5th degree obstructing justice, & 1 count of 1st degree engaging in a pattern of corrupt activity. Plead not guilty. Held without bond. DA will seek the DP. Per Jake’s plea agreement, DP is off the table only for Jake if his testimony is truthful. But George still faces the DP as he did not take a deal.
Trial began on 8/29/22 with final jury selection & the jury was seated on 8/30/22. 12 Jurors & 6 alternates. Jury: (9 women & 3 men) & 6 alternates: (5 women & 1 man). 9/30/22: Ill juror replaced with alternate. 12 jurors & 5 alternates. Jury: (9 women & 3 men) & 5 alternates (4 women & 1 man). A few are in their late 20s or 30s, but most are in their 40s or 50s.
Trial began with opening statements on Monday, 9/12/22. (Trial is scheduled for 8 to 9 weeks (56-63 days). State rested their case on 11/10/22.

Defense witnesses: Bernard Brown, who allowed the Wagners to store trucks & trailers filled with their possessions at his Peebles car business from mid-2017 to mid-2018, the year the family spent in Alaska. Alex Staley, friends with George through his wife Samantha (who previously testified for prosecution). Went fishing with him, and George talked about his friendship with Frankie Rhoden.

I have a feeling any holdouts will be encouraged to do the "right thing", and he'll be convicted. Then again, they may be back in five minutes, with an all guilty. It's hard to tell. We can't see the faces of the jury, but boy, if I were a juror and had to sit through all of those photos again, I'd think it would seem rather desperate on the part of the prosecution, or that they thought I was too stupid to get it the first time, during the Prosecutions months of presentation of evidence via testimony, diagrams, ballistics, graphic photos, and the occasional, JESUS!! Surely calling upon Jesus worked.
