2/9/23 Thursday, Trail Day 1: Harrington will now have a bench trial, scheduled to take place on 2/13/23 at the Marlboro County Courthouse in Bennettsville. Initial testimony will be taken on 2/9/23 in Bennettsville because one of the State’s witnesses will be unavailable during the week of February 13.
Circuit Judge Michael Nettles is conducting a bench trial in the case, meaning there is no jury. Prosecutors said Harrington recently waived his right to a jury trial in an agreement that removed the death-penalty option if he is convicted. Only one witness is expected to testify on Thursday. The witnesses’ testimony was scheduled in advance of Monday’s start date for the trial because the person was not available next week.
Harrington has filed: Motion to have a solicitor provide written notice of evidence, Motion to prevent the state from seeking the death penalty against him, Motion to preclude public shackling, Motion for complete redecoration & transcript of all proceedings, Motion prohibiting defendant from being in jail clothing, Motion to incorporate all federal & state constitutional bases, Motion specially setting hearings on all pretrial motions, Motion to require constitutional grand jury proceedings, Motion for an order compelling heightened scrutiny & motion for non-waiver of rights.
Three witnesses for the State testified Thursday, including a radiologist & forensic scientist.

Attorney Heather Weiss with the S.C. Attorney General’s Office is helping in the prosecution of this case. Fourth Circuit Deputy Solicitor Kernard Redmond and Assistant Solicitor Elizabeth Munnerlyn are the lead prosecutors.

Harrington’s lawyer Boyd Young said, “Ella lowery lived a lifestyle that was dangerous and led to a laundry list of suspects.”

The state’s first witness was Delores Lowery, the mother of Ella and grandmother of Iyana. Lowery testified that she called 911 after coming home from work and finding her daughter faced down in a pool of blood in her home.

Bennettsville Police Sgt. Robert "Bob" Hale took the stand for the prosecution. Hale worked with the Marlboro County Sheriff's Office at the time of the killings and said they responded to the home and searched for Lyana.

Former Marlboro County Sheriff's Office Investigator Josh White and FBI Jackie Hamelryck testified Tuesday on behalf of the state.

Former Marlboro County investigator Trevor Hunt testified on behalf of the state Tuesday afternoon.

Testimony resumes Wednesday morning.

ABC 15 has learned the trial could extend into next week due to some witnesses not being available until that time.

A former Marlboro County investigator talked about the initial arrest in the trial of a man accused of double murder. The trial started on Monday at the Marlboro County Courthouse.

Jamie Seales was an investigator in May of 2017 when 36-year-old Ella Lowery and her 8-year-old daughter Iyana were killed.

Agent Connolly told the judge that he noticed something wasn't right with Harrington's hand when they questioned him after he was arrested in connection with the murders in Charlotte.

“ When I shook his hand, to me, it felt like something might have been wrong with his right hand for a couple of reasons. First of all, it felt like the bottom part of his hand was swollen. His handshake was very weak. And for a large guy, that just struck me as odd. During the course of the interview, I would try to watch his right hand to see what he was doing with it during that time. Most of the time, he would keep it under the table or he would keep his hand folded while he was talking to us. There were times that he would use his left hand for reasons that struck me as odd. Like, for example, he would sign his rights waiver statement with his right hand. But when he was offered a cigarette, everything with his right hand would stay down, and he would reach out with his left hand and just keep his right hand largely out of sight. So, I thought that was interesting and thought it should be followed up on," said Connolly.
He said there was an x-ray done on Harrington's hand.

Prosecutors said Harrington’s hand was swollen because he used it in the killings.
