Brown still refuses to give information on whereabouts of Leah's body, court hears​


Following the victim impact statements, Mr Atkinson KC gives submissions regarding the minimum term that Brown could spend behind bars.

The court hears that Brown has provided no information regarding the whereabouts of Leah. Investigators went to see him yesterday but he declined to speak to them. He also could have provided information to his own team of lawyers but has not done so.

Mr Justice Hilliard commends the team at Sussex Police and Kent Police, including Det Supt Wolstenholme and DCI Neil Kimber, for their investigation which they led from start to finish.

'A number of extremely serious factors' in the case​


Mr Henderson is now addressing the judge. He says that the prosecution served a large document of facts and submissions to the judge and the defence team.

Mr Justice Hilliard says there are “a number of extremely serious factors” in the case, including the disposal of the body, and adds that count two could be a minimum of 30 years on its own. The second count of murder, count two, relates to Alex Morgan.

The judge also says that the murders were of a sexual nature.

"There are no counter-balancing factors, only aggravating factors," Mr Henderson KC says.

Judge now addressing court​


Mr Justice Hilliard thanks both the defence and prosecution teams for their conduct throughout the trial.

The judge says: "Leah Ware was 32 years old when [Brown] murdered her. Her personal life had been difficult."

He adds: "People who met Leah spoke of her kindness and the warmth of her soul."
Regarding Alex Morgan, the judge says:

"She also had a number of difficulties in her life to contend with. She had two children who she loved very much, and parents who cared for her."

The judge says: "The person who bears responsibility for what happened here is the defendant, no one else."

Mr Justice Hilliard notes Alex’s love for her children, even during tough times:

“Who could ever forget the money she had gathered at her home for her sons, should something happen to her at Brown’s yard.”

Judge will not impose a whole life order​


The judge tells the court that he will not be imposing a whole life order on Brown.

A whole life order means that there is no minimum term and the person spends the rest of their life in prison.

A minimum term will be set - this is how many years Brown must spend in prison before being eligible for parole. The judge does say that, due to Brown's age, the minimum term may result in Brown spending the rest of life in prison.

Aggravating factors in the case​


Mr Justice Hilliard mentions that Leah’s mental health is an aggravating feature of the case and that Brown had been "using Leah Ware to satisfy his own sexual desires".

He says: "I cannot be sure how Brown killed Leah. I cannot be sure if he planned to kill her."

The judge adds that Brown's actions after the trial are considered another aggravating feature of the case, such as preventing a burial.

On failing to appear in court today and not saying what he did to Leah's body, the judge says of Brown: "His conscience is untroubled by what he has done."

Brown engaged in sexual activity with Alex Morgan 'against her will'​


Speaking of Alex Moran’s murder, the judge says: "She was extremely vulnerable when she was on her own at the isolated farm buildings."

He then mentions the trail of clues Alex Morgan left behind at her home should something happen to her.

Mr Justice Hilliard believes the murder took place in the shipping container and that Brown “engaged in violent sexual activity with her, against her will".

The judge says:

[Brown] had a preoccupation with violent, non-consensual sexual activity and that is what he planned to engage in that morning.

I am sure that he always intended that Alex Morgan would never leave Little Bridge Farm alive after he had carried out violent sexual acts with her.

And adds:

There was a significant degree of premeditation to this murder for at least 3 weeks. There are no mitigating factors at all
