My opinion hasn’t changed today, guilty as sin in my book.

Admits being in the area before, during and after she’s gone missing and murdered. Admits moving and burying the body on his own.
Witness says just before Lindsay was last seen a male matching his description was chasing her round the coppice with her escaping just before Lindsay appears in the same vicinity.
History of attacking women.
Defence story of a random guy asking him to move a body is ridiculous.
I can see that’s there, as yet, is no direct evidence of him murdering her but the circumstantial evidence combined with the DNA is overwhelming.

Ask yourself how many walks have you been on and ended up bumping into someone you don’t know & can’t describe and agreeing to move a body for them? Nope me neither

JMO

Has there been evidence of a history of attacking women ?

The DNA was only related to the disposal so far which he admits

I agree very likely guilty but worrying that no concrete evidence yet

Came from someone who supposedly knows the family, how much truth is in it is anyone’s guess.
A lot of what has been said/rumoured locally has transpired to be true so far.
If he has done it I can’t see him having not something similar to an obvious lesser extent previously

My Opinion remains the same. I think he was out to attack a lone female that day. I’m not saying he meant to kill her, but it could be an attack gone wrong.

The witness statement from the Coppice is interesting, we haven’t seen CCTV of him entering the Coppice, but I imagine the jury would have? Wonder what he’s wearing. I think that shows him loitering/stalking lone females in the area, and I think she had a very lucky escape.

I think the talk of the other person in the Gym with him is his family member, not his invisible friend the hooded man.

It still remains ludicrous to me that someone would kill a woman, leave her body in the coppice and approach a CHILD he doesn’t know, to dispose of the body for him. Why would you leave your freedom in the hands of a child. How could you be sure they would? Could? Do it? I don’t believe it and even if the Jury do return not guilty, I still won’t believe his fairytale fantasy of the hooded man.

He was wearing a hoody that day wasn't he?

I believe so.

If her description of a grey hoodie and matching trousers fit what he was wearing I think we can ignore her estimated age bracket. I find it notoriously hard to guess people’s correct ages, especially the younger generations.

I’ve just scrolled back. The don’t mention the colour in the court reporting, they have however showed the jury the CCTV.

Found Deceased - UK - Lindsay Birbeck, 47, Accrington, 12 Aug 2019 *Arrest* #3

3/3/20 Tuesday Day 4: Prosecution witnesses: Zoe Braithwaite (saw male in Coppice during her walk on 8/12/19). Lauren Henson (was at gym in Accrington-saw thin male at gym in the weight-lifting section). Anthony Dewhurst (was at same gym. he has confirmed that the male he saw on a police CCTV appeal was the same person who attended the guy). Jury was read statements. The first is from crime scene investigator Alison Baldry. She attended Accrington Cemetery on 8/25/19-the day after Lindsay’s body was found. She said she was tasked with carrying out a forensic archaeological investigation of a potential clandestine burial. This involved recording, excavating & recovering any remains. Another state was read out to the jury from a police officer. He explained the resources used during a search on 8/24. Prosecutor David McLachlan read the agreed facts to the jury. He said the defendant voluntarily attended Greenbank police station on 8/27/19, and he was informed he was under arrest. The jury heard from a teach at the defendant’s school. Because of reporting restrictions in the case we cannot name the school or the teacher giving evidence. Jury was also read part of the teacher’s statement. Her Honour Mrs Justice Yip has told everyone present, including the jury, that the trial will conclude for today and that the defendant is tired. Trial will resume at 10.30am tomorrow, 3/4.

Maybe I've picked it up wrong but was the closest she was to him 50 metres? Pretty hard to judge someone's age from that distance IMO! And in any case 16 to 20 only 4 years out, id say she was pretty close.

I've just gone back to look at the cctv footage of him when he was wheeling the blue bin. He's wear a grey tracksuit, definitely looks like it's a hoodie

From Lancs live-

Mr McLachlan said a search of the defendants home in Accrington recovered clothing which matched what he was wearing on CCTV clips from August 12, 16 and 17.

So the cops have recovered the clothes he was wearing on the 12th. So we will find out (for sure) if he was wearing a hoody.

I imagine Zoe B will be feeling terrible, possible survivors guilt and wishing she had been more proactive at reporting the matter to police earlier. I feel terrible (both relief and guilt) as I would normally have gone out for a walk in the area between 3.30 and 4. 30 so would think Zoe is feeling pretty horrific. I think he set out that day to attack a women and LB was in wrong place. I doubt she got further than the path at back of WA. She could have seen him ahead and had either 2 options, turn around and look vulnerable or try and front it out and continue walking, she had experience of young people and had teenagers so probably wouldn't have seen him as a threat... Moo though. All this said whilst I think he is guilty I am not sure the evidence thus far provides beyond reasonable doubt. Love this group, much better than the FB murder group. Thanks for everyone's thoughts. Really interesting.

wondering (still) what his intention was......'attack' seems unlikely....murder for the sake of it? or (more likely in my view) sexual assault or robbery

  • #519
I cannot make my mind up robbery or sexual motive..and as I said yesterday I find it worrying the prosecution opening didn't make their version known ...if he has no previous for either ..or no relative internet searches it's a difficult one ..hoping for more information today

He was looking for a female to sexually assault. As opposed to robbery. Previously, I had doubts about whether the defendant could possibly have acted alone. But Zoe Braithwaite's testimony has convinced me that it was him that killed Lindsay. Alone. MOO
