Just short of three years to the day that Kasprzak's body was found in the Jordan River, the preliminary hearing for the teenager accused of beating her to death began Monday.

Police say the boy was just 14 when he brutally killed his girlfriend. On Monday, a seven-day hearing began to determine two things: whether there is enough evidence for a judge to order him to stand trial, and whether that trial should be in juvenile court or adult court...

Leis gave graphic testimony about the numerous skull fractures that were likely caused by multiple blows with "significant force" to her face and head. He believes that the injuries Kasprzak suffered to her head were not survivable, even if her body had not ended up in the Jordan River. Because of water found in her lungs, Leis said he could not discount the possibility that Kasprzak was still alive when she went into the water. But he said she likely would have been unconscious at that point and "barely" alive.

The teen is now 17-years old and has been jailed in a juvenile facility since his arrest. He showed little emotion Monday morning as prosecutors and witnesses began their case against him...

Her step-father James Bratcher was first to testify and said Anne was last seen Saturday night at around 8 p.m. When they began searching for her he found a note in her bedroom. Bratcher testified that the note said she was heading to California and was pregnant. She also said she had lied to her friends. Bratcher also said they found several pregnancy tests in her room that showed negative results.

During testimony of the state's Medical Examiner he was asked if they had done a pregnancy test on Anne. "It (the test) was negative," said Dr. Ed Leis.

On Tuesday, a 17-year-old friend testified about texts he received from the defendant after Kasprzak's body was found. "He was trying to get me to remember an incident about Anne having a bloody nose," Spencer Criddle said... In fact, Criddle said the first he ever heard of Kasprzak's alleged nose bleed was when the defendant texted him asking him to "remember" the bloody nose incident in case he was questioned by police...

Criddle also testified that he was told by Kasprzak that she was pregnant with either the defendant's baby or a 17-year-old Ogden gang member named LJ's baby. He said the defendant told him that Kasprzak wanted to run away to California on the night she disappeared, but the defendant told her it wasn't a good idea and he didn't want to go with her. Kasprzak allegedly "freaked out," the defendant told Criddle. That's when the defendant allegedly left his house to search the nearby Jordan River Parkway for her...

On the night of Kasprzak's disappearance, Criddle said he received a short voicemail from her on his cellphone. He said it sounded like "an emergency," describing her tone as kind of anxious and stressed.

A juvenile court judge ordered a now-17-year-old boy to stand trial Wednesday, ruling there is probable cause to believe that he beat 15-year-old Anne Kasprzak to death in 2012 and then lied to police about her death. But the question remains of whether his case will remain in the juvenile court or if he'll be certified to stand trial as an adult...

Over the next four days, Nolan will hear evidence about the juvenile's mental health and psychological evaluations, as well as other testimony. He will then decide whether the teen's case should stay in juvenile court or be moved to the adult court system...

Kasprzak-Bratcher said she's concerned if the case stays in juvenile court, the accused teen will be released from custody when he turns 21, in just over three years. "He'll be 18 in three months," she said. "In three years, he'll be able to walk away. Annie didn't get to walk away."

"We strongly want him to be certified as an adult for a couple of different reasons. The first one is, he made a pretty adult decision. I mean, in the way that the medical examiner described the way she died, this wasn't a one time, accidental, 'I lost my temper,' this was a brutal attack. And that's a pretty adult decision to make," Veronica Kasprzak said...

"I think I might have felt differently if after it had happened if he had come forth and said, 'I really screwed up. I'm a kid, help me out, I need something.' But for him to evade and even now not take responsibility for what he's done… show very little remorse," Kasprzak said...

Kasprzak talked about her daughter's troubled past and how she was placed in and out of foster homes at a young age before she adopted her just before she turned 10. Because of her experiences as a young child, Kasprzak said her daughter had trouble trusting people. "I strongly believe everything that Annie did was very much from survival mode. 'How do I make sure I'm OK? How do I figure out who to trust and who not to trust?' As a teenager, even for those without trauma history, your first instinct is usually to trust your friends," she said.

During a brief court hearing, a Utah judge tentatively scheduled a Nov. 30 trial for Darwin Christopher Bagshaw, 18. But defense lawyer Chris Bown said he's waiting to receive a recorded interview that prosecutors may present as evidence and could impact the length of the trial, which expert witnesses are brought in and how the defense approaches the case.

A November trial for a teen accused of fatally beating his 15-year-old girlfriend and dropping her body in the Jordan River has been delayed until delayed until 2016.

Blanch reset the 12-day trial to March 7 and said the date should be considered "firm."
 
A Colorado man who pleaded guilty to killing his Utah girlfriend with a shovel over a mistaken pregnancy when he was 14 was sentenced to prison Monday.

Darwin "Christopher" Bagshaw, 18, was sentenced to at least 15 years behind bars.

The judge called the beating unspeakably vicious and cruel as he handed down the punishment in Salt Lake City.

"Words fail when one imposes sentencing in a case like this," Blanch said. Under Utah law, Bagshaw could serve up to life in prison. A parole board will set his eventual release date.
